THIS IS TO CERTIFY THAT THE FOLLOWING RESOLUTION NO. 2009-905 WAS
ADOPTED AT THE REGULAR MEETING OF THE SOUTHOLD TOWN BOARD ON
NOVEMBER 17, 2009:
RESOLVED that the Town Board of the Town of Southold hereby authorizes and directs
Supervisor Scott A. Russell to execute the Amendment to Contract #T303607 between the
Town of Southold and the NYS Department of Environmental Conservation in connection
with the continuation of work of eradicating 3.6 acres of Phragmites australis from Pipes
Cove, which Amendment extends the completion date from November 22, 2009 to
November 22, 2010, subject to the approval of the Town Attorney.

AMENDMENT NO. 1
THIS AMENDMENT, entered into by and between the STATE OF NEW YORK
DEPARTMENT OF ENVIRONMENTAL CONSERVATION (hereinafter referred to as the
DEPARTMENT), having offices at 625 Broadway, Albany, New York 12233~ and the'TOwn of
Southold (hereinafter referred to as the Contractor), with offices at P.O. Box 1179, Southold,
New York 11971 is hereby attached to and becomes incorporated into the above referenced
contract.
WITNESSETH:
WHEREAS, the parties entered into a prior Contract which was duly assigned Contract Number
T303607 which said Contract the parties now desire to amend for a no cost time extension;
WHEREAS, This amendment will allow the contractor to continue their work of eradicating 3.6
acres ofPhragmites australis fi.om Pipes Cove as reflected in the revised scope of work;
WHEREAS, both parties originally agreed to fund work by the Town of Southold to eradicate
Phragmites australis from Pipes Cove; and
WHEREAS, the Contract Provides for a no cost time extension for the Contract in Article 3.
NOW THEREFORE, the parties hereto agree as follows:
Article 3 is.revised by extending the completion date from November 22, 2009 to
November 22, 2010.
2. The Scope of Work - Schedule 1, is hereby deleted and replaced with a new Scope of
Work, which is attached hereto as Schedule la.
All other terms and conditions of Contract # T303607 , as amended will remain in full force
and effect.

Schedule la: Revised Scope of Work
[The scope of work shall consist of 3 Parts: Introductory information (title, objectives, project
leader, project duration, etc), a narrative work plan and a project schedule. Following is a
sample of the components ora Scope of Work for an lnvasive Species Eradication Grant
Project]:
1. Introduction
Title:
Pipes Cove Phragmites Removal
Objective Of Project:
To eradicate 3.6 acres of Common reed (Phragmites australis) by
cutting and herbicide application. Conduct follow-up monitoring to
assure that the invasive plants do not return.

2. Project Narrative/Description Of Work Plan:
The Town of Southold proposes to remove the invasive plant species Phragmites australis from
3.6 acres of marine wetlands located in the Pipes Cove Watershed. The Phragmites will be
manually cut and wicked over a period of three years. A five year monitoring program will be
established to record the success of the project and identify areas in need of follow up treatment.
The goal of the project is to permanently remove the Phragmites from the affected wetland and
encourage the recolonization of the areas with native plant species.
The Town will contract out to a pesticide applicator with experience in Phragmites eradication
for the spraying and cutting of the plants. The protocol will be recommended as per site specific
conditions.
The project site will be monitored by Town staff. The areas slated for eradication
will be photograPhed before and after each phase of the project. Transects will be
established for monitoring the affect of the project on the plants. The area will be
monitored over several years. Maps and layers within the Town's wetland
inventory will be updated as the project progresses. The Town will monitor and
update the GIS information on the Town's wetland maps. Within the transects and
quadrat areas the plants will be measured and counted. The Site will also be used as
a test site for other possible projects: Other projects may include the use of the site
and the data in education/stewardship projects with area schools and the education
of the public on Phragmites australis and other inVasive species eradication
throughout Southold Town.
Town Department of Public Works staff will assist with mowing, maintenance,
removal of the plants, and replanting.
