Box 1179 Southold, NY 11971 Telephone: 631 765-1938 Fax: 631 765-3136 LOCAL WATERFRONT REVITALIZATION PROGRAM TOWN OF SOUTHOLD From: Mark Terry, Date: July 17, 2009 Re: MEMORANDUM Jim King, President Town of Southold Board of Trustees Principal Planner LWRP Coordinator Wetland Permit and Coastal Erosion Permit for JOSEPH and JOANNA CHERNUSHKA Location: 640 Rabbit Lane, East Marion SCTM# 1000-31.-18-20.1 Fairweather-Brown on behalf of JOSEPH & JOANNA CHERNUSHKA requests a Wetland Permit and Coastal Erosion Permit to convert dormered second-floor bedrooms into second- floor conforming space, remove the existing chimney, lift the dwelling to conform to flood plain regulations, and install gutters and drywells to contain roof run-off. Located: 640 Rabbit Lane, East Marion. SCTM#31-18-20.1 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is INCONSISTENT with the denoted following Policy Standards and therefore is INCONSISTENT with the LWRP. A. portion of the existinq residential structure is located seaward of the Coastal Erosion Hazard Line. 4.1 Minimize losses of human life and structures from flooding and erosion hazards. The fo/lowing management measures to minimize losses of human life and structures from flooding and erosion hazards are suggested: Minimize potential loss and damage by locating development and structures away from flooding and erosion hazards. Avoid development other than water-dependent uses in coastal hazard areas. Locate new development which is not water-dependent as far away from coastal hazard areas as practical. Avoid hazards by siting structures to maximize the distance from Coastal Erosion Hazard Areas. 3. Move existing development and structures as far away from flooding and erosion hazards as practical. Maintaining existing development and structures in hazard areas may be warranted for: c. sites where relocation of an existing structure is not practical. The rear yard setback on the pamel is 35 feet from Rabbit Lane. From the rear yard setback to the existin.q structure is a total distance of 22 feet. It is recommended that the Board assess the feasibility of relocating the structure ~ioser to Rabbit Lane within the building envelope and requiring a landscaped buffer landward of the existinq bulkhead. A recommended definition for a landscaped buffer is: LANDSCAPED BUFFER - a land area of a certain len.qth and width which is planted with indiqenous, drou.qht tolerant, ve.qetation similar to that found within the immediate proximity of the parcel. Ve.qetation shall be installed in suffident densitie~ to achieve ninety-five (95) Percent .qround cover within two years of installation. Sun/ival of planted veqetation shall be (ninety) 90 percent for a period of three years. Maintenance activities within the buffer are limited to removinq ve.qetation which are hazardous to life and property, trimmin,q tree limbs up to a heiRht of fifteen feet (15') to maintain viewsheds, replantin,q of ve.qetation and establishinq a four foot (4') wide access path constructed of pervious material for access to the water-body. 5.1 Prohibit direct or indirect discharges that would cause or contribute to contravention of water quality standards. C. Ensure effective treatment of sanitary sewage and industrial discharges by: 8. providing and managing on-site disposal systems: b. protect surface and groundwater~against contamination from pathogens and excessive nutrient loading by keeping septic effluent separated from groundwater and by providing adequate treatment of septic effluent. It is recommended that the Board require that the applicant upgrade the on-site-septic system to protect from potential contamination to qround and surface waters. It is recommended that the Board amend the application to meet and/or further the above policies to the greatest extent practicable. Pursuant to Chapter 268, the Southold Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action.
