SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property
under consideration in this application and determines that this review falls under
the Type II category of the State's List of Actions, without further steps under
SEQRA.
SUFFOLK COUNTY ADMINISTRATIVE CODE: This application has been
referred as required under the Suffolk County Administrative Code Sections A 14-14
to 23, and the Suffolk County Department of planning reply states that the
application is considered a matter for local determination as there appears to be no
significant county-wide or inter-communit, y impact.
PROPERTY FACTS/DESCRIPTION: The subject property is a 7,700 squnre foot
nonconforming lot, measmSng 60 feet wide x 140 feet deep as shown on the survey
prepared August 21, 2008 by John Metzger, licensed surveyor.
BASIS OF APPLICATION: Request for Variances under Sections 280-124
concerning this 7,700 square foot parcel, and based on the Building Inspector's
August 22, 2008 Notice of Disapproval concerning a proposed deck and porch
additions to the existing single-fsmily dwelling, which new construction will be less
than the code-required minimum of 35 feet for a rear yard setback and which
exceeds the code-maximum limitation of 20% lot coverage.
Fiodings of Fact
The Zoning Board of Appeals held a public hearing on this application on January 8,
2009, at which time written and oral evidence were presented. Based upon all
testimony, documentation, personal inspection of the property, and other evidence,
the Zoning Board finds the following facts to be true and relevant:

RELIEF REQUESTED: The applicant proposes to add the following to their
existing two-story dwelling:
(1) an 8 ft. x 27.6 it covered front porch with columns, railings, and steps,
(2) a covered deck with columns and railings at the roar of the house at the first
interior floor level measuring 8 ft. x 27.6 ft x 7.8 ft high (above grade) with a set of
stairs measuring 4 ft. wide x 12 ft. and extending beyond the proposed covered deck
by 8 ft., and
(3) a second-story rear deck with railings measuring 8 feet x +/- 15.5 feet.
These proposed rear yard additions will create a non-conforming rear yard setback
of 27 feet for the proposed deck and porch and a rear yard setback of 19 feet for the
proposed stairs. Collectively, the proposed additions will increase the lot coverage to
25.3%.
ADDITIONAL INFORMATION: The applicant's home is a two-story modular
construction on a crawl space that currently meets the code's maximum lot coverage
of 20% and has a 35 ft. conforming rear yard setback. Because the dwelling had to
be built to FEMA standards, the finished first floor had to be much higher in
elevation than others in the neighborhood and therefore it appears much taller and
larger than other homes in the immediate vicinity which are typically modest one-
story ranch or bungalow style. The rear of the house was built with sliding doors on
both floors in anticipation of proposed rear deck additions. The house currently does
not have a Certificate of Occupancy.
At the public hearing on January 8, 2009 written and oral testimony was given by
neighbors who voiced their concerns over the applicant's dwelling changing the
character of the neighborhood by virtue of it's unusually large appearance on a small
lot and objected to increasing the lot coverage beyond what is allowed by code. They
also voiced concerns over the loss of privacy in their own rear yards that the
applicant's proposed elevated first floor and second story rear yard decks would
cause.
REASONS FOR BOARD ACTION: On the basis of testimony presented, materials
submitted and personal inspections, the Board makes the following findings:
1. Town Law §267-b(3)(b)(3)(1). Grant of alternative relief will not produce an
undesirable change in the character of the neighborhood or a detriment to nearby
properties. The addition of a slightly shallower front porch w/Il reduce the proposed
25.3% lot coverage and improve the appearance of the house from the street. A
smaller rear yard deck at the finished floor level will permit the applicant to enjoy
their rear yard while providing emergency egress and reducing the proposed
excessive lot coverage.

2. Town Law §267-b(3)(b)(2). Alternative reliefc-~nnot be achieved by some method,
feasible for the applicant to pursue, other than an area varlsnce because the house
currently has a code compllsnt lot coverage and roar yard setback so any proposed
addition win roquire a var~snce.
3. Town Law §267-b(3)(b)(3). The variances as proposed are substantlsl in that the
lot coverage of 25.3% roprosents a 26.5% variance beyond the code llmlts of 20% and
the proposed rear yard setback of 27 feet is a 22.85% variance beyond the code
roquired mlnim~ra of 35 feet.
4. Town Law §267'b(3)(b)(5). The rlifficulty has been self-croated insofar as the
applicant could have chosen to build a smaller house in anticipation of his desire to
have a front porch and two rear decks.
5. Town Law §267-b(3)(b)(4). No evidence has been submitted to suggest that a
variance in this rosidential community win have an adverse impact on the physical
or environmental conditions in the neighborhood. The house has been built to
FEMA standards and will adhere to the Town's drainage codes.
6. Town Law §267-b. Grant of alternative rolief is the mlnimunl action necessary
and adequate to enable the applicant to enjoy the benefit of a front porch and rear
deck while proserving and protecting the character of the neighborhood and the
health, safety and welfare of the community.
RESOLUTION OF THE BOARD: In considering all of the above factors and
applying the bslsncing test under New York Town Law 267-B, motion was offerod
by Member Weisman, seconded by Member Oliva, and duly carried, to
DENY the Variances as applied for, and to GRANT ALTERNATIVE RELIEF
as noted below and subject to the fonowing Conditions:
1. The proposed coverod front porch shall be reduced from 8 ft. x 27.6 ft. to
6 ft x 27.6 feet, and
2. The proposed secend-story roar deck shall be (is) denied and the sliding
doors secured according to code or replaced with windows, and
3. The proposed roar deck at the finished floor level shah be no larger than
10 ft. x 8 ft. with 3 ft. (maximum) high rAiliugs, and the roquired stairs to
grade must be located to the side of the open deck se that they do not
protrude into the side yard or the roar yard beyond the 27' non-
conforming roar yard setback granted by this Board; and
Subject to the following CONDITIONS:
1. The roar deck must romain uncovered and open to the sky.
2. A row of 5 ft tall or higher evergreens spaced 3 feet on center shall be

planted and continuously mgintAined along the applicant's westerly
boundary (side yard) for 35 linear feet from the southwest (rear) corner of
the house to the southwest (rear) corner of the property boundary.
3. Lot coverage based upon plans for the alternative relief granted above is
to be confirmed by a survey or letter from a licensed surveyor and the
apphcant before a building permit is issued.
That the above conditions be written into the Building Inspectors Certi~qcate of
Occupancy, when issued.
Any deviation from the variance given such as extensions, or demolitions which are not
shown on the applicanffs diagrams or survey site maps, are not authorized under thla
application when involving nonconformities under the zoning code. This action does not
authorize or condone any current or future use, setback or other feature of the subject
property that may violate the Zoning Code, other th~n such uses, setbacks and other features
as are expressly addressed in this action.
The Board reserves the right to substitute a similar design that is de mlnlmus in nature for
an alteration that does not increase the degree of nonconformity.

Also, since this is the Prahlow's home, thevwish t_o ret.ain~privacy from. thei.r neighbors w?ich
face the Goldsmith Marina and the water across Hobart Road. l;or privacy, they ~ntend to conunue
the existing 6' solid fence and add evergreens.

In accordance with your request at the public hearing the following information is
provided:
1. Front Porch square footage: 184.5 square feet
The stairs and deck shown on the survey prepared by Peconic Surveyors does not contain
all the required details. I will use the architectural plans prepared as a basis for
the calculations requested.
2. As shown on the plans the stairs start 4 feet from the house wall.
Risers are 14 each at 7 7/16" and treads are 13 each at 10", stairs are 4' width.
The horizontal distance from the top of the stair to the end of the last tread on the
ground is 10'-10", a totai horizontai distance of the stairs from the house waii to the
end of the iast tread is 14~-10'' TM
Setback from rear yard to the house, as shown on the survey is 35 feet. The setback to
the edge of the stairs would be 35' less 14'-~0" or a setback of 20-2" to the property
line.
The stairs were designed to go straight out so that the stairs do not block access to
the basement for future use of the basement for an underground garage. The rear yard is
lower than the front yard aliowing for an underground garage and the proper drainage
and compiiance with FEMA.
3. Square footage of the proposed deck is 8' x 27.5' = 220 SF. less the area of the
stair - 4'x 4' (16sf) = 204 square feet. The stair 10'-~0' x 4' = 43,33 SF

(I) An undesirable change will not be produced in the CHARACTER of the neighborhood or ~ detriment to
nearby properties if granted, because: The new house is a modular and the lot is nonconform i~ONl~ll~dli~lD OF APPI:AL$
house was a great improvement to the neighborhood, conforming to the character of the rest of the
neighborhood whleh has year round homes. The neighboring home is also modular and also conforms to the
character of the neighborhood. The addition of the front porch and deck will add a custom look and
architectural character to the modular.
The lot is only 7,700 sq.ft. And 60 feet in width. The location of the sanitary must be located in the front yard to
comply with Health Department regulations. The applicant has attempted to make setbacks as conforming as
possible. The existing house is only 27.5 feet in width. The deck addition will make the rear yard
nonconforming but the finished floor of the house is above grade and a deck or stairs is required.
(2) The benefit sought by the applicant CANNOT be achieved by some method feasible for the applicant to
pursue, other than an area variance, because:
The lot is only 60 feet in width and 140 feet in depth therefore the required front and rear yard setbacks can not
be met with the porch and deck. The proposed house is a great improvement to the dilapidated house
previously on the property. The covered porch improves the design of the house and provides "curve appeal".
(3) The amount of relief requested is not substantial because:
The required rear yard is 35 feet and the finished floor elevation requires large steps down to grade. The
garage is below the first floor and steps down to grade are required. The deck will not encroach significantly
into the rear yard. The majority of the homes in this neighborhood are on nonconforming parcels with
nonconforming setbacks. The addition of front porch will be a significant improvement to the look of a
modular home.
(4) The variance will NOT have an adverse effect or impact on the physical or environmental conditions in the
neighborhood or district because: The property was previously developed with a dilapidated house, there are no
environmental constraints except floor zone. The proposed house will be made conforming to New York State
Building Code. There are no wetlands.
(5) Has the alleged difficulty been self-created? ( )Yes, or (X)No. The lot is only 7,700 square feet and the
proposed year round house is attempting to conform to as many regulations as possible.

Dear ZBA, & Building Department,
I am here to request that the appeal for a zoning variance on CTM 64-5-30 on Old Shipyard Lane,
Southold, NY be denied. The building is already on 20% of the lot that is now allowable by law. They are
now asking for a variance to increase it to 25%. That is not acceptable. I have spoken to my good friend
Mario Sule, who's house abuts that property, and many surrounding neighbors, and are all in agreement
that this structure does not fit in with the architectural integrity of the neighborhood and should not have
been allowed to be built in the first place,
What we all see here is the pathway to an evolution of architectural destruction of the corridor leading to
Founder's Landing. This is one of the older neighborhoods that has not seen much change in the last 50
years (and to some extant 100 years). Perhaps this is not an historic district per say but it is an area that is
cherished for it's older homes and quaint vistas. One day that may be no more. That would be a shame.
This is why we need to freeze this construction and look at ways to change the regional zoning laws to fit
the area.
As it is, this house was built with the intention of a variance request. There is already a door on the back
of the second story thai leads to nowhere. That is where they want to add a second story deck. See
Article A~ Forget it! If they want that access.., use a ladder! We are also upset about the easement that
was allowed for the two car bay garage underneath the back of the property. What kinds of
environmental impact will that have? See Article B. We cannot let this continue! As per our Town
Supervisor it appears that this property was built in violation the local codes as they stand anyway.
My family home is one of the original Southold homesteads dated 1674. It would be a travesty if one day
I woke up and saw a house like the new one on Old Shipyard Lane built to replace my neighbor's house
right next to me. Especially because, not just for decks that could look over my property, but the
additional easement that allows a driveway to run the length of the property to two basement garages on
the back of the house. That kind of construction would certainly undermine the value of our property not
just for monetary concerns but also for the beauty of our area that we hold so dear.
Again this is why we need to change the zoning codes in areas such as this and not let this kind of
misconstruction continue. Thank you for your time and consideration

The lot coverage of 20% has been the code allowable since 1957. I do not think that the
lot coverage, as a footprint, is too much. Rather, it is the overall height of the structure on
the 20 % that is the problem. Further, the building permit, in my view based on what you
tell me, should not have been written if the builder included a 2nd story door that would
be non-functional without a variance and none had been granted. In other words, you
should not be permitted to build in anticipation of getting a variance. 20% lot coverage is
not unusual particularly down in that area. What is unusual is that the whole 20% appears
to be taken up by 2 storys of structure. That is what makes it an overwhelming building. I
should be around later on the week and you should feel free to come talk to me. Scott

They have submitted a request for a variance to the Southold
Town Zoning Board of Appeals for a proposed deck and porch
additions to the existing single-family dwelling, which new
construction will be less than the code-minimum of 35 feet for
rear yard setback and which exceeds the code-maximum limitation
of 20% lot coverage.
The hearing on this matter is scheduled for THURSDAY,
JANUARY 8, 2009 AT 11:30 A.M. at Southold Town Hall.
