(631)765-1809 Fax(631)765-9064 SEP 2 FINDINGS, DELIBERATIONS,AND DETERMINATION s iho4d jovi°t�4 MEETING DATE: SEPTEMBER 22, 2009 ZBA APPLICATION#6194 APPLICANTS/OWNERS: ANTHONY and LISA SANNINO PROPERTY LOCATION: 7490 Alvahs Lane, Cutchogue CTM 101.1.14.4 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions,without further steps under SEQRA. BASIS OF APPLICATION: The applicants request a Special Exception pursuant to Article III, Section 100-31B, subsection 14 of the Zoning Code, to legalize an as built Bed and Breakfast within their existing single-family dwelling, accessory and incidental to their residential occupancy under the Building Department's Certificate of Occupancy Z-32546 dated 08/22/07. The existing one bedroom for lodging and serving of breakfast to the B & B casual, transient roomers was created through additions and alterations to the applicants' existing one family dwelling by conversion of an attached garage attic to living space with balcony under Certificate of Occupancy No.Z-33732 dated 05122109. FINDINGS OF FACT The Zoning Board"of Appeals held a public hearing on this application on August 27, 2009 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, and upon review of the code requirements set forth pursuant to Article III, Section 280.13B(14) to establish an Accessory Bed and Breakfast, the Board finds that the applicant complies with the requirements for the reasons noted below: 1. Anthony and Lisa Sannino, the applicants herein, are the owners of the property, a flag lot with an easement along the northerly boundary providing access to Alvahs Lane. It is improved with a single-family dwelling with an attached three-car garage and a vineyard, as shown on the survey by Peconic Surveyors, P.C. dated March 7, 2007. The ownerslapplicants will continue to occupy same as their, principal residence while operating and managing their Accessory Bed and Breakfast. The`as-built guest room has a private exterior entrance to the house and interior connection within the principal dwelling. 2. The applicants plan to comply with the on-site parking requirements with a minimum of three (3) Page 2—September 22,2009 ZBA 9 6194-ANTHONY and LISA SANNINO PROPERTY LOCATION: 7490 AIvahs Lane,Cutchogue CTM 101-1.14.4 parking spaces, two (2) for the principal single-family dwelling use and one (1) for the Accessory Bed and Breakfast. The applicants comply with the requirements of a dwelling unit as defined in Section 280.12 of the Zoning Code. 3. The Accessory Bed and Breakfast, as applied for, is reasonable in relation to the District in which it is located,adjacent use districts, and nearby and adjacent residential uses. 4. The Special Exception is accessory to the principal dwelling use and will not prevent the orderly and reasonable use of adjacent properties. 5. This accessory use will not prevent orderly and reasonable uses proposed or existing in adjacent use districts. a, 6. No evidence has been submitted to show that the safety, health, welfare, comfort, convenience or the order of the Town will be adversely affected. 7. This Accessory Use is authorized under Zoning Code Section 280-13B(14) with Zoning Board of Appeals approval as noted herein, and with issuance of a Certificate of Occupancy as per Code from the Building Inspector before the Bed and Breakfast is occupied. 8. No adverse conditions were found after considering items listed under Zoning Code Chapter 280, Sections 280.142 and 280.143. RESOLUTION OF NE BOARD: In considering all of the above factors, motion was offered by Member Weisman, seconded by Chairman Goehringer,and duly carried to GRANT the Special Exception application for an Accessory Bed and Breakfast, to be used only in conjunction with the applicants-owners residence, and not as a separate independent use, as applied for, SUBJECT TO the following Conditions: a 1. The Owners shall occupy this single-family dwelling as their principal residence, 2. There shalP'be a flexible chain ladder properly installed for the second-floor bedroom area, 3. (A) An annual harvesting of grapes is permitted, and (B) There Shall be no commercial or retail uses on the subject property related to the manufacture of wine, including but not limited to wine tasting, educational programs, wine production, or„sales, without application to and approval by the ZBA of an area variance for acreage related to a proposed winery (a permitted use) on the applicants' non-conforming 5.2081 acre parcel where the code requires a minimum of 10 acres for a winery with a retail component, and a Special,Exception for a Winery with site plan review approval by the Southold Town Planning Boar(as per Code), 4. This production alone would sustain a small winery however we do have in our plans to purchase grapes from other local vineyards to bring additional varietals to our portfolio. R. 48 in the Agricultural Conservation Zoning District. Section 280-13B(14) "Uses permitted by special exception", B&B This site was created through a minor subdivision that was reviewed and approved by the Planning Board in 1990. The subject parcel created is a flag lot having a 50-foot piece of land stretching along the northern property line with access to Alvah's Lane. There is a 16,900 sq.ft. development area created as part of the overall subdivision with the purpose of creating and preserving farmland. The approved use of the property is residential and consists of a vineyard and 5,181 square foot dwelling with an attached 3-car garage all located in the development area. The following comments are for the Board's consideration: ZBA # 6194, Anthony and Lisa Sannino 1. The applicant is proposing a B&B having one guest room that will need to be reviewed by the Building Inspector for compliance with the criteria set forth in Town code section 280-13B(14 ) in relation to smoke alarms, signage, and the building code. 2. It has come to our attention that the proposed B&B is operating without the benefit of permit. It should be noted that the Code Enforcement Officer has sent a letter to the applicant indicating that they are in violation of the Town Code and that they should cease and desist the B&B operation until the Zoning Board makes a decision regarding this use. 3. Additionally, the Southold Town code Enforcement Officer has considered the current use of the site to be a winery having a retail component. As you are aware, a winery is a permitted use in the AC zoning provided a site plan is submitted to the Planning Board for review and approval as well as located on a parcel in which at least 10 acres are devoted to the vineyard. The subject parcel is only 5.2081 acres therefore; an application would need to be made to the ZBA for consideration of a winery with a retail component. 4. As mentioned above, this parcel was created through a minor subdivision approved by the Planning Board where there were Covenant and Restrictions recorded for the same. The applicants should provide copies of the C & R's to the Board and prove that the property and proposed B&B are not in violation of any of the said covenants. 5. Attention should be given to Section 280-142, General Standards and 280-143 special exception considerations, in relation to the alleged uses on site to the proposed B & B use. Specifically 280-143 (A) and (C) consider suitability of such district for the location of any such permitted use and the effect that the location of the proposed use and the location that entrances and exists may have upon the creation or undue increase of vehicular traffic congestion on public streets, highways or sidewalks to assure the public safety. At this time it is recommended that the applicant address the issues raised herein to the satisfaction of the Zoning Board prior to issuing a determination. Farmers provide fresh food, clean air, economic diversity, and aesthetic open spaces to all the citizens of our town_ In addition, land in agricultural uses requires less tax dollars for services than does land with residential or commercial development. Farmers shall have the right to undertake protected farm practices in the active pursuit of agricultural operations, including, but not limited to: clearing_ grading: plowing, aerial and ground 'spraying, the use of legal agricultural chemicals (including herbicides, pesticides, and fertilizers), raising horses, poultry, small livestock and cattle, processing and marketing produce, installing water and soil conservation facilities, utilizing farm crop protection devices, designing and constructing and using farm structures, including barns, stables, paddocks. fences, greenhouses, and pump houses, using water, pumping, spraying, pruning and harvesting, disposing of organic wastes on the farm, extensive use of farm laborers, training and others in the use and care of farm equipment, animals, traveling local roads in properly marked vehicles and providing local farm produce markets near farming areas. The Sannino home itself adds a low-key style and elegance that is what the North Fork of Long Island has continued to reflect over the past several years. As our neighbors,Anthony and Lisa are irreplaceable to us. Upon arrival to the community they immediately extended their help to us before they had even settled in themselves. They assisted us though the building process with their advice and expertise and stepped in, on very short notice,when the contractor we hired became too difficult to work with. Our home was completed on time with minimal fuss once they committed to working with us. The work was finished before the building permit expired and they walked us through final steps of acquiring our certificate of occupancy. The Sannino's have helped us in ways both large and small. From locking ourselves out and knowing we have a safe place to keep an extra key to helping us figure out air conditioning and heating glitches. There is never a feeling of intrusion on their part,which we enormously appreciate. We can only hope we are as good neighbors to them as they are to us. Please note that we were asked to address the memorandum on 8/25/09 3pm. 1. We believe we can meet all of the requirements to be in compliance with the criteria set forth in town code section 280-13B (14) 2. We were never notified by any such letter by code enforcement that we were in violation of any town code. We have however been following all of the procedures set forth by the town in order to obtain the required permit to operate the requested one room Bed and Breakfast. 3. We are not operating any such winery having a retail component at our home. During the process of obtaining a c/o for the construction of the one room Bed and Breakfast in which the building permit was issued on 6/19/08 and the c/o was issued on 5/22/09 there were three building inspections by a town inspector who would clearly be able to recognize the existence of a said winery. We do however believe that on 6/3/08 when we initially filed the building permit for the constructing of the Bed and Breakfast room and also filled for an agricultural barn we may have alarmed the building department with a website we developed showing a new business model allowing home wine makers to join us in the wine making process. We were quickly informed that such a use would not likely be permitted on our property. Given the size of our family and or property size we would not even want to operate this business at our home. We apologize for creating confusion or concern with any of the Town Departments. As a contractor I have been active with many construction projects in the Town Of Southold. I have been very successful with pleasing all of my clients with regards to their projects, and most important I would like to maintain an honest and productive relationship with the building department, and all of the Town departments collectively. We hope to be an asset to our community through Agri-tourism as well as through our construction services. 4. There are four mandatory winemaking sessions,as well as,one wine tasting class given by a local Long Island Winemaker.Educational viticulture sessions will be included. Session 1:Your freshly picked grapes will be crushed, destemed,and the fermentation process started. Session 2: Two week later,members will return to press their grapes and fill a barrel of their choice. I The small size of the parcel raises the question of whether this property can reasonably fit the description of a farm or an agricultural use. The owners should demonstrate that the building is truly for agriculture,and if they do so, we would concur that a site plan is called for and that it is appropriate for the barn to be located outside the building envelope. Otherwise,this bam appears to be for a residential use,and if so, the building should be constructed within the building envelope with no site plan necessary. The owners should be asked to submit something in writing that attests to their commitment to agriculture... records of their wine production,evidence that they have a larger farm—maybe they lease land and grow grapes elsewhere in town in addition to this parcel.
