THIS INDENTURE, made the ~b'-q'tn day of November, 2009 BETWEEN

party of the first part,
STEVEN SWEENEY, residing at 190 North Drive, Mattituck, NY 11952
party of the second part,
WlTNESSETH, that the party of the first part, in consideration ofTEN ($10.00) dollars,
lawful money of the United States paid by the party of the second part, does hereby grant and release unto
the party of the second part, the heirs or successors and assigns of the party of the second part forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate,
lying and being in the Village of Mattituck, Town of Southold, County of Suffolk and State of New York,
known and designated as and by the Lot # 11, on a certain map entitled, "Mattituck Heights, subdivision
map, property of Gustav Bayer, situated at Mattituck, Suffolk County, N.Y", surveyed February 19, 1927,
by Otto W. Van Tuyl, licensed surveyor, Greenport, Mew York, and filed in the Office of the County Clerk
of Suffolk on March 25, 1927, under file no. 192.
TOGETHER with the use of a right of way 8' wide to and from Wickham Avenue to Long Creek, a branch
of Mattituck Bay, to pass and repass on foot only; said right of way commencing at the northerly junction of
Middle Road and Wickham Avenue, at a concrete monument, nmning in a westerly direction, 8'; thence
running in a northerly direction 130 feet parallel with the boundary line of Hubert W. Klein and Gustav
Bayer, to mean high water mark of Long Creek; thence running in an easterly direction along Long Creek to
land of Hubert W. Klein; thence nmning in a southerly direction along the westerly boundary of Hubert W.
Klein 130 feet to a concrete monument; thence northerly to the junction of Middle Road and Wickham
Avenue, the point or place of beginning.
BEING AND INTENDED TO BE the same premises conveyed to the party of the first part by deed dated
September 1 st, 1970, and recorded in the Office of the Clerk of the County of Suffolk on September 2nd,
1970 in liber 6800 page 417.
THE GRANTOR HEREIN RESERVES A LEGAL LIFE ESTATE IN THE PREMISES FOR THE
TERM OF GRANTOR'S LIFE.
:TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and
roads abutting the above described premises to the center lines thereof.
TOGETHER with the appurtenances and all the estate and rights of the party of the first part in and to said
premises.
TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or
successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby the said premises have been incumbered in any way whatever, except as aforesaid.
AND THE party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party
of the first part will receive the consideration for this conveyance and will hold the right to receive such
consideration as a trust fund to be applied first for the purpose of paying the cost of the improvement, and
will apply the same first to the payment of the cost of the improvement before using any part of the total of
the same for any other purpose. The word "party" shall be construed as if it read "parties" whenever the
sense of this indenture so requires.
IN WITNESS WHEREOF, the party of the first part has duly executed this deed the day and year first
above written.
