Wetland permit for JAMES R. RICH, JR.

Suffolk Environmental Consulting, Inc. on behalf of JAMES R. RICH, JR. requests a Wetland Permit to dredge an
underwater area measuring 12'X 36' along the eastern side of the existing dock structure to a depth of 3' below apparent
low water (allowing for a 1' "over-cut"), and as a ten-year maintenance dredging permit. Located: 3415 Wells Ave.,
Southold. SCTM#70-4-7
The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town
Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided
on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to us, it is our
recommendation the proposed action is CONSISTENT with LWRP policy standards and therefore is
CONSISTENT with the LWRP.
Policy 6 Protect and restore the quality and function of the Town of Southold ecosystem
6.3 Protect and restore tidal and freshwater wetlands.
Comply with statutory and regulatory requirements of the SouthoM Town Board of Trustees laws and
regulations for all Andros Patent and other lands under their jurisdiction
1. Comply with Trustee regulations and recommendations as set forth in Trustee permit conditions.
§ 275-11 Construction and operation standards.
(3) Dredging.

Only maintenance dredging (as defined in 3~ 275-2) is permitted, unless the applicant owns underwater
land or the applicant is requesting permission to dredge in connection with installation of low-sill
bulkheads. All maintenance dredging pertnits shall be valid for a period no greater than l O years.
§ 275-2 Definitions; word usage.
MAINTENANCE DREDGING -- g dre~q, in`g projecl will be considered maintenance dredging if there is documentary
evidence that il has been previously tired`ged.
In the event that the proposed action (dredging) is approved, the following best management practice is
recommended:
1)
Installation of a silt boom prior to and during all intertidal operations surrounding the immediate project
area.
The deployment of silt booms as a Best Management Practice will further advance LWRP Policy 5~ Protect and
improve water quality in the Town of Southold and LWRP Policy 6 Protect and restore tidal and fresh water
wetlands.
Pursuant to § 275-11 A (2)~ as referenced below~ all intertidal excavation requires the installation of a silt boom
that will retain all suspended sediments within the immediate proiect area.
§ 275-11 Construction and operation standards.
A. General. The jbllowing standards are required fi)r all operations within the jurisdiction (~/'the Trustees:

landscaping or site work activitF within Trustee,/urisdiction. 7his structure met3; inchMe, but is not limited to, installation

§ 275-2 Definitions; ~vord usage.
SILT BOOM -- g structure deployed within the water colmnn that is designed to prevent passage of su.%vended
sediments and contaminanls fi'om vpreading from the immediate project area lo sm'rounding waters. Properly installed,
silt booms completely .surround the pr~ect area.
Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written
determination regarding the consistency of the proposed action.

assessment is intended to supplement other information used by a Town of Southold agency in

PROJECT DESCRIPTION:
Applicant proposes to maintenance dredge an
underwater area measuring 1~.0' X 36.0' along the
eastern side of the existing dock structure to a
depth of 3.0' + below apparent low water (allowing
for a 1.0' "over-cut"). Applicant will employ a
"clam-bucket" to dredge via barge off shore.
Applicant requests the approval be issued as a "ten
year maintenancd' dredging permit.
Approximately 5 - 10 cubic yards of spoil is
anticipated to be removed from this area and
deposited within an approved-for upland location.
