Box 1179 Southold, NY 11971 Telephone (631 ) 765-1892 Fax (631 ) 765-6641 Conservation Advisory Council Town of Southold MINUTES Wed., October 14, 2009 4:30 PM Down's Farm Preserve A meeting of the Southold Town Conservation Advisory Council was held Wed., October 14, 2009 at Down's Farm Preserve. Present Were: Absent Was: James Eckert, Chairman Jack McGreevy, Member Peter Young, Member Anne Trimble, Member Doug Hardy, Member Greta Schiller, Member Dave Bergen, Trustee Lauren Standish, Secretary Scott Worth, Student Member CALL TO ORDER Chairman James Eckert called the meeting to order at 4:30 PM. OLD BUSINESS Member Peter Young presented the draft of Review of Mooring Permitting in the Town of Southold and welcomed ideas for revisions, additions, etc. Most of the discussion concentrated on the proposed budget fees. Trustee Dave Bergen suggested revisions that would simplify the revenue/expense sheet and the other members agreed. Peter said he would make the recommended changes and submit the final version to Lauren to forward to the Town Board and the Board of Trustees. Moved by Peter Young, seconded by James Eckert, it was RESOLVED to APPROVE the Review of Mooring Permitting in the Town of Southold with the noted revisions. Vote of Council: Ayes: All Motion Carried NEW BUSINESS Member Jack McGreevy informed the other members that a Comprehensive Planning Meeting was being held at Town Hall on Thurs., October 15, 2009 in the Meeting Hall. He encouraged all CAC members to attend and provide their input. Jack attended the last Trustees meeting held on September 23, 2009 and said that the memo regarding the saltwater fishing licenses was read into the record. There was also a press conference at the Mattituck boat ramp. Trustee Dave Bergen added that an amicus letter from the Town is pending signatures to send to the Court. Jack suggested we have definitive language for the construction of bluff stairs and the following language was voted on: Moved by James Eckert, seconded by Peter Young, it was RESOLVED to APPROVE the following language relating to the construction of bluff stairs: Proposed stairs are properly designed and engineered using best practices and erosion control devices are placed at the footings of the support posts parallel to the bluff face. Vote of Council: Ayes: All Motion Carried Member Doug Hardy submitted a corrected "Bulkhead/Groin Obstacle" with a list of potential wetland violations, replacing the one he submitted last month with the wrong name of the property owner. Trustee Dave Bergen suggested that he submit the potential violations in writing to the Board of Trustees and the Bay Constables. APPROVAL OF MINUTES Moved by Peter Young seconded by Jack McGreevy, to Approve the Minutes of September 16, 2009. DISCUSSION AND RECOMMENDATION OF WETLAND PERMIT & COASTAL EROSION PERMIT APPLICATIONS '- 3 Moved by Greta Schiller, seconded by Jack McGreevy, it was RESOLVED to SUPPORT the Wetland Permit application of MICHAEL KENNA to construct a 3'X 60' fixed catwalk with a 32"X 14' seasonal aluminum ramp onto a 6'X 20' seasonal floating dock secured by two 2-pile dolphins 6" in diameter. Located: 3200 Minnehaha Blvd., Southold. SCTM#87-3-39 Inspected by: Greta Schiller, James Eckert The CAC Supports the application with the Condition the overall length of the proposed dock is shortened in order to maintain the pier line. The CAC observed run-off from the dwelling being directed into the creek and therefore recommends drywells and gutters are installed to contain the roof run-off. Vote of Council: Ayes: All Motion Carried Moved by Peter Young, seconded by James Eckert, it was RESOLVED to SUPPORT the Wetland Permit application of NEW ClNGULAR WIRELESS, PCS, LLC AND METROPCS NEW YORK, LLC to erect a public utility wireless communications stealth monopole, install antennas therein, and install related equipment on ground. Located: Orient by the Sea Marina, 40200 Main Rd., Orient. SCTM#15-9-8.1 Inspected by: Peter Young The CAC Supports the application, however questions the liabilities of hazardous materials or a potential storm surge. Vote of Council: Ayes: All Motion Carried Moved by Doug Hardy, seconded by Jack McGreevy, it was RESOLVED to SUPPORT the Wetland Permit application of JOHN & EMILY BREESE to relocate the existing 8'X 24' floating dock and piles; maintain a 2.5' deep water depth; and replace existing ramp with a 30"X 28' ramp. Located: 3689 Pine Neck Rd., Southold. SCTM#70-6-24 Inspected by: James Eckert, Doug Hardy The CAC Supports the application with the Condition the existing pier line is maintained. Vote of Council: Ayes: All Motion Carried Moved by Jack McGreevy, seconded by Doug Hardy, it was RESOLVED to NOT SUPPORT the Wetland Permit application of THOMAS PULS III & DONNA RICCO for the existing swimming pool located on the west side of the dwelling, conforming to BP#22397 dated 10/19/94; replace the coping around the pool; replace the sandstone around the pool with bluestone; existing wood retaining walls removed and retaining walls pushed landward, flush with pool, and replaced with new cement retaining walls for the reconstructed deck and new steps; replace wood decking with combination of Ipe wood, stone and grass; existing 12.3'X 8.2' shed; replace existing wood gate with retaining wall and gate; expand existing driveway entrance to 15' in width; connect existing gutters and leaders to drywells; and maintain a line of staked hay bales throughout construction. Located: 1350 Eugene's Rd., Cutchogue. SCTM#97-6-1.2 Inspected by: Doug Hardy, Jack McGreevy The CAC does Not Support the application because of the lack of information concerning the drainage for the site, and there should be a 10' non-turf buffer in front of the dock. Vote of Council: Ayes: All Motion Carried Moved by Jack McGreevy, seconded by Doug Hardy, it was RESOLVED to SUPPORT the Wetland Permit application of SYLVIA SAFER to demolish the existing dwelling and garage; construct a new dwelling and garage; stone terrace on grade; and install a new sanitary system. Located: 5600 Indian Neck Lane, Peconic. SCTM#98-5-13 Inspected by: Jack McGreevy, Doug Hardy The CAC Supports the application with the Condition hay bales are installed prior to any construction activities, there are plans to secure the bluff, the run-off from the southeast corner of the new patio is contained, and an effort is made to save trees above an 8" DBH. Vote of Council: Ayes: All Motion Carried Moved by Peter Young, seconded by James Eckert, it was RESOLVED to SUPPORT the Wetland Permit application of XENIUS C. GEORGIOU to construct a single-family dwelling with patio, garage, crushed stone driveway, retaining walls, and sanitary system. Located: 585 Homestead Way, Greenport. SCTM#40-2-18 Inspected by: Peter Young, James Eckert Vote of Council: Ayes: All Motion Carried Moved by Peter Young, seconded by James Eckert, it was RESOLVED to NOT SUPPORT the Wetland Permit and Coastal Erosion Permit applications of MARLO ABBATE & JOSEPHINE PADOVAN to restore the sand excavated from the bluff and to restore the bank along the edge to the original configuration/breadth. Located: 22615 Soundview Ave., Southold. SCTM#135-1-23,24.1 &25.1 Inspected by: Peter Young, James Ecked The CAC does Not Support the applications because of insufficient information and detailed restoration plans should be submitted. Vote of Council: Ayes: All Motion Carried Member Jack McGreevy will attend the next regular meeting of the Board of Trustees scheduled for Wed., October 21,2009. The next meeting of the Conservation Advisory Council has been set for Thurs., November 12, 2009 at 4:30 PM at Down's Farm Preserve.
