Dear Mr. Emilita:
The Southold Town Board of Trustees reviewed the site plan prepared by Barrett
Bonacci & Van Weele, PC, last dated October 8, 2009, and received on October 19,
2009, and determined that the installation of public water from the SCWA main in Indian
Neck Lane to service the agricultural buildings under construction on this property is out
of the Wetland jurisdiction under Chapter 275 of the Town Wetland Code and Chapter
111 of the Town Code.
Therefore, in accordance with the current Wetlands Code (Chapter 275) and the
Coastal Erosion Hazard Area (Chapter 111 ) no permit is required. Please be advised,
however, that no construction, sedimentation, or disturbance of any kind may take place
seaward of the tidal and/or freshwater wetlands jurisdictional boundary or seaward of
the coastal erosion hazard area as indicated above, or within 100' landward from the
top of the bluff, without further authorization from the Southold Town Board of Trustees
pursuant to Chapter 275 and/or Chapter 111 of the Town Code. It is your responsibility
to ensure that all necessary precautions are taken to prevent any sedimentation or other
alteration or disturbance to the ground surface or vegetation within Tidal Wetlands
jurisdiction and Coastal Erosion Hazard Area, which may result from your project. Such
precautions may include maintaining adequate work area between the tidal wetland
jurisdictional boundary and the coastal erosion hazard area and your project or erecting
a temporary fence, barrier, or hay bale berm.
This determination is not a determination from any other agency.

Dear Mr. King:
In accord with a staff determination, Belvedere Property Management is seeking a Letter
of Non-Jurisdiction fi.om Chapter 275 of the Southold Town Code with respect to a
proposed application to provide public water fi.om the SCWA main in Indian Neck Lane
to service the agricultural buildings under construction on this property as shown on the
attached plan entitled "Indian Neck Lane Residential Horse Farm - Water Supply &
Sewage Disposal Plan" prepared by Barrett Bonacci & Van Weele, PC last revised
10/8/09. The nearest disturbance is over 650 feet fi.om the flagged tidal wetlands abutting
and north of Little Creek. These wetlands were flagged for the subdivision of "Lands of
Marco" in 2007 and are shown on the plan entitled "Indian Neck situate Peconic -
Survey" prepared by Barrett Bonacci & Van Weele, PC last revised 9/30/08.
The subject premise currently enjoys a building permit for the agricultural buildings
issued by the Town without the requirement of a permit under Chapter 275. No change in
the building footprint or any other changes to this site are proposed other than that shown
on the water supply plans.
