WITNESSETH, that the party of the first pan, in consideration of TEN DOLLARS ($10.00),
lawful money of the United States, paid by the party of the second pan, does hereby grant and
release unto the party of the second pan, the heirs or successors and assigns of the party of the
second pan forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon
erected, situate, lying and being at Bay View, near Southold, in the Town of Southold, County of
Suffolk and State of New York, being known and designated as Lots No. 8, 9, 10, I 1 and 12 on a
certain map entitled, "Map of Goose Neck, situate at Bayview, Town of Southold, Suffolk
County, NY, owned by GW Smith & Sons" made by Otto W. Van Tuyl, Licensed Surveyor,
Greenpon, NY and filed in the Suffolk County Clerk's Office on November 22, 1948 as and by
File No. 1663 being more particularly bounded and described as follows;
BEGINNING at a point on the northerly side of Smith Drive North distant noah 39 degrees
00 minutes 00 seconds East 350 feet from the comer formed by the intersection of the northerly
side Smith Drive North with the easterly side of Main Bayview Road;
RUNNING THENCE from the point of beginning north 51 degrees 00 minutes 00 seconds
west 143.17 feet;
RUNNING THENCE north 41 degrees 14 minutes 40 seconds east 155.66 feet;
RUNNING THENCE north 41 degrees 01 minutes 00 seconds east 94.52 feet'
RUNNING THENCE south 51 degrees 00 minutes 00 second~ east 133.74 feet to the
northerly side of Smith Drive North;
RUNNING THENCE along the northerly side of Smith Drive North south 39 degrees 00
minutes 00 seconds west 250 feet to the point or place of BEGINNING.
BEING AND INTENDED TO BE the same premises conveyed to the party of the first part
by deed dated 2/24/00 and recorded on 11/13/00 in Liber 12083, page 830.
TOGETHER with all right, title and interest, if any, of the party of the first pan in and to any
streets and roads abutting the above described premises to the center lines thereof,
TOGETHER with the appurtenances and all the estate and rights of the party of the first pan
in and to said premises,
TOHAVEAND TOHOLD the premises herein granted unto the party of the second part, the
heirs or successors and assigns of the party of the second pan forever.
AND the party of the first pan, covenants that the party of the first pan has not done or
suffered anything whereby the said premises have been encumbered in any way whatever, except
as aforesaid.
AND the party of the first pan, in compliance with Section 13 of the Lien Law, covenants
that the party of the first pan will receive the consideration for this conveyance and will hold the
right to receive such consideration as a trust fund to be applied first for the purpose of paying the
cost of the improvement and will:apply the same first to the payment of the cost of the
improvement before using any part of the total of the same for any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so
requires.
