SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated October 6, 2009 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: A letter dated October 2, 2009 confirming consistency with LWRP policy standards was submitted to the Board of Appeals under Chapter 268, Waterfront Consistency Review of the Town of Southold Code and Local Waterfront Revitalization Program. PROPERTY FACTS/DESCRIPTION: The subject property is a 237,789 square foot parcel measuring 477.45 feet along Old Main Road on the north, 413.12 along the eastern border, 560.27 (110.39+46.84+163.53+ 147.26+92.15) feet along Budd's Pond to the south, and 571.79 (292.21+12.00+35.00+12.00+ 220.58) feet along the western border. The lot is improved with a one-story restaurant building, a swimming pool, and two one-story frame buildings as shown by a survey prepared by John T. Metzger, L.S., dated September 24, 2003. BASIS OF APPLICATION: Request for Variances from Code Sections 280-56 and 280-116, based on an application for a building permit and the Building Inspector' s July 27, 2009 Notice of Disapproval Concerning proposed addition/alterations to a (restaurant) building, the new construction is proposed: (1) at less than the code-required minimum of 75 feet from a bulkhead adjacent to Budd's Pond, and (2) at less than the code-required minimum of 35 feet from the front yard lot line. Page 2- December 22, 2009 ZBA File#6333 - William Liebl~in CTM: 1000-56-6-6.1 at 62300 Rt. 25, Sou~hold FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on December 3, 2009, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: RELIEF REQUESTED: Applicant seeks a variance to allow retention of a 0.5 foot setback from Old Main Road for a wooden deck on the roadside and a wooden waterside deck 20 feet from the bulkhead. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted, and personal inspections, the Board makes the following findings: 1. Town Law Sect. 267-b (3)(b)(3)(1). An undesirable change will not be produced in the character of the neighborhood or a detriment nearby properties. The applicant proposes construction of an outdoor grade level water-side deck between the existing restaurant and an existing wood retaining walls. The water-side deck will be visible only from the water and the restaurant. The decks will be almost entirely within the confines of an existing retaining wall. 2. Town Law Sect. 267-b ¢3)(b)(2). The benefit of adding decks to allow outdoor seating within the confines of existing retaining walls cannot be achieved by some method feasible for the applicant to pursue other than an area variance. The building to which the decks are to be attached is already nonconforming. 3. Town Law Sect. 267-b (3)(b)(3). The amount of relief requested is not substantial. The proposed decking will be unenclosed and is of Iow profile and will be within the confines of existing retaining walls. 4. Town Law Sect. 267-b (3)(b)¢5). No evidence has been submitted to suggest that a vadance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. All new construction will be at or near grade level and within the confines of existing retaining walls. 5. Town Law Sect. 267-b (3)(b)(5). The difficulty has been self-created so far as the changes proposed ara the result of the applicant's desire to modify a pre-existing structure. 6. Town Law Sect. 267-b. RESOLUTION OF THE BOARD: In considering all of the above factors under New York Town Law 267-b, a motion was offered by Member Simon, seconded by Member Weisman, and duly carried, to GRANT the area variances as applied for. Per Site Plan dated July 21, 2009 and Elevations dated July 16, 2009 prepared by Sepenoski - Stoltze Design. Any deviation from the variance given such as extensions, or demolitions which are not shown on the applicant's diagrams or survey site maps are not authorized under this application when involving nonconformities under the zoning code, This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. The Building department has called to our attention the fact that there is a discrepancy in the resolution and referenced drawings with respect to the partial roof addition. Specifically, the resolution makes reference to the Site Plan dated July 21 st which clearly shows the 10' by 37'~artial roof addition. It also makes reference to an elevation drawing which has an earlier date of July 16 which was an inaccurate drawing inasmuch as it failed to show the partial roof addition although it did show the front facade addition. I believe that everyone was of the understanding that our application was to include the partial roof addition as shown on the site plan and explained in testimony at the public heating. In addition, I further clarified this matter in my letter to the Board dated December 11, 2009 (copy attached). I have also enclosed a copy of my final plan and elevation drawings for your reference. In light of the above, I would appreciate your discussing this matter with the Building Department and clarifying the intent of the variance which was granted so they can proceed with reviewing our application for the building permit. It was agreed at the hearing by Mr. Lieblein, the Owner of the property, that the southerly (waterside) deck would remain open without a roof at this time. However, I wish to call to the Board's attention that our application and accompanying drawings do call for a new roof addition on the northeasterly comer (parking lot side) of the wrap around deck. In addition, there is a proposed reconfiguration of the Main Road side roof line from the existing double gable barge look to a taller, single gable, more conventional looking roof line which is meant to conceal the existing roof mounted mechanical equipment. Both of these items are critical to the design and intended use of the restaurant and I wanted to make certain they were included in the final resolution. I have attached a copy of an artist's preliminary conceptual rendering for your reference in the above which I hope you will find helpful in clarifying the intent and extent of our application. Subsequent to the issuance of a variance (ZBA File # 6333), my client has been advised by the DEC that the waterside deck is unacceptable to them as originally presented and requires modification. The nature of the modification is to reduce the depth of the deck from 30' to 20' thereby moving it 10' further back fxom the retaining wall and bulkhead. They are allowing that the deck area lost by this additional 10' setback can be added as a 20' by 30' addition to the east over the existing parking lot. This modification is presently shown on the enclosed map. It is my opinion that the spirit of the relief granted in the variance is maintained if not enhanced by the increased setback from the bulkhead and respectfully request your review of the enclosed and are hopeful you will concur with my opinion. It was agreed at the hearing by Mr. Lieblein, the Owner of the property, that the southerly (waterside) deck would remain open without a roof at this time. However, I wish to call to the Board's attention that our application and accompanying drawings do call for a new roof addition on the northeasterly corner (parking lot side) of the wrap around deck. In addition, there is a proposed reconfiguration of the Main Road side roof line from the existing double gable barge look to a taller, single gable, more conv~entional looking roof line which is meant to conceal the existing roof mounted mechanical equipment. Both of these items are critical to the design and intended use of the restaurant and I wanted to make certain they were included in the final resolution. I have attached a copy of an artist's preliminary conceptual rendering for your reference in the above which I hope you will find helpful in clarifying the intent and extent of our application. The widths of the deck areas are eight feet with two lengths of 68 feet and the other 79 feet. The center deck is proposed of a size lO' by 14'. 4. By this applicQtio~, appellant requests a Special Excep- tion to. permit the installation and_relocation of three new fuel storage tank's within containment walls with an overall Outside dimension of 24'10" by 16'6", more o? less, as.shown on diagram (A-l) dated October 31, 1985 prepared by Peconic Associates, with tO $outhold Town Board of Appeals -41- July 31, 19B~mlspecial Meeting (Port of Egypt, Appeal No. 3525-SE, decision, continued:) a setback of 13 feet from the edge of rip'-rap along the water's edge at its closest point from the outside of containment wall, and 23 feet to the first fuel tank, as amended. 4. The newly proposed fuel tanks are to replace existing fuel storage tanks which are presently located at the easterly portion of the subject premises as required by Article 12 of the Suffolk County Health Code and in compliance with the Provisions of the National Fire Protection Association {NFPA) regulations, Tidal Wetland Land Use Regulations 6 NYCRR, N.Y.S. Fire Code, etc. 5. Article VIII, Section lO0-80(B), subsection (16) permits by Special Exception approval from this board the sale and storage of fuel in the "C-Light" Industrial Zoning Districts and subject to site plan approval from the Southold Town Planning Board in accord- ance with Article XIII of the Zoning Code. By action taken March 24, 1986, the Southold Town Planning Board referred the site plan to the Building Department for certification in accordance with Section 100-133(C). 6. It is noted for the record that actions have been taken under Applications No. 3494 and 3495 by this board con- cerning similar relief, as noted therein, and action taken simul- taneously herewith under Appeal No. 3524. 7. It is the opinion of the board members that it would be within the best interests and protection of the public, customers, employees, etc., if the fuel-storage tanks were located in area more distant than the area chosen, as further noted below. In consider(rig this application, the board finds and deter- mines that by locating the proposed fuel tanks with containment enclosure and fencing at a distance, noted'below: (al the use of same will not prevent the orderly and reasonable use of adjacent propeties or o.f properties in adjacent use districts; (bi the use will not adversely affect the safety, welfare, comfort, convenience or order of the town; {c} the use is in harmony with and will promote the general purposes aMd'intent of zoning. Setbacks to be: {a) from existing stack-rack building 135 feet to west corner of tank and pump; (b) 77 feet from southeast corner of existing one-story motel building at closest point; (c) 35 feet from southeast corner of loading ramp sump no closer than 25 feet to rip-rap; 5. Proper diking and cement walls containment to retain any leakage of fuels; 6. Signs to be placed on fencing identifying danger'and requiring "no smoking" as per National Fire Protection Agency standards. Vote of the Board: Ayes: Messrs.
