SUBJECT TO a 20 foot right of way over the southerly side of
the premises for the exclusive benefit of Lot No. 3 shown on
minor subdivision map made for Robin A. Raeburn and Mary
Elizabeth Murphy by Roderick Van Tuyl P.C. and dated February 5,
1979 a distance of 97.70 feet to the southerly boundary of said
right of way being described as follows:
BEGINNING at a point where the easterly side of the subject
premises intersects the first described 20 foot right of way;
RUNNING THENCE South 70 degrees 16 minutes 10 seconds West
97.70 feet.
BEING AND INTENDED to be the same premises conveyed to the
grantor herein by Deed dated December 26, 1987 and recorded in
the Suffolk County Clerk's Office on January 11, 1988 in Liber
10510 page 206.
This conveyance is subject to and assuming a mortgage made
by John R. Dempsey and Rudolph H. Bruer to The North Fork Bank &
Trust Company dated December 30, 1987, in the principal sum of
$175,000.00 and recorded in the Suffolk County Clerk's Office in
Liber 13711, page 87, on January 11, 1988, on which mortgage
there is now due and owing the sum of $175,000.00 and interest,
which the party of the second part, or grantee, agrees to assume
and pay.
