AUTHORIZATION
Pursuant to the provisions of Chapter 275 and/or Chapter 111 of the Towa Code of the Town of
Southold and in accordance with the Resolution of the Board of Trustees adopted at the meeting held on
.September 23~ 2009, and in consideration of application fee in the sum of $250.Q0 paid by Michael & Corinne
Slade and subject to the Terms and Conditions as stated in the Resolution, the Southold Town Board of
Trustees authorizes and permits the £ollowing:
Wetland Permit to remove 163' of existing wooden boardwalk to allow for the
reconstruction of the existing bulkhead; reconstruct 172' of existing bulkhead by re-sheathing
landward side of bulkhead with "Everlast" 2.1 vinyl sheathing; install new l"x6' tie rod ends
welded into existing backing system tie rods; reinstall wooden boardwalk in-place after
bulkhead reconstruction is completed; maintenance dredge an area 50' seaward from the
existing bulkhead to a depth of-4.0' below MLW on the east end and progressing to -7.0' below
MLW on the west end; approximately 350 cubic yards of dredged spoil to be trucked olT site to
an approved upland dis..posal site, w!tlt the condition of the deployme.n.t 0~ a silt boom that will
retaha all suspended sediments within khe water column of the immediate project.area pursuant
to Chapter 275-11 and as defined in Chapter 275L2 of the Town Code, and as dePicted on the
site plan prepared by CosteHo Marine Contracting Corp., last dated September 24, 2009, and
stamped approved on September 25, 2009.
1N WITNESS WHEREOF. the said Board of Trustees hereby causes its Corporate Seal to be affixed,
and these presents to be subscribed by a majority of the said Board as of this date.
TERMS AND CONDITIONS
The Permittee Michael & Corinne Slade, residing at 1435 West Road, Cutchogue, New York
as part of the consideration for the issuance of the Permit does understand and prescribe to the
following:
That the said Board of Trustees and the Town of Southold are released from any and all
damages~ or claims for damages, of suits arising directly or indirectly as a result of any
operation performed pursuant to this permit, and the said Permittee will, at his or her own
expense, defend any and all such suits initiated by third parties, and the said Permittec
assumes full liability with respect thereto, to the complete exclusion of the Board of
Trustees of the Town of Southold.
That this Permit is valid for a period of 24 months, which is considered to be the estimated
time required to complete the work involved, but should circumstances warrant, request for
an extension may be made to the Board at a later date.
That this Permit should be retained indefinitely, or as long as the said Permittee wishes to
maintain the structure or project involved, to provide evidence to anyone concerned that
authorization was originally obtained.
That the work involved will be subject to the inspection and approval of the Board or its
agents, and non-compliance with the provisions of the originating application may be cause
for revocation of this Permit by resolution of the said Board.
That there will be no unreasonable interference with navigation as a result of the work
herein authorized.
That there shall be no interference with the right of the public to pass and repass along the
beach between high and low water marks.
That if future operations of the Town of Southold require the removal and/or alterations in
the location of the work herein authorized, or if, in the opinion of the Board of Trustees,
the work shall cause unreasonable obstruction to free navigation, the said Permittee will be
required, upon due notice, to remove or alter this work project herein stated without
expenses to the Town of Southold.
That the said Board will be notified by the Permittee of the completion of the work
authorized.
That the Permittee will obtain all other permits and consents that may be required
supplemental to this permit, which may be subject to revoke upon failure to obtain same.

Dear Ms. Costello:
The Board of Town Trustees took the following action during its regular meeting held on
Wednesday, September 23, 2009 regarding the above matter:
WHEREAS, Costello Madne Contracting Corp. on behalf of MICHAEL & CORINNE
SLADE applied to the Southold Town Trustees for a permit under the provisions of
Chapter 275 of the Southold Town Code, the Wetland Ordinance, original application
dated July 2, 2008, and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory
Council and to the Local Waterfront Revitalization Program Coordinator for their findings
and recommendations, and,
WHEREAS, the LWRP Coordinator recommended that the proposed application in part,
be found Inconsistent with the LWRP, and specifically Inconsistent with the following
coastal policies: Policy 6 - Protect and restore the quality and function of the Town of
Southold Ecosystem, Policy 6.3 - Protect and restore tidal and freshwater wetlands,
and,
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said
application on September 23, 2009, at which time all interested persons were given an
opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the
premises in question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
conceming this application, and,
WHEREAS, the structure, namely the proposed 8' extension to existing finger pier and
install two new 10" diameter x 30' long support pilings at offshore end, as applied for,
does not comply with the standards set forth in Chapter 275 of the Southold Town
Code, specifically Chapter 275-11, Construction and operation standards, C (2)(c)[1][a],
only one catwalk may be permitted per residential lot; only one mooring or dock may be
permitted per residential lot, and,
WHEREAS, the Board has determined that the structure, as applied for does not
comply with the standards set forth in Chapter 275-11, Standards for Issuance of a
Permit, as the lot (SCTM# 110-7-26) is zoned R-40 Residential and only one catwalk is
permitted per residential lot, and,
NOW THEREFORE BE IT
RESOLVED, for the foregoing reasons, and based upon the application's failure to meet
the standards contained in Chapter 275 of the Town Code, that the Board of Trustees
deems the proposed project to be Inconsistent with the Local Waterfront Revitalization
Program pursuant to Chapter 258-5 of the Southold Town Code, based on the additions
to the existing structure, and,
BE IT FURTHER
RESOLVED that the Board of Trustees DISAPPROVES in part, the application of
MICHAEL & CORINNE SLADE specifically to construct an 8' extension to existing
finger pier and install two new 10" diameter x 30' long support pilings at offshore end
and as depicted on the site plans prepared by Costello Marine Contracting Corp., last
dated September 2, 2009 and received on September 23, 2009. The Board of Trustees
otherwise approves the application as described in a separate letter as attached.
This is not a determination from any other agency.

not affect the health, safety and general welfare of the people of the town,
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees have found the application in part to be
Consistent with the Local Waterfront Revitalization Program, and,
RESOLVED, that the Board of Trustees approve the application in part of MICHAEL &
CORINNE SLADE specifically to remove 163' of existing wooden boardwalk to allow for

stamped approved on September 25, 2009.
The Board of Trustees otherwise disapproves the application as proposed with respect
to anything not described herein.
Permit to construct and complete project will expire two years from the date the permit
is signed. Fees must be paid, if applicable, and permit issued within six months of the
date of this notification.
Inspections are required at a fee of $50.00 per inspection. (See attached schedule.)

SPECIAL C(~NDITIONS
1. Any debris or excess material from construction of this project shall be completely removed from the adjacent area
and removed to an approved upland area for disposal: No debris is permitted in tidal wetlands or protected buffer areas.
2. All areas of soil disturbance resulting from the approved project shall be stabilized with appropriate vegetation
(grasses, etc.) immediately following project completion or prior to permit expiration, whichever comes first. If the
project site remains inactive for more than 48 hours or planting is impractical due to the season, then the area shall be
stabilized with straw or hay mulch or jute matting until weather conditions favor germination.
3. All disturbed areas where soil will be temporarily exposed or stockpiled for longer than 48 hours shall be contained
by a continuous line of staked haybales / silt curtains (or other NYSDEC approved devices) placed on the seaward side
between the fill and the wetland or protected buffer area. Tarps are authorized to supplement these approved methods.
4. All fill shall consist of "clean" sand, gravel or soil (not asphalt, slag, flyash, broken concrete or demolition debris).
5. No excavation of the beach is authorized for the purpose of obtaining fill or stone material.
6. All peripheral berms, cofferdams, rock revetments, seawalls, gabions, bulkheads or other approved shoreline
stabilization structures shall be completed prior to placement of any fill material behind such structures.
7. The new bulkhead shall be constructed landward of the existing structure. The existing sheathing shall not be
removed until the landward sheathing is securely in place. Once the new sheathiqg has been appropriately installed,
the old sheathing shall be cut to grade or removed in its entirety. Old sheathing may remain in place.
8. Prior to any construction or removal of bulkheads or other shoreline stabilization structures, all backfill must be
excavated landward of the structure and retained so as not to enter the waterway, tidal wetlands or protected buffer
areas.
9. There shall be no discharge of runoff or other effluent over or through any bulkhead or shoreline stabilization structure
or into tidal wetland or protected buffer area.
10. The use of wood treated with pentachlorophenol or other wood treatment not specifically approved by the
Department for use in wetlands and/or marine waters, is strictly prohibited in the construction of structures that will be
in contact with tidal waters.
11. No permanent structures shall be installed on docks/catwalks/floats without first obtaining written Department
approval (permit, modification or amendment).
12. Dredge material approved to remain on-site and/or within the NYSDEC Tidal Wetlands jurisdiction shall be retained
so as not to enter anywater body, tidal wetlands, or protected buffer areas. Off-site, upland disposal of dredged material
beyond NYSDEC Tidal Wetland jurisdiction requires the approval of the Division of Solid and Hazardous Materials (831)
444-0375 and is not covered by this permit.
13. During the dredge operation, the permit holder and his contractor shall prevent spillage of sediment during
excavation and haulage. Dredging shall be accomplished with a clam shell or other closed bucket equipment.
14. Excavated sediment shall be placed directly into the approved disposal/dewatering site or conveyance vehicle.
No side-casting (double dipping) or temporary storage of dredged material is authorized.
15. At least 48 hours prior to commencement of the project, the permittee and contractor shall sign and return the top
portion of the enclosed notification form certifying that they are fully aware of, and understand all terms and conditions
of, this permit. 'Within 30 days of completion of project, the bottom portion of the form must also be signed and returned,
along with photographs of the completed work.

( TIDAL WETLANDS)
If future operations by the State of New York require an alteration in the position of the structure or work herein
authorized, or if, in the opinion of the Department of Environmental Conservation it shall cause unreasonable
obstruction to the free navigation of said waters or flood flows or endanger the health, safety or welfare of the people
of the State, or cause loss or destruction of the natural resources of the State, the owner may be ordered by the
Department to remove or alter the structural work, obstructions, or hazards caused thereby without expense to the
State, and if, upon the expiration or revocation of this permit, the structure, fill, excavation, or other modification of
the watercourse hereby authorized shall not be completed, the owners, shall, without expense to the State, and to
such extent and in such time and manner as the Department of Environmental Conservation may require, remove
all or any portion of the uncompleted structure or fill and restore to its former condition the navigable and flood
capacity of the watercourse. No claim shall be made against the State of NewYork on account of any such removal
or alteration.
The State of New York shall in no case be liable for any damage or injury to the structure or work herein authorized
which may be caused by or result from future operations undertaken by the State for the conservation or
improvement of navigation, or for other purposes, and no claim or right to compensation shall accrue from any such
damage.
All necessary precautions shall be taken to preclude contamination of any Wetland or waterway by suspended solids,
sediments, fuels, solvents, lubricants, epoxy coatings, paints, concrete, leachate or any other environmentally
deleterious materials associated with the project..
Any material dredged in the conduct of the work herein permitted shall be removed evenly, without leaving large
refuse piles, ridges across the bed of a waterway or floodplain or deep holes that may have a tendency to cause
damage to navigable channels or to the banks of a waterway.
5. There shall be no unreasonable interference with navigation by the work herein authorized.
If upon the expiration or revocation of this permit, the project hereby authorized has not been completed, the
applicant shall, without expense to the State, and to such extent and in such time and manner as the Department
of Environmental Conservation may require, remove all or any portion of the uncompleted structure or fill and restore
the site to its former condition. No claim shall be made against the State of New York on account of any such
removal or alteration. '
If granted under 6NYCRR Part 608, the NYS Department of Environmental Conservation hereby certifies that the
subject project will not contravene effluent limitations or other limitations or standards under Sections 301,302,303,
306 and 307 of the Clean Water Act of 1977 (PL 95-217) provided that all of the conditions listed herein are met.
8. At least 48 hours prior to commencement of the project, the permittee and contractor shall sign and return the top
portion of the enclosed notification form certifying that they are fully aware of and understand all terms and
conditions of this permit. Within 30 days of completion of project, the bottom portion of the form must also be
signed and returned, along with photographs of the completed work and, if required, a survey.
9. All activities authorized by this permit must be in strict conformance with the approved plans submitted by the
applicant or his agent as part of the permit application.

Item A: · Permittee Accepts Legal Responsibility and Agrees to Indemnification
The permittee, excepting state or federal agencies, expressly agrees to indemnify and hold harmless the Department
of Environmental Conservation of the State of New York, its representatives, employees, and agents ("DEC") for all claims,
suits, actions, and damages, to the extent attributable to the permittee's acts or omissions in connection with the permittee's
undertaking of activities in connection with, or operation and maintenance of, the facility or facilities authorized by the permit
whether in compliance or not in compliance with the terms and conditions of the permit. This indemnification does not
extend to any claims, suits, actions, or damages to the extent attributable to DEC's own negligent or intentional acts or
omissions, or to any claims, suits, or actions naming the DEC and arising under article 78 of the New York Civil Practice
Laws and Rules or any citizen suit or civil rights provision under federal or state laws.
Item B: Permittee's Contractors to ComPly with Permit
The permittoe is responsible for informing its independent contractors, employees, agents and assigns of their
responsibility to comply with this permit, including all special conditions while acting as the permittee's agent with respect
to the permitted activities, and such persons shall be subject to the same sanctions for violations of the Environmental
Conservation Law as those prescribed for the permittee.
Item C: Permittee Responsible for Obtaining Other Required Permits
The permittee is responsible for obtaining any other permits, approvals, lands, easements and rights-of-way that may
be required to carry out the activities that are authorized by this permit.
Item D: No Right to Trespass or Interfere with Riparian Rights
This permit does not convey to the permittee any right to trespass upon the lands or interfere with the riparian rights of
others in order to perform the permitted work nor does it authorize t~e impairment of any rights, title, or interest in real or
)ersonal property held or vested in a person not a party to the permit.
GENERAL CONDITIONS
General Condition 1: Facility Inspection by the Department
The permitted site or facility, including relevant records, is subject to inspection at reasonable hours and intervals by an
authorized representative of the Department of Environmental Conservation (the Department) to determine whether the
)ermittee is complying with this permit and the ECL. Such representative may order the work suspended pursuant to ECL
71-0301 and SAPA 401(3).
The permittee shall provide a person to accompanythe Department's representative during an inspection to the permit
area when requested by the Department.
A copy of this permit, including all referenced maps, drawings and special conditions, must be available for inspection
by the Department at all times at the project site or facility. Failure to produce a copy of the permit upon request by a'
Department representative is a violation of this permit.
General Condition 2: Relationship of this Permit to Other Department Orders and Determinations
Unless expressly provided for by the Department, issuance of this permit does not modify, supersede or rescind any
order or determination previously issued by the Department or any of the terms, conditions or requirements contained in
such order or determination.
General Condition 3: Applications for Permit Renewals or Modifications
The permittee must submit a separate written application to the Department for renewal, modification or transfer of this
)ermit. Such application must include any forms or supplemental information the Department requires. Any renewal,
modification or transfer granted by the Department must be in writing.
The permittee must submit a renewal application at least:
a) 180 days before expiration of permits for State Pollutant Discharge Elimination System (SPDES), Hazardous
Waste Management Facilities (HWMF), major Air Pollution Control (APC) and Solid Waste Management
Facilities (SWMF); and
b) 30 days before expiration of all other permit types.
Submission of applications for permit renewal or modification are to be submitted to:

c) exceeding the scope of the project as described in the permit application;

Subject: Slade Inspection
In response to the June 26 letter from Pat Moore, in reference to the Slade property, I inspected the section of
the bulkhead where the sailboat is depicted in the pictures provided to us by Ms, Moore. It was stated in the
Better that Mr. Slade was unable to moor his sailboat against the bulkhead as a result of a lack of water depth.
This inspection was done at Iow tide on July 7 at about 6:15 PM... It should be noted that full moon was on July
6 and that Iow tide was scheduled for about 6:30 PM. I found the vessel in question floating up against the
bulkhead. I pulled on the vessel's spring lines and found that it floated freely both forward and backward..

I have been retained by Dr. And Mrs. Slade regarding
reconstruction of their functional permitted bulkhead. Lori Hulse
has advised me that I may proceed with the application prepared by
Costello Marine Contracting. I will work with Mr. Costello, who
knows more than I do regardin~ the work to be performed.
It is my understandin~ that at the public hearin~ the Board
was prepared to ~rant the wetland permit application for the work
described on the DEC permit dated October 9, 2008. However, the
Board raised the concern of authorizin~ placement of more than one
float (two floats) along the bulkhead and westerly dock. One 6'
x 20' float alon~ the bulkhead had a valid permit and is shown on
amended permit #4440. The piles for the second float had been at
the property since my client started renting from Mr. Stahl in the
early 80's and the old floats were replaced in the 1990's.
Nevertheless, due to the criminal complaint, he was prohibited from
continuing this application unless he removed both floats
immediately. He removed both floats as directed.
The floats have become necessary because of the accumulation
of runoff of sand and fill from the Town Road(West Road) through a
storm drain installed by the Town, at the end of West Road, which
drains directly adjacent to the boat slips. The road's runoff has
caused the boat slip on the seaward side of the bulkhead to fill
in. Dr. Slade did not become aware of the severe silt and sand
accumulation under the float and adjacent to the bulkhead until the
Board required him to remove the existin~ float. The float enables
the owner to continue to use the slip by the bulkhead. While the
Town needs to correct this condition, the practical solution to the
property owner who is being damaged by the Town's actions, or
Town's failure to act, is to provide a float. The two floats (5'
x 24'= 120 sq.ft.) also permit the sail boats to maneuver more
easily to the dock. The floats are positioned and tied up to the
pre-existing piles.
My clients dredged this area in 1996 and the County dredged in
1997 with maintenance dredging thereafter. The owner has
maintained their sailboat at this location for years however,
without a float, the sail boat can not be positioned parallel to
the bulkhead. (See photo) As you see in the photograph the sail
boat remains at an angle due to the sand accretion. At low tide
the sail boat is more than 4 feet from the bulkhead. A float
enables the owner to continue the use of his property despite the
damage caused by the Town's storm drain.
The one float has a permit, the proposed second float which
Dr. Slade has known to be at this location since the 80's remains
inland of the pier line formed by New Suffolk Shipyard's floats and
boats which are parallel to Wickham Creek (see Google map).
With regard to the permit application, I noticed that all the
proposed actions described in the Costello application merely
require administrative permits.

accomplished this year.

THE FOLLOWING SECTION ADDRESSES THE PROPOSED BULKHEAD REPLACEMENT:
The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and
the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP
Consistency Assessment Form submitted to this department, as well as the records available to me, it is our recommendation that
the proposed action is CONSISTENT with LWRP policy standards and therefore is CONSISTENT with the LWRP;
provided that the proposed action is an in-kind/in-place replacement pursuant to § 268-3.
§ 268-3. Definitions.
MINOR ACTIONS -- Include the following actions, which are not subject to review under this chapter:
A. Maintenance or repair involving no substantial changes in an existing structure or facility;
Replacement, rehabilitation or reconstruction of a structure or facility, in kind, on the same site, including upgrading
buildings to meet building or fire codes, except for structures in areas designated by the Coastal Erosion Hazard Area
(CEHA) law where structures may not be replaced, rehabilitated or reconstructed without a permit;
The bulkhead replacement will require the installation of a silt boom that will retain all suspended sediments within the
immediate proiect area pursuant to § 275-11 and as defined in § 275-2.
§ 275-11. Construction and operatiop-~andards. ~--
A. General. The following standards are required for ail operations within the jurisdiction of the Trustees:
(2) Erosion control. Installation of an erosion control structure is necessary during any building, grading, landscaping or site
work activity within Trustee jurisdiction. This structure may include, but is not limited to, installation ora silt fence, hay bales,
wood chip berm and silt booms. The placement of the erosion control structure(s9 shall be determined by the Trustees or their
designee. All intertidal construction and excavation requires the instullation of a silt boom that will retain all suspended
sediments within the immediate project area.
§ 275-2. Definitions; word usage.
SILT BOOM -- A structure deployed within the water column that is designed to prevent passage of suspended sediments and
contaminants from spreading from the immediate project area to surrounding waters. Properly installed, silt booms completely
surround the project area.
The deployment of a silt boom will further advance LWRP Policy 5~ Protect and improve water quality in the Town of
Southold and Policy 6 Protect and restore tidal and fresh water wetlands.
Policy 5. Protect and improve water quality and supply in the Town of Southold.
5.3 Protect and enhance quality of coastal waters.
B. Minimize disturbance of streams and creeks including their bed and banks in order to prevent erosion of
soil, increased turbidity, and irregular variation in velocity, temperature, and level of water.
Policy 6. Protect and restore the quality and function of the Town of Southold ecosystem.
6.3 Protect and restore tidal and freshwater wetlands.
A. Comply with statutory and regulatory requirements of the SouthoM Town Board of Trustees laws and regulation*'
for all Andros Patent and other lands under their jurisdiction
1. Comply with Trustee regulations and recommendations as set forth in Trustee permit conditions.
If the action {bulkhead replacement) is approved the following best mana~,ement practice {BMP) is recommended:
1. Require the applicant to maximize a non-turf, permeable buffer landward of the bulkhead in place of the existing
wooden board walk.

The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and
the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP
Consistency Assessment Form submitted to this department, as well as the records available to me, it is our recommendation that
the proposed action is INCONSISTENT with LWRP policy standards and therefore is INCONSISTENT with the LWRP.

The proposed finger pier extension which is on lot (SCTM# 110-7-26) is zoned R-40 Residential. Only one catwalk is
permitted per residential lot pursuant to § 275-11. Currently there are multiple docking structures on this residential lot
and therefore the proposed finger pier extension is not in compliance with § 275-11 Construction and operation standards
as referenced below.
§ 275-11. Construction and operation standards.
C. In water. The following standards are required for all in-water operations adjacent to residential properties. Operations
conducted on properties zoned MI or M2 may be given greater flexibility in these requirements given the water-dependent nature
of their use.
(2) Docks.
Regulations for the placement and configuration of docking facilities.

Only one catwalk may be permitted per residential lot. Only one mooring or dock may be
permitted per residential lot. Upon a showing of special need due to low water level and hazard to
property, the Trustees may permit both a mooring and a dock for the same residential property.

§ 275-11 Construction and operation standards

(a) Creeks.
Only maintenance dredging (as defined in § 275-2) is permitted, unless the applicant owns underwater
landor the applicant is requesting permission to dredge in connection with installation of low-sill
bulkheads. All maintenance dredging permits shall be valid for a period no greater than l O years.

[2] Dredging may be permitted when it can be demonstrated thal the actions of man have resulted in
impairment to water quality or habitat value.

MAINTENANCE DREDGING - A dredging project will be considered maintenance dredging if there is documentary evidence
that it has been previously dredged.
The proposed dredging activity may improve navigation to Wickham Creek and further support the associated water-
dependent oses of the neighboring Marina~ which will advance LWRP policy 10t Protect $onthold's water-dependeot uses
and promote siting of new waterdepeodent uses in suitable locations. The intent of policy 10 is to protect existing water-
dependent commercial~ iodnstrial~ and recreational oses and to enhance the economic viability of water-dependent oses by
ensoring adequate provision of infrastructure for water-dependent uses and their efficient operation.
Policy 10. Protect Soothold's water-dependent uses and promote siting of new waterdependeot uses in suitable locations.
10.5 Provide sufficient infrastructure for water-dependent uses.
A. Provide adequate navigation infrastructure.
1. Protect and maintain existing public and private navigation lanes and channels which provide access to the Town's
water-dependent uses.
2. Maintain necessary public and private channels and basins at depths consistent with the needs of water-dependent uses.
If the Agency~ Board of Trustees makes a contrary determination of consistency~ the Agency shall elaborate in writing the
basis for its disagreement with their recommendations Pursuant to Chapter 268 Waterfront Consistency Review.
§ 268-5. Review of actions.
In the event the LWRP Coordinator's recommendation is that the action is inconsistent with the LWRP, and the agency
makes a contrary determination of consistency, the agency shall elaborate in writing the basis for its disagreement with
the recommendation and state the manner and extent to which the action is' consistent with the L WRP policy standards.
Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination
regarding the consistency of the proposed action.

It is the recommendation of the Local Waterfront Revitalization Coordinators that when the Board of
Trustee's require the deployment ora silt boom for all in the water intertidal operations that the Board of
Trustee's further stipulate within the applicants resolution for a wetland permit that the applicant or agent
provide confirmation with the Board of Trustee's office when the silt boom has been deployed prior to
operations.
§ 275-2 Definitions; word usage.

suspended sediments and contaminants from spreading from the immediate project area to surrounding
waters. Properly installed, silt booms completely surround the project area.

Our proposal will enhance the visual quality. The present condition of these structures is somewhat
an eyesore. Reconstructing the existing structures will make the area look well maintained and non
neglected.

Policy 4 Minimize loss of life, structures, and natural resources from flooding and erosion.
All proposed construction is on pre-existing structures. The maintenance of these structures will not
increase flooding or erosion in this area.

This proposal will not have any impact on the water quality and supply of the Town of Southold.

Protect and restore the quality and function of the Town of Southold's ecosystem.
There is virtually no vegetation in the project area. The area of shoaling is the proposed dredged
area. The shoaling is limiting boat access to the bulkheaded area. The proposed construction is on
structures that are existing and only a slight alteration is being made to the existing dock which
conforms to neighboring docks. A buffer behind the bulkhead will be maintained to control any
potential runoff. The area is not a significant habitat. All best management practices will be adhered
to during the reconstruction of these structures.

This proposal will not have any impact on the air quality of the Town of Southold.

has always been used at the bulkhead, it can be documented in Town Trustee records since 1997.
The existing structures are vested, "permitted structures" which need to be repaired. We request that

Re: Michael Slade Property
To whom~mayconcern:
I docked my 22-foot sailboat at the Slade property from 1991 to 2007 (1991
when owned by Sy Stahl) until I sold the boat. Prior to that I docked at
Cutchogue Harbor Marina and for years before that was aware of the docks at
the Lister/Stahl/Slade property. My full-time residence is about two hundred
feet from the boat slips.
From the beginning, it was understood that it was not a marina and offered no
other services other than access to water and electricity. This was clear all the
years I kept my boat there. Most, if not all, of the tenants were local residents
who did not need the services of a full marina, but only a place to keep their
boats. There were restrictions such as required insurance, finite limits to boat
dockage, no live-aboards, no sublets, responsibility for garbage removal, etc.
There was no storage or repair on site other than in-water emergency repairs
(major repairs or maintenance were done off-site), no restrooms, small dock
lights only in use if a boater went out at night and remained off in all other
times.
In my 21 years living almost adjacent to the 81ade slips (and 40 years of visiting
on West Creek Avenue) and my 11 years in the slips, I have not noted any
increase in the number of slips nor the size of the existing slips. The bulkhead
was repaired several years ago, but it did not alter the size nor layout of the
slips, but served to shore up the old bulkhead that has been in place since the
1950s where it is shown as existing on a blue print of a proposed "boatel' by the
then owner of all the area property (Lister). A rock revetment was put in place
along the creek-side to enhance the existing cement and rocks along the east
side of the creek. Other than the dock lights, there is no other outside lighting,
noise, parking issues, no amenities for onsite picnics, parties, barbecues,
sunbathing, etc. It is/was simply a place to keep a boat and feel safe with other
local boat owners.

To ~vhom it may concern:
About 1995 I rented one of Michael Slade's slips at the foot of West Road on Fleet's
Neck. I kept my boat there for several years. During that time he had six slips south of
West Road plus two or three births directly on the creek. He was careful to let me
understand that he was not running a marina and there was to be no major maintenance,
no overnight living aboard and no other use of his property. Finger docks and pilings
were provided as was well water for flushing off salt spray. During my stay he had the
bulkhead and wood walkways repaired by a dock builder. Riprap was added to the creek
bank to check erosion where there was no bulkhead west of the house.
Earlier, in the seventies, I kept a boat further up in the creek and later in Boatman's
Harbor Marina. My recollection of the layout of the 110-7-26 property at that time is less
definitive than my recollection of the nineties, but I recall boats being kept there. I may
have assumed then that it was part of the marina.
My earliest recollection of the area dates from about 1950. As a frequent guest of the
Vanderbeck/Baming family who had a house on West Creek Avenue, I remember the
area as a base for marine recreation. Mental images of sixty years ago are dim but the
~o_'tc~d imprcssion is one of li~tlc shorc development and exteusive marsh grass. I do
recall construction at the marina, the marina's gasoline sign and the house where we
wm~ld buy h,qil. The easl bank oC~he creek was hardened south of the marina with

placed there by Harry Lister.

Dear Mr. Fitzgerald,
The following action was taken by the Board of Town Trustees
during its regular meeting held on April 27, 1995 regarding the
above matter:
WHEREAS, Proper-T Services, on behalf of MICHAEL SLADE,
applied to the Southold Town Trustees for a permit under the
provisions of the Wetland Ordinance of the Town of Southold,
application dated February 10, 1995 and,
WHEREAS, said application was referred to the Southold Town
Conservation Advisory Council for their findings and
recommendations, and
WHEREAS, a Public Hearing was held by the Town Trustees with
respect to said application on ~p~IL ~ ~995, at which time all
interested persons were given an opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are
familiar with the premises in question and the surrounding area,
and,
WHEREAS, the Board has considered all the testimony and
documentation submitted concerning this application, and,
WHEREAS, the structure complies with the standard set forth in
Chapter 37-18 of the Southold Town Code, which will be listed on
a separate page, and,
WHEREAS, the Board has determined that the project as proposed
will not affect the health, safety and general welfare of the
people of the town,
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees approves the application of
MICHAEL SLADE to construct approx. 135' of new bulkhead
joining two existing bulkhead structures, excavate and dredge a
small area adjacent to new bulkhead, using spoil to backfill
bulkhead, and replant beach on south side 18" on center.
Located: 1435 West Road, Cutchogue.
Permit to construct project will expire two years from the date
it is signed. Fees must be paid, if applicable, and permit
issued within six months of the date of this notification.
Two inspections are required and the Trustees are to be notified
upon completion of said project.

The following action was taken by the Board of Trustees at their
regular meeting of Ju/%e 27, 1996:
RESOLVED that the Southold Town Board of Trustees approve the
request for an Amendment to Perr~it #4440 to constr~ct approx.
135' X 12' to 20' wide rock revetment instead of bulkhead to tie
into two existing bulkheads as Der DEC requirement and dredge
area around docks to depth of from 4' below MLW to 7' below
MLW yielding approx. 350 c.y. of spoil and a 10 year
maintenance~period as necessary, and that any excess spoil be
given to the Highway Department. Located: 1435 West Road,
Cutchogue.
This does not constitute any other permits from any other
agencies.
