Wetland Permit for FISHERS ISLAND DEVELOPMENT CORP.
J.M.O. Environmental Consulting on behalf of FISHERS ISLAND DEVELOPMENT CORP. requests a
Wetland Permit to reclaim and repave East End Rd., which is a private road extending from Oriental Ave.
eastwardly approx. 4.5 miles to the east of the island. The plan calls for reclaiming the existing pavement to create
a sub base, replacing old culverts with new larger pipes, grading and repaving, with two courses of bituminous
concrete. Existing unpaved storm water leaks offs will be improved with rip rap in areas not adjacent to freshwater
wetlands and stone trenches and landscaped swales designed to accommodate run-off from a design storm will be
installed in areas near wetlands. Areas adjacent to the road disturbed during the grading process will be Ioamed
and seeded. In addition, proposed construction of an 8' wide paved or boardwalk path to follow the road alignment
for an approx, length of 3.25 miles. Design plans proposed a corridor approx. 12' wide be cleared, topsoil
removed, processed gravel base installed and a final 2" pavement course of bituminous concrete. Any disturbed
areas w~ll be loamed and seeded. In areas where the path crosses freshwater wetlands, an elevated boardwalk with
open grating is proposed. Located: Fishers Island
The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold
Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the
information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the
records available to us, it is our recommendation that the proposed action is CONSISTENT with LWRP policy
standards and therefore is CONSISTENT with the LWRP.
Policy 5 Protect and improve water quality and supply in the Town of Southold.
5.2 Minimize non-point pollution of coastal waters and manage activities causing nonpoint pollution.
5.3 Protect and enhance quality of coastal waters.
Policy 9 Provide for public access to, and recreational use of, coastal waters, public lands, and
public resources of the Town of Southold.
9.1 Promote appropriate and adequate physical public access and recreation to coastal resources.
9.2 Protect and provide public visual access to coastal lands and waters from public sites and
transportation routes where physically practical.
§ 275-11 Construction and operation standards.
A. General. The following standards are required for all operations within the jurisdiction of the Trustees:
(2) Erosion control. Installation of an erosion control structure is necessary during any building, grading,
landscaping or site work activity within Trustee jurisdiction. This structure may include, but is not limited to,
installation of a silt fence, hay bales, wood chip berm and silt booms. The placement of the erosion control
structure(s) shall be determined by the Trustees or their designee. All intertidal construction and excavation
requires the installation ora silt boom that will retain all suspended sediments within the immediate project area.
In the event the proposed actions are approved, the following BMP's are recommended:
1)
To install hay bales and silt fences as an erosion control measure to retain runoff sediments during
construction; within the 100' jurisdictional setback of the Board of Trustees.
2)
That the bike path leading to the proposed elevated board walks be constructed of pervious
materials, mitigating storm water runoff and transport of pollutants; within the 100' jurisdictional
setback of the Board of Trustees.
3)
Maintain buffers widths landward of wetlands to achieve a high filtration efficiency of surface
runoff as determined by vegetative cover type, soil characteristics, and slope of land.
4)
Where buffers (within the jurisdictional setback) may be disturbed, retain and add indigenous
plants to maintain and restore values of natural ecological wetland communities.
Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written
determination regarding the consistency of the proposed action.

There will be a one time impact on the wetland areas while the
path is constructed. To minimize impacts,the path was designed
to use "Thru-Flow"fiberglass decking for the walks which allows

Project Description for Fishers Island Development Corporation
Proposed Recreational Path, Fishers Island, New York
Fishers Island Development Corporation (FIDCO) is proposing to reclaim and repave
East End Road on Fishers Island. East End Road is a private road extending f~om
Oriental Avenue eastwardly approximately 4.5 miles to the east end of the island. The
existing road is approximately 20 feet wide and was last paved in the early 1970's with
minimal maintenance since them The current plan calls for reclaiming the existing
pavement to create a new sub base, replacing old culverts with new larger pipes, grading
and repaving, with two courses of bituminous concrete. There will be some minor
relocation of the road bed in two areas to accommodate construction of the proposed
recreational path. Existing, unpaved storm water leak offs will be improved with rip rap
in areas not adjacent to freshwater wetlands and stone hvaches and landscaped swales
de$iglled to accommodate rallOff from a design storm will be installed in areas near
wetlands. Reference is made to the accompanying drainage ~port. Silt fence will be
installed and maintained in areas where rollOffto the wetlands is possible. This will
insure no disturbance to those areas during construcfiom Areas adjacent to the road

St~ 38+75 - 40+55- The existing 8~ culvert will be replaced with a 15"pipe and
the road will be raised 1'-2' to provide adequate cover over the new culvert.
Sta. 148 +50- The existing culvert will be extended approximately 50 feet mid a
rip rap pad installed at the outlet.
Sta. 172+00- The existing culvert will be replaced with a 15" pipe, a eateh basin
installed and a vegetative swale constructed at the outlet.
Sra. 174+50- 179+00- The road bed will be relocated approximately 10 feet to the
north to accommodate construction of the recreatiorlal path disctlssed later in this
Stm 188+50- 195+00- The road again will be relocated approximately 10 feet to
the north and also raised 12"- 18". Again to ac, gommodate col:lstruglioll of the
Stm 197+25 -200+50- The existing culvert will be replaced with 2- 15" pipes, and
a concrete bin wall system installed to allow the road to be raised approximately 4
feet. Flooding is common in this area during storm events and with this, the only
access to the east end of the island; it is important to keep thi.~ road passable at all
times.
221 +00- 222+50- The road in thi.n area will be raised approximately 18" in order
to improve drainage at the intersection of East End Road and the gravel road
extending northerly.

In addition to the road reconstruction, the Fishers Island Recreational Path Foandafon is
proposing construction of an 8' wide paved or boardwalk path. This path would generally
follow the road alignment for an approximate length of 3.25 miles. Several areas of this
path are adjacent to property donated for conservation to the Henry L. Ferguson Museum
Inc. either by FIDCO or private individuals. FIDCO is responsible for approximately 135
act,s being added to the Museum land and this path will allow bicycle and pedestrian
access between many of these Museum parcels. The design plans propose a corridor
approximately 12 feet wide be cleared, topsoil removed, processed gravel base installed
and a final 2" pavement course of bita~minons concrete. Again~ any disturbed areas will
be loamed and seeded. In two of the areas where the path crosses freshwater wetlands, an
elevated boardwalk with open grating is proposed. The foundation for these boardwalk
sections will be belical anchors, be at least 18" above the wetlands. A third wetlands
eros~ng~ detailed below and on the plans, is proposed to have the boardwalk cantilevered
from a concrete bin wall system so foundations within the wetlands will not be necessary.
The concrete bins will be installed in the existing roadway. To mitigate clearing of the
path route; approximately 60 major a-ees, 31 minor trees and 950 shrubs will be planted
as part of this project. Below are key components of the path project.
The path begins approximately 575 feet southerly along Wilderness Road from
the intersection of Oriantal Ave. and East End Road. This is propc~ni because of
wetlands areas adjacent to East End Road-Sts~ 0+0 - 2+15. The be~nnlng of the
path follows the existing gravel access road to the capped landfill and then joins
East End Road near Sts- 10+50.
sra. 27+50 - 28+80- This portion of the path is proposed to be elevated boardwalk
crossing the southerly limits of a f~shwater wetlands are~ The option of
relocating the road to the south to allow the path to be consmicted outside the
wetlands was considered but that would require filling approximately 1000 square
feet of wetlands on the southerly side of the road. This filling would be necessary
in order to provide property ab~onmem and slope adjacent to the roadway.
Stm 38+75-40+75- Again~ this portion of the path is proposed as elevated
boardwalk. Freshwater wetlands exist on both the north and south sides of the
Sm. 300 +00 - 352+00- The path in this area does not follow the paved road but
extends northerly and easterly sharing the existing gravel road. Improvements to
this road are proposed and detailed on the design plans.
St~ 131+ 75- 133+25, Stm 170+60 172+50 and Stm 163+50 - 166+50- The path
in these areas are proposed to be elevated boardwalk because of the existing
slopes along the side of the road. Excessive filling and disturbance would be
necessary if acceptable slopes were proposed adjacent to the path. Two of these
areas have freshwater wetlands nearby and the boardwalks as proposed will not

steel beamq cantilevered from a concrete bin system. The bin system will allow
the road to be elevated approximately 2 -4 feet above existing road and wetlands
elevation~ A detail of this system is shown on the design plans.
Path ends at the drive to the golf club Sta~ 204+ 50.
Adequate sediment and erosion control will be provided along the path as necessary and
as previously mentioned.; extensive planting will be done along the entire path as part of
this project.
