surviving joint tenant, GRACE R. LEWIS deceased of Suffolk County, New York on the 7~h day of November,
1997
party of the first part, and JOHN J. NICKLES, JR., residing at 24 William Street, Worcester, MA 01609
party of the second part,
WlTNESSETH, that the party of the first part, in consideration of ten ($10.00).~p,.~~able
consideration paid by the party of the second part, does hereby grant and rel~:~"~~ second
part, the heirs or successors and assigns of the party of the second part
ALL that certain plot, piece or parcel of land, situate, lying and being in the Town of Southold, County of Suffolk
and State of New York, shown and designated on a certain map entitled, "Map of Beixedon Estates, Town of
Southold, Suffolk County, N.Y., Property of Grace R. Lewis, formerly Grace Rogers DeBeixedon", made by
Otto W. VanTuyL Licensed Surveyor, and filed in the Suffolk County Clerk's Office on March 16, 1946, as Map
Not. 1472, as and by lot numbered 5 in Block Number 2 on said map.
TOGETHER with all of the right, title, and interest of the party of the first part, in, and to the land lying in the bed
of any street, road, or avenue in front of or adjoining said premises to the center line thereof.
TOGETHER with the right to pass and repass over the roads, streets and avenues as shown on said map, and
the right, in common with other owners of the lots shown on said map, to use the beaches designated on said
map as Pict A and Pict B respectively, solely for recreation and not for commercial purposes.
SUBJECT to: (1) any state of facts an accurate survey would show; (2) such state or municipal zoning,
planning and building ordinances and regulations as may be effective; (3) rights of the owners of all other lots
shown on said map, to pass and repass over any land lying in the bed of any street, road or avenue in front of
or adjoining the premises hereby conveyed, and to the rights of public utilities to lay and maintain pipes,
conduits, poles, wires, etc., in, over and across said streets, roads, or avenues as more particularly granted
and set forth in recorded easement agreements with New York Telephone Company, Long Island Lighting
Company, and North Fork Water Company, Inc., its successors or assigns, or any of them; (4) easements to
New York Telephone Company, Long Island Lighting Company, and North Fork Water Company, Inc., its
successors or assigns, or any of them, to install, lay and maintain pipes, conduits, wires, poles, etc., along and
adjacent to the rear boundary line of said boundary lines of said premises, as more particularly granted and set
forth in easement agreements of record.
THIS DEED is a correction deed given by the party of the fimt part to the party of the second part for the
purpose of correcting the Lot Number of the filed map, and the Suffolk County Tax Map Number as set
forth in deed dated September 25, 2009, and recorded with the Suffolk County Clerk's Office on September
25, 2009 in Liber 12601 at Page 219.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads
abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances and all
the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the
premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of
the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the
first part will receive the consideration for this conveyance and will hold the right to receive such consideration
as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same
first to the payment of the cost of the improvement before using any part of the total of the same for any other
purpose. The word "party" shall be construed as if it read "parties" when ever the sense of this indenture so
requires.
