Requests for Variances under Sections 280-4(B), 280-18, and 280-116A(1), based on the Building Inspector's revised April 8, 2009 Notice of Disapproval concerning a proposed swimming pool, deck, and raised patio construction, which new construction areas will be: (a) less than 100 feet from the top of the L.I. Sound bluff or bank, and (b) greater than the code-limitation of 20% lot coverage on this +/- 29,406square feet of buildable land, located at 2670 Grandview Drive, Orient; CTM 1000-14-2-3.6. The applicants also request a Variance concerning an application for a drainage control Page 2 – Agenda – Special Meeting Southold Town Zoning Board of Appeals November 12, 2009 Special Meeting permit based on the Building Inspector's June 3, 2009 Notice of Disapproval under Section 236 (13), for the reason that the site plan shows a land area having a slope greater than 20% for the construction of the proposed meeting house building, and #6245. The applicants request the following, based on the Building Inspector's amended October 20, 2008 Notice of Disapproval: (a) Variance under Zoning Code Section 280-36 based on an application for a building permit to construct a new building which will exceed the code limitation of 2½ stories; (b) Special Exception under Zoning Code Section 280-35B to construct and establish use as a conference facility for member private training and education classes; and (c) Special Exception under Zoning Code Section 280-35B concerning as-built Motel units in former accessory poolhouse building. 10/29 PH: KEVIN and BETTY ANN MORRIS #6328. Request for a Variance under Section 280-122A and ZBA Zoning Interpretation # 5039, based on the Building Inspector's July 9, 2009 Notice of Disapproval concerning an application for a building permit to construct renovations and additions to the existing dwelling, for the reasons that the new construction will create a new nonconformance with regarding to a single side yard at less than 15 feet, and total side yards at less than 35 feet. (Note: This lot appears to be between 20,000 and 30,000 square feet after deleting the land below the bluff or bank of Little Peconic Bay.) Request for Variances under Section 280-124 based on the Building Inspector's revised July 16, 2009 Notice of Disapproval concerning a new pergola and new patio (after removal of deck) with a setback at less than 10 feet on a single side yard, less than 25 feet on total side yards, and exceeding the code limitation of 20% lot coverage on this 6,045 square feet lot (measured from the Coastal Erosion Line), at 1400 Sound Beach Drive, Mattituck adjacent to Long Island Sound; CTM 1000-106-1-35.1. 10/29 PH – Sanitary letter was received 11/12: LORRAINE PARRA # 6324. Requests for Variances under Section 280-124 based on the Building Inspector's July 8, 2009 Notice of Disapproval which states that the new addition/alteration (to the existing single family dwelling) will be less than the code-required minimum of 35 feet and will exceed the maximum lot coverage of 20%, after creating new habitable floor space on this +/- 2,475 square foot lot, at 970 Seventh Street, Greenport; CTM 1000-48-2-19. 10/29 PH: JON and JENNIFER SHIPMAN #6327. Request for a Variance under Section 280-124 based on the Building Inspector's June 17, 2009 Notice of Disapproval concerning an addition to the existing single-family dwelling with a front yard setback at less than the code-required 50 feet, at 4745 Elijahs Lane, Mattituck; CTM 1000-100-4-11. Requests for Variances under Sections 280-116-B and 280-124, based on the Building Inspector's August 17, 2009 Notice of Disapproval concerning an application for demolition and a building permit for a new single- family dwelling, which new construction will be: 1) less than the code-required minimum of 75 feet from the bulkhead, 2) less than 35 feet from the front lot line, 3) less than 35 feet from the rear lot line, 4) less than 25 feet for both (combined) minimum side yard setbacks, 5) exceeds the code limitation of 20% maximum lot coverage (building area), 6) access to the property is not in accordance with New York Town Law, Section 280-a, and Town Code Section 280-109-A. 10/29 PH, pending information concerning grant application information. BARBARA SHINN # 6308. Request for Variances from Town Code Chapter 277, Section 277-3B(1), based on the Building Inspector’s April 8, 2009 Notice of Disapproval stating that the proposed wind turbine is not meeting the code requirement for a minimum distance from a property line, total height of the small wind energy system plus 10 feet, except that it shall be set back at least 300 feet from a property line bordering an existing residential structure. The proposed location is shown 136.5 feet measured easterly to other land identified as CTM 1000-100-4-4; zero feet from the applicant’s agricultural land along the west, and +/- 18 feet from the applicant’s agricultural land south of the wind turbine. The applicant’s properties are shown with an area of 1.2 acres, or 22.49 acres with both the applicant’s single-family dwelling and agricultural lands.
