b. Pint plan showing location of lot and of buildings on premises, relationship to adjoining premises or public streets

Re: Application for Building Permit for Edward Nolan, SCTM #1000-86-7-7.3
Dear Sir:
Attached is a completed Application for Building Permit submitted on behalf of Edward Nolan
for the construction of stairs to the beach on a deeded fight-of-way. The fight-of-way is on the
property of Margery Prellwitz (SCTM #1000-86-7-7.1).
Also enclosed are a number of supporting documents and a check made to Town of Southold
with thc dollar amount left blank for the fee for this permit.
Included is a letter of non-jurisdiction from the Southold Trustees. Application has been made
to the NYSDEC for a letter of non-jurisdiction and/or a confirmation that the project does not
require a permit. A copy of the cover letter to the DEC is attached. It would be appreciated if
the permit could bc issued without a formal statement from the DEC, since the Nolan's are
most anxious to have safe access to their beach as soon as possible.

Dear Mr. Fitzgerald:
The New York State Department of Environmental Conservation (the "Department") has
completed its review of your request for a letter of non-jurisdiction for the above referenced property
and has the following comments:
The submitted photograph depicts a concrete curb-like structure, not a bulkhead as labelled
on the VanTuyl survey. Additionally, the structure cannot provide storm protection from waves or
hold fill; therefore, the structure is not a substantial structure. Accordingly, the property does not
qualify for a letter of non-jurisdiction and a permit will be required for the proposed stairway.
I have enclosed an application package for your convenience. Please complete and submit
with 3 additional copies of the plan and 4 copies of a cross-section for the stairway. A permit can
be issued upon receipt and review of the plan and approvable cross-section.
