THIS INDENTURE, made the /3 day of October, 2009
BETWEEN
LYNNE WEN'nNORTH, as Executrix under the Last Will and Testament of Mildred Boyce who
died a resident of Suffolk County, New York on March 2, 2009 (File No. 629P2009 P 67161),
residing at 1135 Oaklawn Avenue, Southold, New York 11971, party of the first part, and
LYNNE WENTVVORTH, as Executrix under the Last Will and Testament of Mildred Boyce who
died a resident of Suffolk County, New York on March 2, 2009 (File No. 629P2009 P 67161),
residing at 1135 Oaklawn Avenue, Southold, New York 11971, party of the second part, and
WITNESSETH, that the party of the first part, in consideration of Ten and 00/100-($10.00)-Dollars, and other
good and valuable consideration paid by the party of the second pad, does hereby grant and release unto the
party of the second part, the heirs or successors and assigns of the party of the second part forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate
lying and being in the Town of Southold, County of Suffolk, State of New York, known and designated as Lot
Numbers 8 and 9 on a certain map entitled, "Map of Northwood Estates at Southold" made by Van Tuyl &
Son, Licensed Land Surveyors, and filed in the Suffolk County Clerk's Office on February 7, 1972 as Map No.
5675.
SUBJECT TO a 25 foot right-of-way along the easterly line of Lot 8 for the benefit of SCTH#1000-54-3-5.
BEING AND INTENDED TO BE the same premises conveyed to Mildred Boyce by deed dated August 23,
1984, recorded December 28, 1984 in Liber 9703 page 490.
THIS DEED is made to merge Lots 8 and 9 into one single parcel.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads
abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances and all
the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the
' premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of
the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the
first part will receive the consideration for this conveyance and will hold the right to receive such consideration
as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same
first to the payment of the cost of the improvement before using any part of the total of the same for any other
purpose. The word "party" shall be construed as if it read "parties" when ever the sense of this indenture so
requires.
