Location of Property: 940 Homestead Way, Greenport CTM 1000-40-2-20
SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property
under consideration in this application and determines that this review falls
under the Type II category of the State's List of Actions, without further steps
under SEQRA.
SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as
required under the Suffolk County Administrative Code Sections A 14-14 to 23,
and the Suffolk County Department of Planning issued its reply dated January 2,
2009 stating that this application is considered a matter for local determination
as there appears to be no significant county-wide or inter-community impact.
BASIS OF APPLICATION: Request for Variances under Section 280-15, based on
the Building Inspector's November 12, 2008 Notice of Disapproval for a proposed
accessory swimming pool in a front yard instead of the code-required rear yard,
and for a fence at a height which will exceed the code limitation of four (4') feet
in a front yard location adjacent to C.R. 48 (a/k]a North Road).
AREA VARIANCE RELIEF REQUESTED: The applicant proposes an in-ground
swimming pool in a front yard, instead of the code-required rear yard. The
property contains two street frontages, resulting in two front yards. Also, the
fence is proposed to exceed code limitation of four feet in height for a fence in a
front yard, located at south side and part of west side of this parcel as shown on
the site survey prepared by Wallace T. Bryan, L.S.
FINDINGS OF FACT
REASONS FOR BOARD ACTION: On the basis of testimony presented, materials
submitted and personal inspections, the Board makes the following findings:
1. Town Law Section 267-b(3)(b)(1). Grant of the variance will not produce an
undesirable change in the character of the neighborhood or a detriment to
nearby properties. The 6' fence is used as a privacy barrier between the proposed

18' by 36' swimming pool and CR48, and the pool will be at least 65 feet from
southerly front lot line, at least 20 feet from the westerly side lot line which is
also screened, and greater than 25 feet from the easterly side lot line. The Board
feels that the granting of this application will not cause a detriment to the
immediate neighborhood, because several lots in the immediate area were found
to share the same unique situation, in that they all front on two public streets.
2. Town Law Section 267-b(3)(b)(2). The benefit sought by the applicant cannot
be achieved by some other method for the applicant to pursue, because there is
no other place on the applicants' property to build an accessory structure
without a variance.
3. Town Law Section 267-b(3)(b)(3). The amount of relief is not substantial based
upon the unique nature of two front yards that are back to back on this property.
4. Town Law Section 267-b(3)(b)(5). No evidence was presented to indicate that
the granting of variances would create a hazard on this property, or surrounding
properties.
5. Town Law Section 267-b(3)(b)(4). Based upon the immediate area of
residential homes with two front yards, the variances requested will not impact
either the physical or environmental characteristics of the immediate district.
6. Town Law Section 267-b. Grant of the requested relief is the minimum action
necessary and adequate to enable the applicant to enjoy the benefit of adding a
swimming pool, while preserving and protecting the neighborhood and the
health, safety and welfare of the community.
RESOLUTION OF THE BOARD: In considering all of the above factors and
applying the balancing test under New York Town Law 267-B, a motion was
offered by Member Simon, seconded by Member Weisman, and duly carried, to
GRANT the variance as applied, as shown on Map prepared by Wallace T.
Bryan, L.S. revised 9//26/08 (File #02-271).
Any deviation from the variance given such as extensions, or demolitions which are not shown on
the applicant's diagrams or survey site maps, are not authorized under this application when
involving nonconformities under the zoning code. This action does not authorize or condone any
current or future use, setback or other feature of the subject property that may violate the Zoning
Code, other than such uses, setbacks and other features as are expressly addressed in this action.
The Board reserves the right to substitute a similar design that is de minimis in nature for an
alteration that does not increase the degree of nonconformity,
