good and valuable consideration paid by the party of the second part, does hereby grant and release unto the
party of the second part, the heirs or successors and assigns of the party of the second part forever,

RUNNING THENCE along said easterly line of West Creek Avenue, North 00 degrees 52 minutes 50 seconds
East, 140.20 feet to a concrete monument;
THENCE along land now or formerly of Jerome A Appelquest and Helen B. Appelquest, his wife, North 72
degrees 39 minutes 40 seconds East, 200.07 feet to a concrete monument;
THENCE along other land now or formerly of Jean M. James, Sogth 03 degrees 42 minutes 45 seconds East,
109.51 feet (calc.) (South 05 degrees 56 minutes 20 seconds East, 1'09.54 feet) to a concret~ monument set
on said northerly line of Midwood Road;
THENCE along said northerly line of Midwood Road, South 65 degrees 40 minutes 10 seconds West, 219.74
feet to the point or place of BEGINNING.
BEING AND INTENDED TO BE the same premises conveyed to the party of the first part by deed dated
7/11/96, recorded 8/14/96 in Liber 11787 page 480, the grantors herein being same persons as the grantees
in deed recorded in Liber 11787 page 480.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads
abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances and all
the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the
premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of
the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby the said premises have been encumbered in any way whatever1 except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the
first part will receive the consideration for this conveyance and will hold the right to receive such consideration
as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same
first to the payment of the cost of the improvement before using any part of the total of the same for any other
purpose. The word "party" shall be construed as if it read "parties" when ever the sense of this indenture so
requires.
