Occhiogrosso, residing at 1580 Corey Creek Lane, Southold, NY 11971, as to an undivided 1/7th interest party of the second part, WITNESSETH, that the party of the first part, in consideration of TEN dollars and other good and valuable consideration paid by the party of the second part, does hereby grant and release unto the party of the second ~art, the heirs or successors and assigns of the party of the second part forever, ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate, lying and being in the Town of Southold, County of Suffolk and State of New York, known and designated as Lot 28 on a certain map entitled, "Map of Corey Creek Estates at Bayview," and filed in the Suffolk County Clerk's Office on August 15, 1967 as Map No. 4923. The Grantor, herein reserves a life estate for Victor Occhiogrosso for his exclusive life use and occupancy. Victor Occhiogrosso shall be responsible for all maintenance and repairs. Water and sewer charges, insurance charges, and taxes relating to the premises. Said life use shall be personal to Victor Occhiogrosso and shal! not be subject to assignment or lease, except as otherwise provided in this paragraph. Victor Occhiogrosso reserves the power to appoint the remainder and/or his life uses in the premises to any one or more of the issue of the Grantor, siblings of the Grantor, or issue of the Grantor's siblings, or the spouses or surviving spouses of any of the foregoing persons, with the term "issue" being deemed to include persons who have been adopted according to law but not born out of wedlock. This power shall be exercisable or may be relinquished during the life time of Victor Occhiogrosso by a deed to the grantee listed herein and/or grantee~ listed on deed dated, 10/21/1999, recorded 11/4/1999, in Liber 11998 pg 803 or to others who are members of the class of appointees set forth herein, making express reference to this power and executed and recorded in the County Clerk's Office where this deed is recorded, prior to the death of Victor Occhiogrosso. No exercise. of this power shall be deemed to release Victor Occhiogrosso's life estate unless such a release is explicitly made in a deed. The exercise of this power shall not exhaust it and unless the power is specifically released in such a deed, the deed recorded last shall control as to any ambiguities or inconsistencies. Said premises known as 1580 Corey Creek Lane, Southold, NY 11971 Being and intended to be the same premises as conveyed to the party of the first part by deed, dated 10/21/1999, recorded 11/4/1999 in Liber 11998 pg 803 in the Suffolk County Clerk's Office. TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads abutting the above described premis, es to the center lines thereof; TOGETHER with the appurtenances and all the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of the second part forever. AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby the said premises have been encumbered in any way whatever, except as aforesaid. AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first part will receive the consideration for this conveyance and will hold the right to receive such consideration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the payment of the cost of the improvement before using any part of the total of the same for any other purpose.
