ANN DILLER, residing at 49 Deer Path Road, North Great River, New York
11739, as Executrix under the Last Will and Testarrent of Kathleen M.
Diller, deceased, and THCMAS EDWARD HEMBLO and ANN DILLER HEMBLO, both
residing at (no #) Ackerly Pond Road, Southold, New York 11971, as
Executors under the Last Will and Testament of JANE D. HEMBLO, deceased,
hereinafter referred to as the "Declarants";
WHEREAS, the Declarants are the =ers in fee simple of a
certain parcel of land situate on the easterly side of Ackerly Pond
Road, in the T= of Southold, Ccunty of Suffolk and State of New York,
being the premises described in Schedule A attached hereto, hereinafter
referred to as the "premises".
WHEREAS, the Declarants intend to subdivide said premises into
two (2) lots, =nsisting of one 1.92 acre lot and a 15.947 acre parcel,
and desire to subject said premises to certain =nditions, covenants and
restrictions; and
WHEREAS, the two parcels are set out on a map entitled, "Map
of Set-Off Made for Ann Hernblo, et a1." and filed in the office of the
Southold Town Planning Board; and
WHEREAS, the Southold Town Planning Board has approved said
set-off on the condition that Lot 2 on said subdivision not be further
subdivided .
NCW, THEREFORE, the Declarants do hereby declare that the
aforesaid premises and every portion thereof are hereby held and shall
be conveyed subject to the =nditions, covenants and restrictions

hereinafter set forth, and that every purchaser of said premises or any
portion thereof, by the acceptance of a deed thereto, covenants and
agrees that the premises so purchased shall be held subject to the

Town of Southald, County of Suffolk and State of New York, bounded and
described as follows:
BEX;INNING at a point on the easterly side of Ackerly Pond Road at
the northwest corner of the premises herein described adjoining land of
Funnankiewicz on the North;
RUNNING THENCE along said land of Funnankiewicz the following two
(2) courses and distances:
(1) North 440 18' 00" East, 44.70 feet; thence
(2) North 3P 53' 10" East, 504.00 feet to land of
the Long Island Railroad;
RUNNING THENCE along said land four (4) courses and distances as
follows:
(1) On an arc to the right having a radius of 2840.04 feet, a
distance of 133.0 feet; thence
