MINUTES
SOUTHOLD TOWN BOARD OF APPEALS
July 3, 1973
A special meeting of the Southold Town Board of Appeals
was held at 7:30 P.M., Tuesday, July 3, 1973, at the Town
Office, Main Road, Southold, New York.
There were present: Messrs: Robert W. Gillispie, jr.,
Chairman; Robert Bergen; Fred Hulse, Jr.
The Chairman read letter dated June 22, 1973 received
from David H. Verplank, Esq., counsel for St. John's
Lutheran Church, Hicksville Road and Gail Drive, North
Massapequa, New York, which was in response to a letter sent
to Mr. Verplank by the Chairman of the Southold Town Board
of Appeals dated June 4, 1973, requesting clarification
of uses and purposes with respect to Appeal No. 1771 for
a special exception to the Zoning Ordinance.
A public hearing was held on Appeal No. 1771 on May
24, 1973.
After public hearing, correspondence, and intensive
investigation the Board finds that the applicant, St.. John's
Lutheran Church, Hicksville Road and Gail Drive, North
Massapequa, New York, has applied for permission to use
premises situated on the north side of Sound View Avenue, on
Great Pond, Southold, New'York, for church related activities
of the applicant, a religious institution, which is a
permitted use by special exception in "A" Residential zone.
The proposed uses may be described as being ancillary or
auxiliary to St. John's Lutheran Church, North Massapequay

New York, and would not constitute a church, a.worship
community, or a mission church (defined as being "a church
that has not petitioned the State of New York for incorporation
to become an independent incorporated body,'). The proposed
uses would include "outreach" and evangelical ~ctivities
as defined and strictly limited on Page 3 of Mr. David H.
Verplank's letter of June 22, 1973; would not include
proselytizing (defined by Webster as "converting,'). The
uses would be continuous in the summer and weekends in the
winter. The premises are described as being 2.1+ acres with
approximately 310.78' on Sound View Avenue and 298.42! on
Great Pond, with a substantial structure used variously
in the past as a restaurant, a labor camp, for church
picnics, and a residence.
On motion by Mr. Gillispie, seconded by Mr. Bergen, it was
RESOLVED, St. John's Lutheran Church, Hicksville Road
and Gail Drive, North Massapequa, New York, be GRANTED
permission to use premises situated on the north side of
Sound View Avenue, on Great Pond, Southold, New York, for
church related activities, subject to the following limitations
and conditions, and subject to site plan approval of the
Southold Town Planning Board:
1. The property may be used by St. John's Lutheran
Church, North Massapequa, New York, for their own church
related activities (such as bible study meetings, Sunday
School Teachers' meetings, Church Council meetings). It
may also be used, by arrangement with the applicant, by
local congregations for similar purposes.
2. The property may be used by the Director of the
facility and his wife. The Director will have primary
responsibility for all activities conducted on the premises.
3. The property may be used as a retreat center for
members of St. John's Lutheran Church for planned meetings
or conferences, usually lasting as long as two nights and
three days; attendees to provide their own food preparation
and service; sleeping arrangements provided by the two
remaining second floor bedrooms and one room on the first
floor intended for use as a small dormitory. The phrase
"retreat", as used herein, refers to a place of withdrawal
for religious instruction. Teenage St. John's Church groups
using the facility for overnight visits must be supervised
by at least two adults in addition to the Director and his
wife.

4. Foster care on the premises (as permitted by the
courts) by the Director and his wife of not more than two
children under six years of age, for a period of not over
30 days each, appears to be a permitted use of residential
property. However, it is listed here in the interest of
clarity.
5. As stated above, the foregoing permitted uses are
not to be construed as permitting the establishment of a
church, a worship community, or a mission churchl However,
St. John's Lutheran Church groups would, of course, set times
for their own church services.
6. Uses proposed, and interior changes, shall conform
to the Southold Town Building Code, New York State Multiple
Residence Law, and Suffolk County Board of Health requirements.
7. Parking surfaces, subject to approval of Building
Inspector, shall be furnished for at least 30 vehicles
according to the requirements of the Zoning Ordinance.
8. The total of all persons staying overnight on the
premises shall in no case exceed 25 persons.
9. Questions of interpretation of permitted uses shall
be referred to the Board of Appeals for determination.
10. The Board of Appeals may review this application
and the operation of the project as it affects the community
at any time but, in any case, before August 1975.

The SQuthold Town Board of Appeals reviewed the application
for a special exception (Appeal No. 1799), George Ahlers and
Barry Hellman, Cutchogue and Southold, respectively; the
minutes of public hearing held on June 28, 1973; and all
pertinent correspondence. Neither George Ahlers, Barry Hellman,
or their counsel,?~as present for the meeting.

On motion by Mr. Gillispie, seconded by Mr. Bergen, it was
RESOLVED to postpone decision on Appeal No. 1799, George AhlerS
and Barry Hellman~ Cutchogue and Southold, New York, respectively,
because of complications surrounding the installation of a sewage
treatment plant.
Vote of the Board: Ayes:- Messrs: Gillispie, Bergen, Hulse.
The Meeting was adjourned at 8:40 P.M.
