WITNESSETH, that the party of the first part, in consideration of Ten Dollars and other valuable
consideration paid by the party of the sec6nd part, does hereby grant and release unto the party of
the second part, the heirs oi' successors and assigns of the second part forever,
ALL that certain plot, piece or parcel of ladd, with the buildings and improvements thereon
erected, situate, lying and being in the Village of East Marion, Town of Southold, County of
Suffolk and State of New York, and bounded and described as follows:
BEGINNING at a stone monument being on the southerly side of the Main Road ( NYS rt. 25) at
the intersection of the easterly line of land now or formerly of Maiorana and the southerly side of
said Main Road (NYS Rt. 25);
RUNNING THENCE South 35 degrees zi9 minutes 50 seconds East 95.96 feet; '
THENCE South 38 degrees 44 minutes 00 seconds East 106.60 feet to land now or f6rmerly'of
Diaz;
RUNNING THENCE along the land now or formerly of Diaz South 54 degrees 39 minutes 00
seconds West 103.35 feet to land now or formerly of Xefos;
RUNNING THENCE along the land now or formerly of Xefos North 35 degrees 21 minutes 00
seconds West 235.00 feet to the southerly side of Main Road (NYS Rt. 25);
RUNNING THENCE along the southerly line of Main Road (NYS Rt. 25) North 73 degrees 22
minutes 30 seconds East 101.43 feet to the point or place of BEGINNING.
BEING AND INTENDED TO BE the same premises conveyed to the party of the first part by
deed dated March 4, 2003 and recorded July 30, 2004, in the Office of the County Clerk of the
County of Suffolk in Liber 12334, Page 235.
TOGETHER with all the fight, title and interest, if any, of the party of the first part in and to any
streets and roads abutting the above described premises to the center lines thereof; TOGETHER
with the appurtenances and all the estate and fights of the party of the first part and to said
premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second
part, the heirs or successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered
anything whereby the said premises have been encumbered in any way whatever, except as
aforesaid.
AND the party of the first part in compliance with Section 13 of the Lien Law, covenants that the
party of the first part will receive the consideration for this conveyance and will hold the fight to
receive such consideration as a trust fund to be applied first for the purpose of paying the cost of
the improvement and will apply the same first to the payment of the cost of the improvement
before using any part of the total of the same for any other pUrPose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so
requires.
IN WITNESS WHEREOF, the party of the first part has duly executed this deed the day and year
first above written.
