On November 17, 2009, this office fonNarded the Town Board resolution (copy
attached) in connection with the referenced matter requesting that the seasonal speed
limit on CR 48 be eliminated and that the New York State Department of Transportation
maintain a 40 m.p.h, speed limit all year round. After conducting an investigation and
traffic study, the New York State Department of Transportation has denied this request.
Please see attached correspondence dated June 9, 2010.
If you would like us to obtain a copy of the traffic study through FOIL, please
advise. Thank you.

THIS IS TO CERTIFY THAT THE FOLLOWING RESOLUTION NO. 2009-887 WAS
ADOPTED AT THE REGULAR MEETING OF THE SOUTHOLD TOWN BOARD ON
NOVEMBER 4, 2009:
RESOLVED that the Town Board of the Town of Southold hereby supports and requests the
permanent lowering by the New York State Department of Transporation (DOT) of the
maximum speed limit on Count3' Route 48 in the area of Town Beach between a point 500_+
feet east of Town Beach and a point 300_+ feet west of Clark Road from 50 mph to 40 mph
thereby eliminating the current seasonal restriction and further authorizes the Town Clerk to
execute the requisite TE-9 form for the DOT to effectuate the change, subject to the approval of
the Town Attorney.

Dear Mr. Hillman:
We have completed our investigation regarding your request to reduce the posted speed limit
from 50 mph to 40 mph, on CR 48 from 300 feet west of Clark Road to 500 feet e~st of Town
Beach in Southold. Our investigation included an accident analysis, a speed study and field
observations of the are~.
Prior to installing, modifying or removing a traffic control device, a comprehensive engineering
study is conducted. By law, the New York State Department of Transportation must follow the
National Manual on Uniform Traffic Control Devices and New York State Supplement to
facilitate a uniform system of traffic control devices. These manuals Contain specific
requirements for the posting of traffic control devices. The study that was conducted used
nationally accepted engineering guidelines established from many observations at intersections
throughout the country by experienced traffic engineers. Where the guidelines were met, the
installation, modification or removal of a traffic control device improved traffic flow and
decreased accidents. Where the guidelines were not met, public compliance was reduced and
additional congestion resulted.
The resuks of our study showed the 85m percentile speed was 54 mph and 51 mph for eastbound
and westbound CR45 respectively. Based on our study, the reduction of the posted speed limit
from 50 mph to 40 mph at the subject location would not be appropriate at this time.

Gentlemen:
The Town Board of the Town of Southold, by a resolution adopted
November 4, 2009, and the County Superintendent of Highways of the County of
Suffolk, hereby request the Department of Transportation, pursuant to Section
1622.1 of the Vehicle and Traffic Law, to establish a lower maximum speed at
which vehicles may proceed on Route 48, a County road between a point 500+
feet east of Town Beach and a point 300+_ feet west of Clark Road from 50 mph
to 40 mph thereby eliminating the current seasonal restriction.
Upon receipt of the notice that the regulation herein requested has been
established, the County of Suffolk will provide, install and maintain signs in
accordance with the Vehicle and Traffic Law and conforming to the Manual of
Uniform Traffic Control Devices of the Department of Transportation.
