J.M.O. Environmental Consulting Services on behalf of DAVID WILMERDING requests a Wetland Permit &
Coastal Erosion Permit to construct a 5'X 46' fixed dock onto an existing 8'X 88' fixed dock, to re-deck the existing
8'X 88' fixed dock and to construct (2) steps on the existing fixed dock. Located: Private Rd. off of Equestrian Ave.,
Fishers Island. scTM#9-9-3.4
The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the' Town of Southold
Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information
provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to
us, it is our recommendation that the proposed action is EXEMPT pursuant to § 268-3.
§ 268-3. Definitions.
MINOR ACTIONS -- Include the following actions, which are not subject to review under this chapter:
A. Maintenance or repair involving no substantial changes in an existing structure or facility;
Replacement, rehabilitation or reconstruction of a structure or facility, in kind, on the same site, including
upgrading buildings to meet building or fire codes, except for structures in areas designated by the Coastal
Erosion Hazard Area (CEHA) law where structures may not be replaced, rehabilitated or reconstructed
without a permit
Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written
determination regarding the consistency of the proposed action.

All applicants for permits* incl. aing Town of Southold agencies, shall complete this CCAF for
proposed acliom that are subjoct to the Town of Southold Wai~ f,u~i Consistency Review Law. This
assessment is intended to supplement other inf~on used by a Town of Southold agency in
making a de~,,,~inalico of consist~cy. *Except minor exempt actions including Building Permits
and other ministerial permits not located within the Coastal Erosion Hazard Area.
2. Before answering the questions in Sectioo C, the preparer of thig form should review lhe exempt
minor action list, policies and exphmations of each policy cootslned in the Town of Southold Local
Waterfront Revimli~ficm Pro~mu. A proposed action will be evaluated as to ils si?ificant
beneficial and adverse effects.upon the coastal area (which includes all of Southold Town). /

Response to Coastal Policies - LWRP for Southold Town for
Wilmerding, Fishers Island
Policy 1- The project as proposed will have no impact whatsoever on the
character of the community of Fishers Island and will have no impact on
open space. The proposed work shall be concentrated in an existing area of
maritime activity. It is felt that this project is consistent with this policy.
Policy 2 - The project as proposed shall have no impacts whatsoever on any
existing historic or archaeological resources of the Town of Southold. It is
felt that this project is consistent with this policy.
Policy 3- The project consists of the rehabilitation of an existing private
recreational docking facility. The rehabilitation shall have no impacts
whatsoever on the visual quality or scenic resources located within Southold
Town. It is felt that this project is consistent with this policy.
Policy 4- The project as proposed does not involve the construction of a
shore hardening structure, nor does it involve the development in a natural
protective feature area. It is felt that this policy is not applicable to this
project.
Policy 5- The project as proposed does not involve development that will
have any impacts whatsoever upon the quantity or quality of potable water
supplies in the Town of Southold. It is felt that this policy is not applicable
to this project.
Policy 6- The project as proposed shall not cause any adverse changes to the
ecological quality of Little Hay Harbor. There shall be no degradation or
physical loss of ecological components nor shall the rehabilitation of the
existing private recreational docking facility have any impacts upon any
Significant Coastal Fish and Wildlife Habitat. It is felt that this project is
consistent with this policy.
Policy 7- The project as proposed shall have no impact whatsoever upon the
quality of air in Southold Town. It is felt that this policy is not applicable to
this project.
Policy 8- The project does involve the disposal of that portion of the
existing recreational docking facility to be replaced. The debris which shall
be removed will be disposed of properly. It is felt that this project is
consistent with this policy.
Policy 9- The project as proposed provides the property owner access to
Little Hay Harbor and the recreational use of coastal waters, public lands
and public resources of the Town of Southold. It is felt that this project is
consistent with this policy.
Policy 10- The project as proposed involves the rehabilitation of an existing
private recreational docking facility and shall not require the relocation of
the existing structure. It is felt that this project is consistent with this policy.
Policy 11- The project as proposed involves the rehabilitation of an existing
private recreational docking facility. The rehabilitation of said structure
shall have no impact upon the long term maintenance and health of living
marine resources. The project does not involve stocking or the introduction
of non-indigenous species of fish, plant or wildlife and shall provide
recreational use of the Town of Southold% fmfish, shellfish, crustaceans and
marine plants. It is felt that this project is consistent with this policy.
Policy 12- The project as proposed does not involve agricultural lands in the
Town of Southold. It is felt that this Policy is not applicable to this project.
Policy 13- The project as proposed does not involve the use of development
of energy or mineral resources. It is felt that this Policy is not applicable to
this project.
