Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is CONSISTENT with the Policy Standards and therefore is CONSISTENT with the LWRP. Pursuant to Chapter 268, the Zoning Board of Appeals shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. The subject premises is located in the "A" Residential and Agricultural Zoning District which requires minimum sideyards at l0 and 15 feet and maximum total lot coverage Up to 20 percent of the lot area. 4. Article XL, Section lO0-11g.2, subparagraph A(1) requires all buildings proposed on lots adjacent to the Long Island Sound to be~set back not less than one-hundred [100] feet from the ordinary highwater mark. 5. FoP the re~ord it is ncted that: (a) the N.Y.S. Department of Environmental Conservation by letter dated July 30, 1987 determined That no permit is necessary unuer .Article 25 of the Environmental Conservation Law, and (b) the Southold Town Trustees waived jurisdiction by letter dated August 28, 1987. 6. By this application, appellant is proposed to construct an open woooen decK at the rear (north} end of the existing dwelling, extending to the nearest existing concrete block wall not more than 19 feet, leaving a setback from the tie line along mean high water au 60± feet, and from the furthest wood bulkhead at 17 feet at its closest point. The width of the deck at its widest Point is proposed at 50.02 feet. Al~o proposed is an open oecK area along both sides of the dwelli-ng from the rear cf the house and extending southerly to the e%isting Dlamuer and stoop areas, all as shown by the sketched survey submitted with this aeplication. 7. The total "tot coverage requested for the existing and proposed deck ~nstruction is 2559 so. ft. In considering this appeal, the Board also finds ano determines: (a) that the ~elief reques~eo is not substantial ~n relation to the nean highw~er mark; (b) that the percentage of relief requested as to lot coverage is eight oercent over the max~mem-oermitted; (c) that along the rear and both sides of this property are constructed con'~rete block walls, which lend to the uniqueness of this o]rcel an~ creation of the difficulties imposed herein; (d) that the circumstances are un~que to the parcel and are not aersona~ in nature; the existi to pursue situation and which (h) that the construction as proposeo is landward of ng bulkhe'ad and existing concrete olock wall; that ther~ is no other method feasible for appellant other tha~ a var]aoce; that this!proposal would alleviate the multi-level of the rearyard ana possible erosion in the future the Board.,finos are sufficient to warrant; that in vi'ew of the manner in which the difficulties in consid6ring all the above factors, the interests Page 3 - Appl. The decks be constructed at a height above 9rade not to exceed 16 inches {two 8" steps as proposed herein); 2. The decks remain open, unroofed ~nd .nenclosed at all times as proposed herein; 3. The decks not be constructed past or over the existiq§- concrete party walls; 4. That this construction shall not be useo in deter- mining the average established setbacks for a principal building as to liveable floor area, etc. Vote of the Boare: Ayes: Messrs.
