The meeting began at 7:25 p.m. with five LPC members present. Adoption of Meeting Minutes: ?? ACCEPTANCE OF MEETING MINUTES FROM SEPTEMBER 29, 2009 AND OCTOBER 13, 2009 MOTION made by Ray Huntington, seconded by Eric Keil, to adopt the September 29, 2009 meeting minutes, as revised. Motion carried: 5/0 HOLD acceptance of meeting minutes from October 13, 2009, for review. Applications and Inquiries: ?? CONWAY (Estate of Julia) PROPERTY SCTM #: 1000-54-7-21.1 Offered: dev rights Location: 4395 Hortons La, Southold Zoned: AC, R-40 (0.26 acre) Total Acreage: 34 acres (GPS 33.86) CPF: Yes Subdividable: Yes FWet: 0.52 acre John Sepenoski, LPC Chairman, was not present for a discussion of this project due to a family relationship. Stephen Searl (PLT) presented information re: potential PDR Stephen Searl presented a proposed project on land owned by the Estate of Julia Conway. Heirs have contacted Peconic Land Trust, Inc. with the purpose of preservation of the farm with the sale of the development rights and outright sale of fee title. Property includes a farmhouse and several barns and ag structures. Land has been planted in sod for the past 5 to 8 years. This project may be a candidate for the Town’s $4 million bond program. PLT has ordered an appraisal to consider a potential purchase of fee title to the farm, selling the development rights to the Town. MOTION made by Lillian Ball, seconded by Eric Keil, to direct Melissa Spiro to commission an appraisal for fee title and development rights easement values on property owned by the Estate of Julia Conway. Property restrictions, if any, will be discuss at a later date and any such restrictions imposed that will affect the value of the property, will be subject to appraisal revisions. TPC LLC PROPERTY (Business Name: Beds and Borders) SCTM #: 1000-127-2-2.1 PDR offered: All Location: 550 Route 25, Laurel Zoned: R-80 Total Acreage: 14.8 acres (GIS 14.77) CPF: Yes Subdividable: Yes F/MWet: 0 acres New PDR Application. Proposed project presented by Melissa Spiro who met with landowner, Kevin Cande, who would like to sell a development rights easement to entire parcel to Town. Property is located along the Town of Southold/Riverhead border line. LPC members divided as to whetherto proceed with an appraisal. A consultation with the Town Board appeared desirable. Due to Melissa’s anticipated absence on day of next Town Board Work Session (Wed, 11/4/09), John Sepenoski and/or Ray Huntington, will schedule appointment with Town Board seeking Town Board’s opinion on this preservation project before any further action is taken by Land Preservation Committee. John Sepenoski and/or Ray Huntington will brief Town Board and John & Raywill report back to committee. ?? GIRARDS PROPERTY (6900 Wickham Avenue, LLC) SCTM #: 1000-107-10-10.1 Offered: 8.1 dev rights Location: 6900 Wickham Ave, Mattituck Zoned: A-C Total Acreage: 10.10 acres CPF: Yes Subdividable: Yes F/MWet: 0 acres Reviewed appraisal [executive session]. The members entered into EXECUTIVE SESSION. Melissa Spiro presented background information on re-activated application. Last appraisal completed in September 2006. New appraisal dated October 1, 2009. Appraisal reviewed by committee. MOTION made by Eric Keil, seconded by Chris Baiz, to authorize Melissa Spiro to present a purchase offer by certified mail/return receipt requested for a development rights easement per buildable acre on agricultural land owned by 6900 Wickham Avenue, LLC (Girards). The Committee’s offer is based on the landowner’s proposal to offer a development rights easement on approximately 8.1 acres of the 10.1 acre parcel, reserving an area around the existing residential home and several other structures located on the property. The Committee’s offer does not restrict the location or allowance for agricultural structures as permitted by Town Code. The purpose of this acquisition is for farmland protection. This offer is subject to approval by the Town Board after a Town Board public hearing on the project. Motion carried: 5/0 END OF EXECUTIVE SESSION ?? PLT & MACARI PROPERTIES SCTM #: 1000-109-1-13.2 PDR: 42.13 acres Location: Route 25, Cutchogue SCTM #: 1000-109-1-24.4 PDR: 34.19 acres Location: 1855 Alvahs La, Cutchogue Stephen Searl (PLT) presented information re: potential land swap between owners. Stephen Searl presented a proposed acre for acre land swap between adjacent landowners, Peconic Land Trust, Inc. (1000-109-1-13.2) and Marcari Vineyards (1000-109-1-24.4) that is subject to LPC review. Both parcels have Town purchased development rights easements. Proposed lot line changes would result in PLT property having road frontage of Alvah’s Lane, and eliminating its right- of-way over Macari property fronting on NYS Route 25 and Macari vineyard operation owning land behind their winery. MOTION made by Eric Keil, seconded by Lillian Ball, granting Peconic Land Trust, Inc. and Macari Vineyards permission to pursue an acre for acre land swap resulting in lot line changes for these two Town development rights easements in accordance with concept plan presented by Stephen Searl of Peconic Land Trust, Inc. Motion carried: 5/0 Applications & Inquiries for Uses or Structures on Preserved Property ?? SCTM #1000-58-1-1.1 (Town/County Open Space f/k/a Bittner) Reviewed proposed parking lot plan. Parking lot plan as devised by Jim McMahon, DPW, and rendered by drawings of Jamie Richter, Town Engineer, was reviewed by Committee. Plan shows proposal for 5 parking spaces with back-up space in location previously approved by Committee, Parking area will be composed of 6” thick blue stone blend, after removal of two trees in proposed parking area. LPC members instructed Melissa Spiro to inform Jim McMahon, DPW, to relocate existing gate closer to proposed parking area to prevent vehicle parking outside proposed parking location. Natural methods, such as felled tree trunks or rocks to be used either side of relocated gate to prevent vehicles from being able to drive around the closed gate. No RCA, only blue stone blend to be used for parking area. Jim & Jamie to provide LPC with an updated and revised rendering of parking area showing relocation of existing gate. General Land Preservation Items: ?? MELISSA SPIRO’S CONFIDENTIAL STATUS REPORT AND FINANCIAL SNAPSHOP UPDATE [executive session re: status of offers] ?? PRESERVATION OUTREACH rd Update re: October 23 Cutchogue/Mattituck farm belt Discussion Forum o Forum, presented by the Peconic Land Trust, Inc. and Town of Southold, and hosted by Louis & Lisa Carracciolo, was attended by approximately 10 landowners. Due to success of this forum, it was suggested that any future forums should target specific areas within the Town and scheduling would best be done during winter months, possibly December thru February, in order to assure a bigger turn-out of local agricultural landowners. ?? KACE LI, LLC DEIS Ray Huntington presented information re: DWIS public hearing and comment period Ray Huntington provided hand-out of NYS-DEC Notice of Completion of Draft EIS, Notice of Complete Application and Notice of SEQR Hearing for applicant, KACE LI, LLC, and tax map location of subject property. The NYS-DEC, lead agency for KACE LI, LLC, will be holding a SEQR public hearing on Wednesday, October 28, 2009 from 7:00 to 9:30 p.m. at Southold Town Hall for public comment on the proposed annexation by the Village of Greenport of approximately 17.2 acres of land (SCTM #1000-40-3-1) in the Town of Southold and the subsequent development and construction of a residential project known as Northwind Village. Northwind Village is a proposed 128 living units on 17 acres of land that borders Moores Woods in Greenport. There is an on-going lawsuit between the Town of Southold and KACE LI, LLC regarding the annexation of this parcel to the Village of Greenport and the proposed development of this property. Ray asked that LPC members attend this public hearing and prepare and submit written comments on the DEIS that determined that this project would have no significant environmental impact on the surrounding areas. LPC is concerned that there will be an environmental impact as natural drainage from this area flows across Moores Woods into Pipes Neck Creek and to land that has been bought by the Town for preservation to protect the Pipes Cove area and waterways. Ray will attend hearing to state LPC’s concerns for the environment and Town preserved lands. th Written comments may be forthcoming from LPC before November 30 closing date for receipt of comments once members have had an opportunity to review the DEIS. ?? AGRICULTURAL ADVISORY COMMITTEE MEMO TO TOWN BOARD RE: $4 MILLION FARMLAND BOND REVIEW AND PREPARE COMMENTS HOLD for next meeting ?? The next regular meeting will be held on Tuesday, November 24, 2009, at 7:00 p.m., in the Annex Executive Board Room. Due to Melissa’s scheduling conflict for the prescheduled November 10, 2009, LPC members decided th to cancel the November 10 meeting. Any pressing issues requiring LPC decisions prior to the next th meeting scheduled for November 24 will be discussed via e-mail with LPC members. Adjournment: ??
