a. This application MUST be completely filled in by typewriter or ih ;mk and subrrdtted to the Building Inspector with 3
sets of plans, accurate plot plan to scale. Fee according to schedule.
b. Plot plan showing location of lot and of buildings on prmnises, relationship to adjoining premises or public streets or
areas, and waterways.
c. The work covered by this application may not be commenced before issuance of Building Permit.
d. Upon approval of this application, the Building Ingpector will issue a Building Permit to the applicant. Such a permit
shall be kept on the premises available for inspection throughout the work.
e. No building shall be occupied or used in whole or in part for any purpose what so ever until the Building Inspector
issues a Certificate of Occupancy.
f. Every building permit shall expire if the work authorized has not commenced within 12 months after the date of
issuance or has not been completed within 18 months from such date. If no zoning amendments or other regulations affecting the
property have been enacted in the interim, the Building Inspector may authorize, in writing, the extension of the permit for an
addition six months. Thereafter, a new permit shall be required.

Dear Lucille Seitz:
It has come to our attention that you constructed a shed within 100 feet of NYS regulated
freshwater wetland # SO-5. Our records indicate that these structures were built without the
benefit of a Freshwater Wetlands permit from this agency as required by 6NYCRR Part 663
(Freshwater Wetlands Regulations). Therefore, these structures were built in violation of Article
24 (Freshwater Wetlands Act) of the Environmental Conservation Law (ECL).
At this time the Bureau of Habitat will not pursue this violation. However, be advised that ~ahy
future regulated activities conducted on this site without the benefit of a NYSDEC permit Wil/be
treated as serious violations punishable by fines and/or removal of structures and/or restoration
of the area. Regulated activities include but are not limited to: construction of buildings, roads,
driveways, parking areas and other structures; filling and excavating; clearing of vegetation;
grading or ground disturbance.

The Board of Town Trustees took the following action during its regular meeting held on
Wednesday, May 18, 2005 regarding the above matter:
WHEREAS, Mark Schwartz, AIA- Amhitect on behalf of LUCILLE SEITZ applied to the
Southold Town Trustees for a permit under the previsions of Chapter 97 of the Southold
Town Code, the Wetland Ordinance of the Town of $outhold, application dated April 8,
2005, and
WHEREAS, said application was referred to the Southold Town Conservation Advisory
Council for their findings and recommendations, and,
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said
application on May 18, 2005 at which time all interested persons were given an
opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the
premises in question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
· WHEREAS, the structure complies with the standards set forth in Chapter 97 of the

1. The application and supporting documentation submitted show the shed to be an existing
structure built without benefit of a Freshwater Wetlands (Article 24) permit. The Department of
Environmental Conservation does not issue after-the-fact permits for existing structures.
Therefore, we will no longer consider this a portion of the project. Should you have any
questions about the shed or the waming letter you received from the Bureau of Habitat, please

2. Project plans must clearly illustrate all existing and proposed conditions and structures at the
site. Therefore, you must show the existing shed on the plans.
3. Department staffwill delineate/confirm the fi'eshwater wetland boundary in the field. You
will be advised when the delineation/confirmation has been completed. Once the line is
determined, you must revise the project plans showing this boundary line and all proposed work.
The project plans must also show a line which is labeled word for word "Limits of Clearing,
Grading and Ground Disturbance".
This application will remain incomplete until the above items/information are submitted and/or
addressed and you have submitted 5 copies of revised plans. Do not heditate to call me at
