The fight-of-way is on the property of Margery Prellwitz (SCTM #1000-86-7-7.1). Also enclosed are a number of supporting documents and a check made to Town of Southold with thc dollar amount left blank for the fee for this permit. Included is a letter of non-jurisdiction from the Southold Trustees. Application has been made to the NYSDEC for a letter of non-jurisdiction and/or a confirmation that the project does not require a permit. A copy of the cover letter to the DEC is attached. It would be appreciated if the permit could bc issued without a formal statement from the DEC, since the Nolan's are most anxious to have safe access to their beach as soon as possible. Additionally, the structure cannot provide storm protection from waves or hold fill; therefore, the structure is not a substantial structure. Accordingly, the property does not qualify for a letter of non-jurisdiction and a permit will be required for the proposed stairway. I have enclosed an application package for your convenience. Please complete and submit with 3 additional copies of the plan and 4 copies of a cross-section for the stairway. A permit can be issued upon receipt and review of the plan and approvable cross-section.
