BETWEEN
ROBERTA JAKLEVIC, surviving tenant by the entirety of William J. Jaklevic who died a resident
of Suffolk County on May 3, 2005, Surrogate's Court File #1307P2005, residing at 900 Old Harbor
Road, New Suffolk, New York 11956, party of the first part, and
ROBERTA F. JAKLEVIC and JOHN J. JAKLEVIC, as Trustees under the Roberta F.
Jaklevic Qualified Personal Residence Trust dated July /o, 2009, residing at 900 Old Harbor
Road, New Suffolk, New York 11956 and 45 Apple Court, Southold, New York 11971, respectively,
party of the second part,
WITNESSETH, that the party of the first part, in consideration of Ten and 00/100--($10.00)--dollars, and other
good and valuable consideration paid by the party of the second part, does hereby grant and release unto the
party of the second part, the heirs or successors and assigns of the party of the second part forever,
All that certain plot, piece or parcel of land, situate, lying and being in the Town of Southold, County
of Suffolk and New York, being bounded and described as follows: ·

BEGINNING AND INTENDED TO BE the same premises conveyed to the party of the first part by deed
dated February 20, 2003 and recorded in the office of the Clerk of the County of Suffolk on February 20, 2003
in Liber 12236 at Page 372.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads
abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances and all
the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the
premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of
the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the
first part will receive the consideration for this conveyance and will hold the right to receive such consideration
as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same
first to the payment of the cost of the improvement before using any part of the total of the same for any other
purpose. The word "party" shall be construed as if it read "parties" when ever the sense of this indenture so
requires.

at the northwest corner of said land of Kwit; running thence along, land'of Kwit, Wickham and.Lpck~vood

TOGETHER. with all dght of ways easements and privileges and subject to all covenant, restrictions and agreements
of record.
Subject to rights of others over the road, 33 feet in width, running from Old Harbor Road southwesterly and thence
southeasterly through a portion of the premises.
The parties of the second part, their heirs, executors, administrator and successors shall have ~ right of way and free
access to all of the canals in the Hardngton H. Tuthill property, known also as School House Creek Association, and
to have sole use of 15 feet in the canals in front of and adjacent to the premises herein conveyed to maintain landing
and docks; the parties of the second part and their grantees or successors in interest to leave a right of way for
vessels to come and go freely of at least a 30 foot channel in the middle of the canals.
