Box 1179 Southold, NY 11971 Telephone: 631 765-1938 Fax: 631 765-3136 LOCAL WATERFRONT REVITALIZATION PROGRAM TOWN OF SOUTHOLD To: Martin Sidor, Chair Town of Southold Planning Board From: Mark Terry, Principal Planner x~XJ~ LWRP Coordinator Date: May 6, 2009 Re: Proposed Standard Subdivision of Karen Mazzaferro SCTM# 1000-63.-1-12 Zoning District: R-40 '- This proposed standard subdivision is to subdivide a 4.28- acre parcel itit~ 3 lots, where Lot 1 equals 41,994 sq. ft., Lot 2 equals 43,631 sq. ft., and Lot 3 equals 90, 023 sq. ft, in the R-40 Zoning District. The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, the proposed action is CONSISTENT with the LWRP, provided that the below recommendations are required in the subdivision approval. To further Policy 3.1, "Enhance visual quality and protect scenic resources throughout the Town of Southold. " E. Preserve existing vegetation and establish new indigenous vegetation to enhance scenic quality: 4. Restore or add indigenous vegetative cover that presents a natural appearance. The plat dated as last revised, on January 27, 2009 does not show the location of trees pursuant to § 280-93 Front landscaped area. A front landscaped area shall be required for all uses in all zoning districts. The required landscaped area shall be covered with grass or other ground cover and shall include appropriate trees and shrubs. As a minimum, in all nonresidential districts and in the Hamlet Density Residential and R-40 Low-Density Residential Districts, one shade tree having a caliper of two inches shall be planted within the front landscaped area for each 40feet or fraction thereof of lot frontage. The purpose of the landscaping is to enhance the appearance of the use on the lot but not to screen the use from view. A. Residential districts. In all residential districts, required front yards, except for the driveway, shall be landscaped with grass or other suitable ground cover, trees and/or shrubs. It is recommended that the Board require the installation of two trees on Lot 1 and one tree on Lot 2 pursuant to this section. It is further recommended that the Board require street trees along the 25' ROW and/or accept the existing trees along the ROW to meet § 161-44. Street trees of the Southold Town Code. In addition i~ is recommended that the existing vegetation on each lot be incorporated within the required clearing limits pursuant to § 240-49 Clearing of the Southold Town Code. The cleating limits are required to be shown on the final plat. The clearing limits could be applied to establish the required 30 foot transitional buffer described below. The parcel to the south of the subject parcel is zoned L1. Therefore, a 30 foot buffer along the southern property boundaries of Lot 2 and portions of Lot 3 (approximately 102') is required pursuant to: 3~ 280-94 Transition buffer area. The purpose of the transition buffer area is to provide privacy from noise, headlight glare and visual intrusion to residential dwellings. A buffer area shall be.required along all boundaries of a nonresidential lot abutting any lot in a residential district. Such buffer area shall comply with at least the following minimum standards: A. The buffer area shall be located within the boundaries of the subject property. The minimum width of buffer areas shall be as follows: '(5) Industrial districts: 30feet. C. The buffer area shall be of evergreen planting of such type, height, spacing and arrangement as, in the judgment of the Planning Board, will effectively screen the activity on the lot from the neighboring residential area. As a minimum, the planting shall consist of a double row of trees six feet in height planted at intervals of 10 feet on center. Nonevergreen planting may be included to supplement evergreen planting, but not to take its place. E. Where the existing topography and/or landscaping provides adequate screening, the Planning Board may accept the existing planting and/or buffer area as the required planting. To further Policy 5, "Protect and improve water quality and supply in the Town of Southold" and protect and improve the water quality and supply in the area, it is recommended that the following best management practices be required: 1. Require the use of gutters, leaders and subsurface drywells to retain surface runoff. 2. Require the use of native plants and encourage the use of disease-resistant and drought- tolerant plants in landscaping. 3. Prohibit the residential application and use of synthetic pesticides and fertilizers capable of entering the potable water supply.
