Construct 110' of new bulkhead and new 4' wide wood walkway in-place. Remove existing floating dock, ramp and access platform and install new 4'X 4' cantilevered platform, 32"X 14' seasonal aluminum ramp and 4'X 50' seasonal floating dock in-place. Remove existing retaining wall and construct 110' of new retaining wall in-place. Provide a 10' wide non-turf buffer zone landward of walkway. Located: 655 Albacore Dr., Southold. SCTM#57-1-17 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is CONSISTENT with the Policy Standards and therefore is CONSISTENT with the LWRP provided that the following recommendations to further the below listed policies are implemented. 5.3 Protect and enhance quality of coastal waters. Protect water quality based on an evaluation of physical factors (pH, dissolved oxygen, dissolved solids, nutrients, odor, color and turbidity), health factors (pathogens, chemical contaminants, and toxicity), and aesthetic factors (oils, floatables, refuse, and suspended so/ids). To further the above policy, it is recommended that the Board minimize the use of CCA treated materials in the bulkhead and dock design. Policy 6. Protect end restore the quality and function' of the Town of Southold ecosystem 6.3 Protect and restore tidal and freshwater wet/ands. E. Maintain buffers to ensure that adverse effects of adjacent or nearby development are avoided: Maintain buffers to achieve a high filtration efficiency of surface runofL. A void permanent or unnecessary disturbance within buffer areas. Maintain existing indigenous vegetation within buffer areas. To, further the above policy, it is recommended that a perpetual landscaped buffer be required landward from the bulkhead. LANDSCAPED BUFFER -- a land area of a certain length and width which is planted with indigenous, drouqht tolerant, ve.qetation similar to that found within the immediate proximity of the parcel. Vegetation shall be,installed in sufficient densities to achieve ninety-five (95) percent qround cover within two years of installation. Survival of planted vegetation shall be (ninety) 90 percent for a pedod of three years Maintenance activities within the buffer am limited to removing veqetation which are hazardous to life and property, trimming tree limbs up to a hei,qht of fifteen feet (15') to maintain wewsheds, replantinq of veqetation and establishinq a four foot (4') wide access path constructed of pervious material for access to the water-body. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its wdtten determination regarding the consistency of the proposed action. DEVELOPED COAST POLTC~ES Policy I Foster a pattern of development in the Town of Southold that enhances community character, preserves open space, makes efficient use of infrastructure, makes beneficial use of a coastal location, and minimizes adverse effects of development. Our proposal is consistent with this policy in that all structures are existing and the homeowner is trying to maintain his property by reconstructing this waterfront structures. There are no new structures being proposed. Policy 2 Preserve historic resources of the Town of Southold. This project location has no significant historic resources. Policy 3 Enhance visual quality and protect scenic resources throughout the Town of Southold. Our proposal will not have a negative impact on the visual quality or scenic resources. This proposal is consistent with the area. NATURAL COAST POLTCZES Policy 4 t4inimize loss of life, structures, and natural resources from flooding and erosion. This project has will have no flooding or erosion concerns. The new bulkhead will protect the property in the same manner as the existing. Policy 5 Protect and improve water quality and supply in the Town of Southold. Our proposal will not have any impact of the water quality or supply in the Town of Southold. Policy 6 Protect and restore the quality and function of the Town of Southold's ecosystem. Our proposed dock facility will have minimal effects on the ecosystem. During the initial construction there will be minor disturbance to the underwater lands. Once construction is completed the area will immediately settle and re-establish itself. Policy 7 Protect and improve air quality in the Town of Southold. Our proposal will not have any impact on the air quality in the Town of Southold. Policy 8 Minimize environmental degradation in the Town of Southold from solid waste and hazardous substances and wastes. Our proposal will not influence the environmental degradation in the Town of Southold from solid waster and hazardous substances and wastes, PUI~L/C COAST POUC/ES Policy 9 Provide for public access to, and recreaUonal use of, coastal waters, public lands, and public resources of the Town of Southold. Our proposal will give the property owner the ability the access their boats and engage in the recreational use of town waters. The dock will not inhibit others ability to access these same waters, No new structures are being proposed, Page 2 of 2 WI~RKIN~ COAST POI~CZES Policy 10 Protect the Town of Southold's water-dependent uses and promote siting of new water- dependent uses in suitable locations. This is a waterfront piece of property where the property owner accesses the water to engage in water dependent activities such as boating and fishing. Reconstructing the existing structures will ensure that the homeowner will be able to continue accessing the water without worrying about any of these aging structures failing. POlicy 11 Promote sustainable use of living marine resources in the Town of Southold. The project area does not offer any opportunities for commercial fishing or shellfishing. There are also limited opportunities for recreational fishing at this location. The property owner would normally use a boat to access a larger body of water to engage in this type of water dependent recreation. Policy 12 Protect agricultural lands in the Town of ~outhold. Our proposal will not have any impact on agricultural lands in the Town of Southold. Policy 13 Promote appropriate use and development of energy and mineral resources.
