the second part, the heirs or successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the
first part will receive the consideration for this conveyance and will hold the right to receive such consideration
as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same
first to the payment of the cost of the improvement before using any part of the total of the same for any other
purpose. The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so
requires.

ALL that certain plot, piece or parcel of land, situate, lying and being in the Incorporated Village of
Greenport, Town of Southold, County of Suffolk and State of New York, known and designated as Lots 48
and 49 and parts of Lots 31, 32, 33 and 50 on a certain map entitled, "Map of Sterling Manor" filed
,6/18/1873 in the Office of the Clerk of the County of Suffolk, as Map No. 53, which parts of lots, when taken
together, are more particularly bounded and described as follows:
BEGINNING at a point on the northerly side/line of Monsell Place distant 165.00 feet westerly from the
comer formed by the intersection of the westerly side/line of Atlantic Avenue with the northerly side/line of
Monsell Place;
RUNNING THENCE from said point of beginning along the northerly side/line of Monsell Place, South 72
degrees 26 minutes 20 seconds West, 91.48 feet to a point;
THENCE along the division line between Lot 48 and part of Lot 31 and Lot 47 and part of Lot 30 North 17
degrees 32 minutes 50 seconds West, 117.43 feet to a point;
