Dear Mr. Cuddy:
The Southold Town Planning Board, at a meeting held on Monday, November 9, 2009,
adopted the following resolution:
WHEREAS, this lot line change will reduce Parcel 1 (SCTM#1000-33-2-10) by 2,430 sq.
ft. in order to create as far a setback as possible for the proposed dwelling from the
wetlands. After the lot line modification, Parcel 1 will decrease in size from 21,458 sq. ft.
to 19,028 sq. ft. Parcel 2 (SCTM~1000-33-2-11) will increase in size after the lot line
modification from 24,756 sq. ft. to 27,186 sq. ft. These parcels are located in the R-40
Zone; and
WHEREAS, on August 7, 2008, the Southold Town Zoning Board of Appeals granted
the area variance requested for the above-referenced project; and
WHEREAS, on October 13, 2009, the Southold Town Planning Board granted a retro-
active 90 day extension of Conditional Final Approval on the surveys prepared by John
T. Metzger, Land Surveyor, dated November 21, 2006, from September 9, 2009 to
December 9, 2009 subject to the following condition:
1. The filing of new deeds with the Office of the Suffolk County Clerk pertaining to
the lot line change and, upon filing, submission of a copy to this office; and
WHEREAS, on October 5, 2009, the applicant submitted certified copies of the deeds
reflecting the new lots created through this lot line modification recorded with the Suffolk
County Clerk on September 24, 2009, at Liber D00012601, Page 069 (SCTM#1000-33-

21-11 ) and Liber D00012601, Page 068 (SCTM#1000-33-2-10) in satisfaction of the
above-referenced condition; be it therefore
RESOLVED, that the Southold Town Planning Board hereby grants Final Approval on
the survey, prepared by John T. Metzger, Land Surveyor, dated November 21, 2006.
Enclosed please find a copy of the map which has been endorsed by the Chairman.

the lot line change and, upon filing, submission of a copy to this office; and
WHEREAS, on September 8, 2009, the applicant requested that Conditional Final
Approval be extended for 90 days from the date of approval to meet the above-listed
condition; and
WHEREAS, on September 14, 2009, the Southold Town Planning Board reviewed the
request and agreed to grant the extension requested; and

RESOLVED, that the Southold Town Planning Board hereby grants a retroactive 90

December 9, 2009.
The above-referenced condition must be met within 90 days of this resolution unless
another extension of time is requested by the applicant and granted by the Planning
Board. Upon fulfillment of the condition, the Planning Board will issue Final Approval
and authorize the Chairman to endorse the final surveys.

Dear Mr. Cuddy:
The Southold Town Planning Board, at a meeting held on Monday, March 9, 2009,
adopted the following resolutions:
WHEREAS, this lot line change will transfer 2,430 s.f. from Parcel 1 (SCTM#1000-33-2-
10), reducing it from 21,458 s.f. to 19,028 s.f., to Parcel 2 (SCTM#1000-33-2-11),
increasing it from 24,756 s.f. to 27,186 s.f. Both parcels are in the R-40 Zoning District;
and
WHEREAS, The Town of Southold Zoning Board of Appeals granted an area variance
necessary for this lot line change on August 7, 2008, one goal of which was to create a
greater separation distance between the future building envelope and the nearby
wetlands; and
WHEREAS, on February 9, 2009, The Southold Town Planning Board, acting under the
State Environmental Quality ReView Act pursuant to 6 NYCRR Part 617, Section 617.7,
determined that this is an Unlisted Action, conducted an uncoordinated review and
granted a Negative Declaration; and
WHEREAS, the Southold Town Planning Board has determined that the New York
State Department of Environmental Conservation's Covenant signed by the applicant,
dated June 26, 2007 and notarized on SePtember 30, 2009, serves to adequately
protect the regulated freshwater wetland located on Parcel 1; be it therefore

RESOLVED, that the Southold Town Planning Board hereby waives the public hearing
for this project for the following reasons:
1. No new lots are being created;
2. The existing character of the neighborhood will not be altered;
3. Current and future community planning will not be affected;
4. The freshwater wetlands are being protected pursuant to {}275-3 of the SOuthold
Town Code; and be it further
RESOLVED, that the Southold Town Planning Board grant Conditional Final Approval
on the surveys prepared by John T. Metzger, Land Surveyor, dated November 21,
2006, subject to the following condition:
1. The filing of' new deeds with the Office of the Suffolk County Clerk pertaining to
the lot line change and, upon filing, submission Of a copy to this office.
This condition must be met within six (6) months of the resolution unless an extension of
time is requested by the applicant and granted by the Planning Board. Upon fulfillment
of the condition, the Planning Board will issue final approval and authorize the Chairman
to endorse the final surveys.

The Southold Town Planning Board, as lead agency, has determined that the proposed
action described below will not have a significant effect on the environment and a Draft

Description of Action: This lot line change will reduce Parcel 1 (SCTM#1000-33-2-10) by
2,430 sq. ft. and increase Parcel 2 by 2,430 sq. f. in order to create as far a setback as possible
for a proposed dwelling from the wetlands. Parcel 1 will decrease in total size from 21,458 sq. ft
to 19,028 sq. ft. Parcel 2 (SCTM~1000-33-2-11) will increase in size from 24,756 sq. ft. to
27,186 sq. ft. These parcels are located in the R-40 Zone.
Reasons Supporting This Determination:
An Environmental Assessment Form has been submitted and reviewed and it was
determined that no significant adverse effects to the environment were likely to occur
should the project be implemented as planned.
The determination was based upon the following:
This lot line change will not have any undesirable impacts on the surrounding
neighborhood or. adjacent properties. This lot line change is being sought to create as
far a setback as possible for the proposed dwelling in order to protect existing wetlands
on the property. The resulting lots will be similar in size to surrounding lots and the
wetlands will remain protected as per the Covenants and Restrictions filed by the
applicant.
Further, the proposed lot line change will not have any of the following impacts:
1. There will be no substantial adverse change in existing air quality, ground or surface
water quality or quantity, traffic or noise levels, no substantial increase in solid waste
production, potential of erosion flooding, leaching or drainage problems will occur as
this action, is proposing a negligible change in lot sizes for two pre-existing lots;
2. There will be no significant removal or destruction of large quantities of vegetation or
fauna, no substantial interference with the movement of any resident or migratory
fish or wildlife species, no significant impacts on a s~gniflcant habitat area, no
substantial adverse impacts on a threatened or endangered species of animal or
plant or the habitat of such a species, and no other significant adverse impacts to
natural resourcesbecause this action is merely modifying a lot line between pre-
existing lots to create as great a setback as possible to protect existing wetlands;
3. The proposed action is not in a material COnflict witha community's current plans
or goals as officially approved or adopted because existing wetlands are being
protected and no new lots are being created. The lot line change between the
two lots is being sought to create as far a setback as possible to protect existing
wetlands;
4. The proposed action will not significantly imPair the character or quality'of
important historical, archaeological, architectural, or aesthetic resources or of
existing COmmunity or neighborhood character; as no new lots are being created
and an existing wetlands will remain protected by this lot line change;
5. No major change in the use of either the quantity or type of energy will occur as a
result of this proposed action as this is only a lot line change;
6. No creation of a hazard to human health will occur as a result of this lot line
change;
7. The proposed action will not cause a substantial change in the use, or intensity of
use, of land including agricultural, open space or recreational resources, or in its
capacity to support existing uses, as this action is only a lot line change between
two pre-existing lots which are not part of either agriculture, open space or
recreational resources.
8. Based upon the foregoing, no significant adverse impacts to the environment are
expected to occur should the project be implemented as planned.

PROPERTY FACTS/DESCRIPTION: The applicant's lands are shown as Lots 68
and 67 on the Map of Eastern Shores, Section 2, filed on August 10, 1965 as Map No.
4426 in the Suffolk County Clerk's Office. The property is adjacent to Homestead
Acres, and has frontage along the westerly side of Westwood Lane of 106 feet for the
northerly lot and 119 feet for the southerly lot (ref. April 30, 2008 survey map
prepared by John T Metzger, licensed land surveyor).
BASIS OF APPLICATION: This application is based on the Building Inspector's
amended May 21, 2008 Notice of Disapproval, citing Zoning Code Sections 280-18
(Bulk Lot Area Schedule) and 280-124 (Setback Schedule) concerning:
(1) a proposed lot area with a new nonconformity of 19,028 square feet in size,
instead of 21,458 square feet, resulting in the remaining lot which will become more
conforming at 27,186 square feet instead of 24,756 square feet;
(2) a proposed single-family dwelling at less than 40 feet from the rear lot
hne.
LWRP CODE CH. 268 DETERMINATION: A Letter from the Town LWRP
Coordinator submitted to the Board of Appeals on July 23, 2008 confirming
inconsistency under Chapter 268-3-F, Waterfront Consistency Review of the Town of
Southold Code and Local Waterfront Revitalization Program (LWRP) standards.
The LWRP review notes that SCTM # 33-2-11 contains a portion of shrub swamp
freshwater wetland system (SO-9) listed by the New York State Department of
Environmental Conservation and the Town of Southold (regulated as a natural

feature under Town Code Chapters 275 and 280). Under LWRP Policy 6 (6.3), the
setback from the proposed residence to the freshwater wetland is noted as 35 feet
and to the driveway 39 feet, where the minimum setbacks of 100 feet apply to any
and all operations proposed on residential property within the jurisdiction of the
Board of Trustees.
The applicant submitted to the Board of Appeals copies of a NYS DEC Permit
DEC~1-4738-00755/00003 issued November 10, 2005 under the Environmental
Conservation Law, Article 24 (Freshwater Wetlands) for a single-family dwelling,
driveway and sanitary system and signed Declaration of Covenants and Restrictions
declaring limits of clearing, grading and ground disturbance areas to meet this
agency requirements, in addition to a Declaration of Covenants and Restrictions for
the Suffolk County Health Department pertaining to the Sanitary Code. The
property is adjacent to 2.7 acres of open space land shown on the subdivision map of
Homestead Acres approved April 30, 1986 by the Town of Southold.
The area variances for rear yard setback for the new dwelling and lot size changes
are necessary in order to meet other agency regulations, by locating the proposed
leaching field away from the wetlands which run diagonally across the southern side
of the subject property.
To further Policy 5, the Board requires a 25-foot wide non-disturbance vegetated
buffer area from the wetland llne landward for a distance of 25 feet. This buffer is
intended to preserve the existing trees and natural growth to protect the water
quality of the wetland and provide critical habitat. (See condition with Board
Resolution, infra). In addition, the applicant has agreed to install two drywells on
the site to capture roof runoff as well as runoff that may be created during activities
related to construction of the new dwelling.
The apphcant has followed all procedures to obtain permits from required agencies
under the wetland ordinances and other pertinent codes, and the applicant agrees to
file all Declaration of Covenants and Restrictions applicable to these agency
determinations, including but not limited to the establishment of a non-disturbance
natural vegetation buffer from the "limits of clearing line" as depicted.
In considering the above, the Board determines that the application to be consistent,
to the greatest reasonable degree of conformity under the Town of Southold LWRP
and Zoning Codes.
RELIEF REQUESTED: The applicant proposes to:
1. change the lot line, resulting in an increase of the subject lot 67 (SCTM# 33-
2-3) to 27,186 square feet in total area from the current 24,756 square feet,
thereby making it more conforming in the R-40 District, and a reduction of
the total area of lot 68 (SCTM # 33-2-10) from 21,458 square feet to 19,028
square feet, thereby making it more non-conforming, and

2. construct a new dwelling with a proposed rear yard setback of 20 feet, while
the code requires a minimum rear yard setback of 40 feet.
ADDITIONAL INFORMATION: The proposed lot line change will also require
approval from the Southold Town Planning Board. The ZBA granted the apphcant a
variance on December 10, 1998 (Appeal No. 4604) for a reduction in a side yard
setback from the 15 ft. code requirement to 10 feet, noting that the slope and
wetlands on the subject property constrain the applicant's ability to build a house on
the lot.
REASONS FOR BOARD ACTION: On the basis of testimony presented, materials
submitted and personal inspections, the Board makes the following findings:
1. Town Law §267-b(3)Co)(3)(1). Grant of the variances will not produce an
undesirable change in the character of the neighborhood or a detriment to nearby
properties. The proposed modestly sized dwelling and the size of the proposed
building lots are similar to other houses and lots in the Eastern Shores
Development, which is now virtually built out. The proposed house will be setback
+/- 120 feet from Westwood Lane. Building lot 67 (the subject property) is bordered
on two sides by designated green space and on one side by undeveloped property.
2. Town Law §267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved
by some method, feasible for the applicant to pursue, other than an area variance
because the wetlands on the subject property create significant restrictions on the
size of a dwelling and where a dwelling and sanitary system can be located..
3. Town Law .q267-b(3)(b)(3). The variance granted herein is not substantial with
regard to the lot line change since both lots are currently and will continue to be
similar in size to others in the neighborhood, and is substantial in terms of the
proposed 20 ft. rear yard setback for a new dwelhng which is a 50% variance from
the code required 40 ft. rear yard setback.
4. Town Law §267-b(3)Co)(5). The difficulty has not been self-created but is the
result of requirements from the NYSDEC, SCHD and Town Trustees to move the
proposed leaching field and dwelling to 35 feet and 40 feet from the flagged wetlands
on the subject property, thereby necessitating a lot line change with the adjacent lot
to the north which is also owned by the apphcant, and a rear yard setback variance
in order to locate the proposed leaching field away from the wetlands which run
diagonally across the southern side of the subject property.
5. Town Law §267-b(3)(b)(4). No evidence has been submitted to suggest that a
variance in this residential community will have an adverse impact on the physical
or environmental conditions in the neighborhood. The applicant has followed all
procedures to obtain permits from required agencies under the wetland ordinances

and other pertinent codes. Two drywells are proposed on the site to capture roof

6. Town Law q267-b. Grant of the requested relief is the minimum action necessary
and adequate to enable the applicant to enjoy the benefit of a lot line change and
new dwelling, while preserving and protecting the character of the neighborhood
and the health, safety and welfare of the community.
RESOLUTION OF THE BOARD: In considering all of the above factors and
applying the balancing test under New York Town Law 267-B, motion was offered
by Member Weisman, seconded by Member Ohva, and duly carried, to
GRANT the variance as applied for, and shown on the survey by Peconic
Surveyors dated April 30, 2008, subject to the following Conditions:
a. The use of synthetic herbicides, pesticides and fertilizers is
prohibited.
The Declarant covenants that a 25-foot wide Non-Disturbance,
vegetated buffer area shall be established from the wetland line
landward for a distance of 25 on SCTM# 33.-2-11. It is hereby
understood that the 25 foot Non Disturbance, vegetated buffer is
intended to preserve the existing trees and natural growth to
protect the water quality of the wetland and, provide critical
habitat. Vegetation within this area shall remain in its natural
state in perpetuity. Permitted activities within the buffer are
limited to the removal of dead, diseased trees that are hazardous
to life or property. Notwithstanding the above, the Non

additional native vegetation subject to review and approval of
Southold Town Trustees."
That these ZBA conditions be written into the Building Inspector's Certificate of
Occupancy, when issued.
Any deviation from the variance given such as extensions, or demolitions which are
not shown on the applicant's diagrams or survey site maps, are not authorized under
this application when involving nonconformities under the zoning code. This action

the subject property that may violate the Zoning Code, other than such uses,
