MICHAEL CARLUCCl requests an Amendment to Permit #1788 to replace in-place the
existing 40' timber bulkhead and two existing 8' and 12' returns, and backfill with up to 12 cy.

pipe or timber and to include the existing floating dock and 2'X 7' ramp. Located: 865 Island

The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the
Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy
Standards. Based upon the information provided on the LWRP Consistency Assessment
Form submitted to this department, as well as the records available to me, it is my
recommendation that the proposed action is CONSISTENT with the Policy Standards and
therefore is CONSISTENT with the LWRP provided that the following recommendations to
further the below listed policies are implemented.
5.3 Protect and enhance quality of coastal waters.
Protect water quality based on an evaluation of physical factors (pH, dissolved
oxygen, dissolved solids, nutrients, odor, color and turbidity), health factors
(pathogens, chemical contaminants, and toxicity), and aesthetic factors (oils,
floatables, refuse, and suspended solids).
To further the above policy, it is recommended that the Board minimize the use of CCA treated
materials in the bulkhead and dock design and require turbidity control dudng construction
operations.
Policy 6. Protect and restore the quality and function of the Town of Southold ecosystem
6.3 Protect and restore tidal and freshwater wetlands.
E. Maintain buffers to ensure that adverse effects of adjacent or nearby
development are avoided:
Maintain buffers to achieve a high filtration efficiency of surface runoff.
Avoid permanent or unnecessary disturbance within buffer areas.
Maintain existing indigenous vegetation within buffer areas.
If the action is approved it is recommended that a perpetual landscaped buffer be required
landward from the bulkhead.
LANDSCAPED BUFFER -- a land area of a certain lenqth and width which is planted with
indigenous, drou.qht tolerant, ve.qetation similar to that found within the immediate proximity of
the parcel. Vegetation shall be installed in sufficient densities to achieve ninety-five (95)
percent ground cover within two years of installation; Survival of planted ve.qetation shall be
(ninety) 90 percent for a period of three years Maintenance activities within the buffer am
limited to removing vegetation which are hazardous .to life and property, trimming tree limbs up
to a height of fifteen feet (15') to maintain viewsheds, replanting of vegetation and establishin.q

Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in
preparing its written determination regarding the consistency of the proposed action.
