Box 1179 Southold, NY 11971 Telephone: 631 765-1938 Fax: 631 765-3136 LOCAL WATERFRONT REVITALIZATION PROGRAM TOWN OF SOUTHOLD To: Martin Sidor, Chair f Town of Southold Planning Board,/ From: Mark Terry, Principal Planner X'4v LWRP Coordinator Date: May 5, 2009 Re: Proposed Conservation Subdivision of Briarcliff Sod SCTM# 1000-97.-10~1, 85.-3-12.1 & 12.2 2009 Zoning.District -..AC This proposal is for a conservation subdivision of a 24.97-acre parcel into three lots where Lot 1 equals 1.71 acres, Lot 2 equals 1.71 acres and Lot 3 equals 21.55 acres from which the Development Rights to 21.22 acres have been purchased by The County of Suffolk for the purpose of farmland preservation. The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, the proposed action is CONSISTENT with the LWRP, provided that the below recommendations are required in the subdivision approval. To further Policy 3.1, "Enhance visual quality and protect scenic resources throughout the Town of Southold", C. Screen components of development which detract from visual quality; and Policy 12.1, "Protect agricultural lands from conversion to other land uses." D. Provide buffers between agricultural and non-agricultural uses. New development located adjacent or in proximity to agricultural land or uses should provide sufficient buffer between agricultural and non-agricultural lands to protect agricultural uses from interference from non-agricultural uses, and protect non-agricultural lands from potentially offensive agricultural practices. It is recommended'that if the action is approved, a vegetative buffer be established adiacent to the northern property boundary on Lot 2 between Lots 2 and 3 to minimize potential conflicts between the future residences and current and future agricultural use. It is recommended that the vegetative buffer be required in lieu of the cleating limit restrictions required on each lot. To further Policy 4.1, "Minimize losses of human life and structures from flooding and erosion hazards." the following is recommended. The following management measures to minimize losses of human life and structures fi.om flooding and erosion hazards are suggested: Minimize potential loss and damage by locating development and structures away from flooding and erosion hazards. Proposed Lots 1 and 2 are located on the parcel where lower elevations occur on the parcel (15 feet NGVD). The surface storm water (sheet flow) on Lot 3 is expected to flow from north to south and pond in the southern section of the parcel. It is strongly recommended that the Board require that a grass swale be constructed on Lot 3 south of the 15 foot elevation and north of the Lot 2 parcel boundary to protect' the residential uses on the lots form storm event flooding. The length,, width of the swale should be determined by the Town Engineer. To further Policy 5, "Protect and improve water quality and supply in the Town of Southold" and protect and improve the water quality and supply in the area, it is recommended that the following best ,management practices be required: 1. Require the use of gutters, leaders and subsurface drywells to retain surface runoff. 2. Require the use of native plants and encourage the use of disease-resistant and drought-tolerant plants in landscaping. 3. Prohibit the residential application and use of synthetic pesticides and fertilizers capable of entering the potable water supply. 4. Require pervious driVeway be constructed to serve each lot.
