Hilary, LWRP Coordinator Date: January 12, 2009 Chapter 268, WATERFRONT CONSISTENCY REVIEW Wetland Permit for GABRIEL SCIBELLI SCTM#90-2-15 Patricia C. Moore, Esq. on behalf of GABRIEL SCIBELLI requests a Wetland Permit to construct a 24'X 30' addition to the existing dwelling, landward of and connected to the existing dwelling by a heated passageway, and to install a new sanitary system. Located: 450 Cedar Point Dr. East, Southold. SCTM#90-2-15 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to us, it is our recommendation that the proposed action is EXEMPT pursuant to § 268-3. § 268-3. Definitions. MINOR ACTIONS -- Include the following actions, which are not subject to review under this chapter: BB. Additions to the landward side of an existing dwelling constituting less than 25% of the original structure, except in a Coastal Erosion Hazard Area The following BMP's are recommended: 1 ) Install a line of hay bales and silt fence seaward of the proposed action as an erosion control measure to retain runoff sediments during construction. 2) Install gutters, leaders and drywells to control storm water. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. LWRP CONSISTENCY ASSESSMENT FORM A. INSTRUCTIONS (Scibelli) 1. All applicants for permits* including Town of Southold agencies, shall complete this CCAF for proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law. This assessment is intended to supplement other information used by a Town of Southold agency in making a determination of consistency. *Except minor exempt actions including Building Permits and other ministerial permits not located within the Coastal Erosion Hazard Area. 2. Before answering the questions in Section C, the preparer of this form should review the exempt minor action list, policies and explanations of each policy contained in the Town of Southold Local Waterfront Revitalization Program. A proposed action will he evaluated as to its significant beneficial and adverse effects upon the coastal area (which includes all of Southold Town). 3. If any question in Section C on this form is answered "yes", then the proposed action may affect the achievement of the LWRP policy standards and conditions contained in the consistency review law. Thus, the action should be analyzed in more detail and, if necessary, modified prior to making a determination that it is consistent to the maximum extent practicable with the LWRP policy standards and conditions. Required setbacks are 50 feet front and 40 feet rear. Existing house is nonconforming, developed in Nassau Point with 35 foot front yard setbacks and no rear yard setbacks. The property is a comer lot and both setbacks can not be followed. The addition, due to zoning regulations, must be connected by a heated passageway. The addition is no closer to the neighbor's bulkhead then the existing house.
