Present Were: Absent Was: Jack McGreevy, Member (Acting-Chairman) Peter Young, Member Anne Trimble, Member Doug Hardy, Member Lauren Standish, Secretary Greta Schiller, Member Scott Worth, Student Member Dave Bergen, Trustee CALL TO ORDER The meeting was called to order at 4:30 PM by Acting-Chairman Jack McGreevy. A moment of silence was held for Chairman James Eckert who passed on October 18, 2009. OLD BUSINESS Member Doug Hardy submitted a draft of a letter for review, addressed to the Supervisor, the Board of Trustees, and the Bay Constables regarding a potential Town Wetland Code violation and a violation of the State Law on a property in New Suffolk. Member Peter Young suggested the letter be sent to the Supervisor and the Trustees only at this time. It was agreed upon unanimously to forward the letter to the Supervisor and the Trustees with the attachment photo. 2 Member Peter Young informed the members that the "Review of Mooring Permitting in the Town of Southold" was submitted to the Supervisor and the Board of Trustees. Member Jack McGreevy suggested the document be presented at a Town Board worksession, however Peter didn't think it was necessary at this time. Moved by Jack McGreevy, seconded by Doug Hardy, it was Resolved to present the "Review of Mooring Permitting in the Town of Southold" to the Town Board. All Ayes: All, Motion Carried NEW BUSINESS Acting-Chairman Jack McGreevy expressed his concerns with the proposed project to expand the Mattituck Inlet Marina, which will involve a change in the zoning. At this time, the project has not been submitted to the Board of Trustees or CAC for review, however, Jack suggested the CAC send a memo to Planning Board to obtain a copy of the plans so they can begin the review process. The members had no objection. APPROVAL OF MINUTES Moved by Peter Young seconded by Anne Trimble, to Approve the Minutes of October 14, 2009. DISCUSSION AND RECOMMENDATION OF WETLAND PERMIT & COASTAL EROSION PERMIT APPLICATIONS Moved by Jack McGreevy, seconded by Peter Young, it was RESOLVED to NOT SUPPORT the Wetland Permit application of ROGER PRAETORIUS to install a private recreational docking facility consisting of a fixed walkway with open- grate decking 4'X 85' supported by 8" dia. (nominal) marine piles seaward of the ordinary high water line, hinged ramp 3'X 16', and floating dock 6'X 20', with the float secured by up to four 8" dia. (nominal) marine spiles. Located: 975 Westview Dr., Mattituck. SCTM#139-1-4.2 Inspected by: Jack McGreevy The CAC does Not Support the application because there wasn't enough information to make a recommendation, and the project wasn't staked. Vote of Council: Ayes: All Motion Carried Moved by Doug Hardy, seconded by Jack McGreevy, it was RESOLVED to NOT SUPPORT the Wetland Permit application of YAN RIEGER to install 77' of a single row of stone (one to two tons in size) at toe of dune, underlain with filter fabric and core stone and place sand over stone and plantings, and install stone steps. Located: 370 Harbor Rd., Orient. SCTM#27-4-6 Inspected by: Peter Young, Doug Hardy 3 The CAC does Not Support the application at this time because there should be a coordinated mitigation plan with the adjacent property owner (Gilooly). Vote of Council: Ayes: All Motion Carried Moved by Doug Hardy, seconded by Peter Young,.it was RESOLVED to SUPPORT the Wetland Permit application of BREWER YACHT YARD AT GREENPORT to remove (1) gasoline dispenser, install (1) 5,000 gallon double wall steel UL#2085 fire rated A.S.T. with associated piping and relocate three (3) gasoline dispensers behind the existing wood bulkhead. Located: 1410 Manhasset Ave., Greenport. SCTM#1001-3-1-1 & 1000-36-1-1 Inspected by: Doug Hardy, Peter Young Vote of Council: Ayes: All Motion Carried Moved by Jack McGreevy, seconded by Doug Hardy, it was RESOLVED to SUPPORT the Wetland Permit application of LEONARD VlTO SESSA to replace in-place and elevate 2' an existing 4'X 40' pier with 4'X 40' vinyl grated pier; extend landward to the bulkhead an additional 4'X 40' vinyl grated deck pier secured by 6" dia. pilings landward of the Iow water line and (4) 8" dia. pilings seaward of the Iow water line; replace existing 3'X 16' ramp with a 3'X 18' ramp and replace in place two existing 6'X 20' floats secured by (4) 10" pilings; install (8) 10" mooring pilings; replace in-place existing 30' wood retaining wall; replace existing 10' return with a 20' return; install one new 20' return; replace existing 3'X 4' beach access stairs on easterly side of pier and add one 3'X 4' set of beach access stairs to westerly side of pier. Located: 1505/1525 Naugles Rd., Mattituck. SCTM#99-4-9.2,17&27 Inspected by: Jack McGreevy The CAC Supports the application, however the area is congested and there is a concern with a potential navigation problem. Vote of Council: Ayes: All Motion Carried Moved by Doug Hardy, seconded by Peter Young, it was RESOLVED to NOT SUPPORT the Wetland Permit application of THOMAS O'NEILL to install a 69' Iow-profile bulkhead along the southern shoreline and connect to the existing southwestern-most vinyl bulkhead return; expand the existing fringe of tidal wetlands vegetation along the southern shoreline; and install a section of GeoGrid matting measuring 10' X 7' between the AHW and ALW within the southwestern section of the subject property in order to allow for the launching and retrieving of small boats. 4 Located: 1420 Smith Drive South, Southold. SCTM#76-3-10.1 Inspected by: Peter Young, Doug Hardy The CAC does Not Support the project as applied for, and recommends a Iow-sill wave energy absorbing structure, which would dampen the boat wakes. Vote of Council: Ayes: All Motion Carried Moved by Jack McGreevy, seconded by Doug Hardy, it was RESOLVED to SUPPORT the Wetland Permit application of ROBERT O'BRIEN to remove 239' of existing bulkhead and construct new in-place. Provide 10' wide non-turf buffer landward of new bulkhead. Remove existing dock structure and construct a new 125' fixed dock with 42"X 16' seasonal ramp onto a 6'X 20' seasonal float secured by two 8" dia. anchor pilings. Located: 3655 Stillwater Ave., Cutchogue. SCTM#136-2-11 Inspected by: Jack McGreevy The CAC Supports the application with the Condition no CCA is used wherever possible, the dock is raised over the wetlands, floatation devices are installed under the decking on the floating dock ,and there is proper alignment with the neighboring docks. The CAC questions the width of the proposed ramp. Vote of Council: Ayes: All Motion Carried Moved by Doug Hardy, seconded by Jack McGreevy, it was RESOLVED to SUPPORT the Wetland Permit application of BLUE MOON PARTNERS, LLC CIO RANDALL FAIRHURST MP to construct approx. 143 If. of vinyl bulkhead in place of existing timber bulkhead (including 6' and 10' returns); remove existing concrete pad; replace flagpole; construct 5'X 7' platform off bulkhead in place of existing 8'X 7' platform; replace (in-kind and 3' closer to bulkhead) 3'X 12' ramp and 6'X 40' float; and maintenance dredge 15'X 80' area located 5' off bulkhead to a maximum depth of -5' ALW (with maximum 1' overcut) and use approx. 45 cy. spoil as backfill landward of new bulkhead. Located: 360 Wiggins Lane, Greenport. SCTM#35-4-28.33 Inspected by: Doug Hardy, Peter Young Vote of Council: Ayes: All Motion Carried Moved by Jack McGreevy, seconded by Anne Trimble, it was RESOLVED to SUPPORT the Wetland Permit application of CHRISTINE HUNT to construct approx. 73 linear ft. of vinyl bulkhead in place of existing timber bulkhead and backfill with approx. 5 cy. clean sand to be planted with beach grass (12" on center); construct approx. 104 If. vinyl retaining wall in place of existing timber retaining wall and construct 6' return; remove existing 21' timber bulkhead return and construct +~-37' vinyl return along northerly property line; and renourish eroded area of bluff face with approx. 15 cy. clean sand to be planted with native vegetation. Located: 5700 Vanston Rd., Cutchogue. SCTM#111-10-13.1 Inspected by: Jack McGreevy The CAC Supports the application with the Condition CCA materials are not used and measures are taken to protect the stable bluff. The CAC recommends an 18" bump-out of the upper landward bulkhead, which will eliminate disturbance to the bluff, and leave the old bulkhead in-place, and a longer landward return on the northwest side of the property. Vote of Council: Ayes: All Motion Carried Moved by Doug Hardy, seconded by Peter Young, it was RESOLVED to SUPPORT the Wetland Permit & Coastal Erosion Permit applications of the ESTATE OF DONNA LEVlN to construct approx. 133 If. of vinyl bulkhead (and 5' easterly return) in place of existing timber bulkhead and restore washed out portion of bluff face (due to storm-collapsed section of existing wall) with approx. 450 cy. clean sand to be planted with Cape American beach grass (12" on center). Located: 21695 Soundview Ave., Southold. SCTM#135-1-7 Inspected by: Peter Young, Doug Hardy The CAC Supports the application with the Condition public access is provided along the shoreline, such as a walkway with stairs, and there should be no confiscation of State public property. The CAC recommends an evaluation of the entire shoreline in that area. Vote of Council: Ayes: All Motion Carried WUNNEWETA POND ASSOC. to dredge a 20'X 280' area of the inland section of the existing channel to a depth of -4' below mean Iow water. Place the spoil (approx. 188 cy.) as beach nourishment in a 16'X 180' area previously approved disposal site located landward of the spring high water mark. Located: Navigation Channel, Wunneweta Pond. SCTM#118-1-11 6 The CAC did not make an inspection, therefore no recommendation was made. DISCUSSION AND RECOMMENDATION OF APPLICATIONS TO AMEND A WETLAND PERMIT Moved by Peter Young, seconded by Jack McGreevy, it was RESOLVED to SUPPORT the Amendment application of JOHN & MARIE SHACK request an Amendment to Permit #7154 to remove and replace in the same footprint, the existing foundation of the dwelling. Located: 1265 Shore Dr., Greenport. SCTM#47-2-26.1 Inspected by: Peter Young The CAC Supports the application with the Condition a line of staked hay bales is installed prior to the construction activities. Vote of Council: Ayes: All Motion Carried Moved by Peter Young, seconded by Doug Hardy, it was RESOLVED to SUPPORT the Amendment application of RITA & JOSEPH DeNICOLO to Amend Permit #7036 to authorize the in-place reconstruction (rather than the renovation/roof restructuring) of most seaward 19.7'X 20' one-story portion of dwelling so as to raise it 2' to proposed elevation of rest of dwelling; and the in-place reconstruction and raising of the existing attached 22.5'X 24' wood deck. Located: 3475 Wells Ave., Southold. SCTM#70-4-6 Inspected by: Peter Young Vote of Council: Ayes: All Motion Carried Member Anne Trimble will attend the next regular meeting of the Board of Trustees scheduled for Wed., November 18, 2009. The next meeting of the Conservation Advisory Council has been set for Wed., December 9, 2009 at 4:30 PM at Down's Farm Preserve.
