Chapter 268, WATERFRONT CONSISTENCY REVIEW
Wetland Permit for NEW SUFFOLK SHIPYARD, LLC
SCTM#117-5-29.1
High Point Engineering on behalf of NEW SUFFOLK SHIPYARD, LLC requests a Wetland Permit to remove the
existing (1) 4K gallon single wall fiberglass storage tank; install (1) 4K gallon double wall steel above ground storage
tank; and install (2) 2' deep drywells and +/-153 lf. roof gutters with downspouts to redirect roof run-off from draining
into water beyond bulkhead into drywells. Located: 6775 New Suffolk Rd., New Suffolk~ SCTM# 117-5-29.t
The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town
Code and the Local Waterfront Rev!talization Program (LWRP) Policy Standards. Based upon the information provided
on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to us, it is our
recommendation that the proposed action is CONSISTENT with LWRP policy standards and therefore is
CONSISTENT with the LWRP
The following Best Management Practices (BMP's) are recommended:
1)
Replacement of the bulkhead prior to the installation of the new 4k gallon double wall steel above ground
storage tank.
2)
The deployment of silt boom surrounding the immediate project area prior to and during all intertidal
operations.
The deployment of a silt boom is recommended (with or without) the bnlkh,~ad being, replaced-
3)
Install a line of hay bales and silt fence between the bulkhead and the proposed action as an erosion
control measure to retain runoff sediments during construction.
The deployment of silt booms as a Best Management Practice will further advance LWRP Policy 5,
Protect and improve water quality in the Town of Southold and LWRP Policy 6 Protect and restore tidal
and fresh water wetlands.
Pursuant to ~ 275-11 all intertidal construction and excavation requires the installation of a silt boom that will
retain all suspended sediments within the immediate project area.
§ 275-11 Construction and operation standards.
General The following standards are required for all operations within thejurisdiction of the Trustees:
(2) Erosion control Installation of an erosion control structure is necessary during any building, grading,
landscaping or site work activity within Trustee jurisdiction. This structure may include, but is not limited to, installation
of a silt fence, hay bales, wood chip berm and silt booms. The placement of the erosion control structure(s.) shall be
determined by the Trustees or their designee..411 intertidal construction and excavation requires the installation of a
silt boom that will retain ail suspended sediments within the immediate project area.
§ 275-2 Definitions; word usage.
SILT BOOM -- A structure deployed within the water column that is designed to prevent passage of suspended
sediments and contaminants from spreading from the immediate project area to surrounding waters. Properly installed,
silt booms completely surround the project area.
Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written
determination regarding the consistency of the proposed action.

Although the proposed action introduces an above ground fuel storage tank approximately 7 feet away
from the bulkhead, it is unlikely to be seen from New Suffolk Road as trailered boats parked adjacent to it
will largely block its view. Also, since the use remains a marina, appurtances such as a fuel tank are
justifiably expected to reside on the property and within view.

secondary containment space for leaks. Any spill/leak will not directly infiltrate the soil/groundwater;

existing single wall underground tank has no provisions for such leak monitoring and is in fact, directly in
contact with the ground water.

assessment is intended to supplement other information used by a Town of Southold agency in
