GALLAGHER, APPLICANTS PROPERTY LOCATION: 2950 Vanston Road, Cutchogue CTM 111-5-7.2 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without further steps under SEQRA. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application has been referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning reply dated June 24, 2008 states that the application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. PROPERTY FACTS/DESCRIPTION: The subject property is a non-conforming 29,852 square foot parcel in the Residential R-40 District, measuring 71.94 feet and 194.50 feet along Old Cove Road to the north, 153.0 feet to the east, 318 feet to the south, and 66.19 feet on Cutchogue Harbor to the west. The property is improved with a single-family, two-story dwelling and a single-stow accessory unheated cottage with an adjoining garage, as shown on the survey by Roderick Van Tuyl, P. C., dated September 7, 1994. BASIS OF APPLICATION: Request for Variances under Section 280-121 A, based on the Building Inspector's April 9, 2008 Notice of Disapproval concerning a proposed addition to the existing garage which is attached to a nonconforming cottage, accessory to a primary dwelling. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on August 21, 2008, at which time written and oral evidence were presented. Based upon all Page 2 - September 4, 2008 ZBA # 6181 - R. and M. Gallagher CTM 1000-111~5-7.2 testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: RELIEF REQUESTED: The applicants seek a variance for a two-car garage addition, ~pl~ac~ of the existing one-car garage. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted, and personal inspections, the Board makes the following findings: 1. Town Law §267-b(3)(b)(3)(1). Grant of a variance for the addition to convert an existing one-car garage attached to a preexisting accessory cottage to a two-car garage will not have an adverse effect on the character of the neighborhood or be a detriment to nearby properties. The house is at the end of a long private road. There are no other houses within 100 feet. 2. Town Law §267-b(3)(b)(2). The benefit of adding garage space for a second car cannot be achieved without a variance, given the nonconforming nature of the building that houses the garage. 3. Town Law §267-b(3)(b)(3). The variance sought for a larger garage is not substantial. The garage addition will amount to 500 square feet and will occupy a portion of the driveway adjacent to the existing one-car garage. 4. Town Law §267'b(3)(b)(5). The difficulty was created when the cottage and garage was built prior to the existence of zoning requirements. The Building Department issued a pre-existing certificate of occupancy for the cottage with garage on May 29, 2008. 5. Town Law §267'b(3)(b)(4). No evidence has been submitted to suggest that grant of this relief will have an adverse impact on physical or environmental conditions in the neighborhood. 6. Town Law §267-b. Grant of the variance is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a two-car garage addition, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. Gallagher CTM 1000-111-5-7.2 RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Simon, seconded by Member Weisman, and duly carried, to GRANT the variance as applied for, as shown on the May 19, 2008 Diagrams A- 1, A-2 and A'3 prepared by Mark K. Schwartz, Architect, subject to the following CONDITION: That no heat or air-conditioning shall be permitted in the accessory cottage. Any deviation from the variance given such as extensions, or demolitions which are not shown on the applicant's diagrams or survey site maps, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. The Board reserves the right to substitute a similar design that is de minimus in nature for an alteration that does not increase the degree of nonconformity. RIDGE-TO-RAFTER ASSEMBLY: 1-1/4" x 20 gauge strap shall be attached to each pair of rafters in accordance to table 3.4. When a collar tie is used in leu of a ridge strap, the number of 10d common nails required in each end of the collar tie need not exceed the tabulated number of 8d nails in the strap. 2). RAFTER-TO-WALL ASSEMBLY: Lateral framing and shear wall connections for rafter, ceiling or truss to top plate shall be in accordance to table 3.3. When a rafter or truss do not fall in line with studs below, rafters or trusses shall be attached to the wall top plate and the wall top plate shall be attached to the to the wall stud with uplift connections. Roofs overhanging the rake side of the building shall be connected with uplift connections in accordance with table 3.3c. 3). WALL-TO-WALL ASSEMBLY: Wall studs above and studs below a floor level shall be attached with uplift connections in accordance with table 3.3b. When walt studs above do not fall in line with studs below, the studs shall be attached to a common member in the floor assembly with uplift connectors Jn accordance with table 3.3. 4). WALL ASSEMBLY TO FOUNDATION: First wail studs shall be connected to the foundation, sill plate, or bottom plate with uplift connectors. Steel straps shall have a minimum embedment of 7 inches in concrete foundation and slab-on-grade, 15 inches in masonry block foundations, or lapped under the plate and nailed in accordance with table 3.3b. When steel straps are lapped under the bottom plate, 3 inch square washes shall be used with the anchor bolts. Anchor bolt spacing is to be spaced and sized in accordance to table 3.2a. In addition to spacing, anchor bolts are to be spaced between 6-12 inches from the end of a sill plate and all corners. 5). TYPE I EXTERIOR SHEARWALL CONNECTIONS: Type I exterior shear walls with a minimum of 7/16 inch wood structural panel on the exterior attached with 8d common nails at 6" c.c. atthe panel edges and 12" c.c. in the field, and 1/2 inch gypsum wallboard on the interior attached with 5d cooler nails at 7" c.c. at panel edges and 10" c.c. in the field shall be in accordance with the length requirements specified in table 3.t 5a-b. 6). TYPE II EXTERIOR SHEARWALL CONNECTIONS: Type II exterior shearwalls shall meet the requirements of table 3.15a-b times the appropriate length adjustment factors in table 3.f 6. 7). INTERIOR SHEARWALL CONNECTIONS: Allowable sidewall lengths provided in table 3. t4 shall be permitted to be increased when interior shearwalls are used. CATHEDRAL CEILING ASSEMBLY: Where a ridge is to be used as a structural beam, the rafters shall either be notched and anchored on top of the beam or slope connectors shall be attached to each rafter-to-ridge along the open ceiling part of the building. Unless otherwise noted, all framing material to be #1 ACQ pressure treated lumber.
