been filed requesting additional dockage facilities at premises located
at the south side of Skunk Lane (Bay Avenue), Cutchogue, New York, now
of Norman C. Boos;
WHEREAS, since the date of filing this application, an environmental
review process has been pending concerning this proposed project; and
WHEREAS, on April 25, 1984, this board has been requested to withdraw
the subject application, without prejudice:
NOW, THEREFORE, BE IT RESOLVED, that Appeal No. 3203, application

In response to your letter dated September 27, 1984
regarding the application of Norman C. Boos for additional
dock facilities in Broadwaters Cove, Cutchogue, by letter
received from the Southold Town Board of Appeals dated
May 9, 1984, the Appeal No. 3203 application for Norman
C. Boos was withdrawn without prejudice, by resolution
adopted by the Board of Appeals.
Therefore, Mr~ Boos can not further expand this facility
until all approvals are obtained from the Building Department,
Board of Appeals, and any other department that would be
involved.

and in accordance with a previous declaration by this board clas-
sifying this project as an Unlisted Action and determining that
same may have significant adverse effects upon the environment,
hereby determines that a Draft Environmental Impact Statement
(DEIS) will be prepared in accordance with Section 617.8 and
resolution unanimously adopted by this board on February 11, 1984

this proposed project and hereby classifies the same as an Unlisted
Action which may have a significant adverse effect upon the environ-
ment for the following reasons:
1. Information has not been submitted indicating the type of
sewage systems available, if any, for those boats having sleeping,
kitchen, or other facilities, which may cause pollution into the
waterway;
2. Information has not been available indicating the type of
maneuvering for those boats to be navigating to and from each docking
facility, which may disturb the wetlands area along the edge of this
subject area.
It is hereby requested that the applicant and/or his agent furnish
our department with a completed Long Environmental Assessment Form.
This declaration should not be considered a determination made for
any other department or agency which may also be involved, nor for any
other project not covered by the subject Z.B.A. application.

Dear Mr. Boos:
At a Special Meeting of the Board of Appeals held on
February 11, 1984, it was the unanimous agreement of the members
to request a Draft Environmental Impact Statement in accordance
with Section 617.8 of the State Environmental Quality Review Act
which shall contain at least the following:
(1) a concise description of the proposed project, its
purpose and need;
(2) a concise description of the environmental setting of
the adjacent areas, sufficient to understand the possible effects
of the proposed project;
(3) a statement of the important environmental impacts of
the proposed project, including short-term and long-term effects
and typical associated environmental effects, i.e.:
[a]
alteration of the adjacent wetlands area, such
as widening of the channel if needed at present or
in the future;
[b] changes and effects of the adjacent wetlands area
due to wave action from navigation;
[c] pollutants-sewage being discharged due to increased
navigation;

(4) an identification and brief discussion of environmental
effects which cannot be avoided, if the proposed project is
implemented;
(5) a description and evaluation of reasonable alternatives,

commitments of resources which would be associated with the
proposed action should it be implemented;
(7) a description of mitigation measures to minimize the
environmental impacts on:

alteration of the adjacent wetlands area, including
erosion, due to increased navigation and maneuvering
of vessels;
lb] sewage pollution;
[c] other pollutants from navigation, etc.
(8) a description of any growth-inducing aspects of the
proposed project;
(9) a list of any underlying studies, reports, expert testi-
mony and other information obtained and considered in preparing
this statement [together with copies of same for reference].
Upon receipt of the Environmental Impact Statement, we are
required to provide for a 30-day commenting period and then to
proceed with Section 617.10 of the SEQRA provisions.
For your reference we are enclosing photocopies pertaining
to other material to be included in this statement.

Dear Mr. Goehringer:
I would like to advise your Board that the Trustees
jurisdiction lies over all lands under water within the
Town of Southold. We are authorized to issue permits
for the placing of docks or other objects in or on any
Town Waters provided that the same does not impede or
interfere with navigation or the public use of said water
or land.
Therefore, in regard to the application of Mr. Norman
C. Boos, the Trustees only have authority over the docks
applied for and to insure that same does not interfere with
navigation. This application, which is before the Board of
Trustees, has been tabled, at the present time.

Dear Mr. Goehringer:
In accordance with your letter dated January il 1984, enc].osed please
find completed Long Environment Assessment form.
I've heard rumor that a petition against this action with heavily ex-
aggerated claims is being or has been sent you. Said petition assert-
ing that we have (1) live on board people in the marina with resulting
cooking and human pollution, (2) that boats are oversize and (3) that
traffic creates a problem, I would like to document for tile board that
these claims are invalid:
(1) Live on board: With the exception of A. Zimmer (my wife's
brother) patrons of tile marina live within a short distance
of the marina. They walk and bike in addition to driving to
the premises. They certainly do not live on board, nor is it
honestly feasible for them to come aboard to cook, home is
much more convenient. On occasion my brother-in-law does stay
overnight at tile marina during which time he uses our personal
dockside facilities. It has been noted on both 1983 and 1984
contracts that live on board is not permitted (see enclosed).
As to my own boat, I do live on board during weekends and I utilize
the toilet facilities in the storage building as purchased (also
enclosed). I have not made these facilities available to anyone
other then my in-laws but if the board wishes me to do so I certainly
will readily comply I supply and maintain refuse cans for those
in need.
(2) Boats are oversize: Our boats range in size from a 13' boat to
two boats that are 25' and one boa 27'. The twenty-seven is
owned by Mr. & Mrs. R. Wacker, members in good standing in the
community, who traded up from a 21 footer to the present size.
They have been patrons of tile marina prior to and during the
entire time that we have been owners. In view of the fact that
they are such good people, and they conform to the rules of the
marina, we could not tell them they must leave be~auae they are
now oversize.
(3) Parking: The enclosed photo (a) showing marina during our first

year of ownership clearly indicates parking to be adjacent to
the road. There was no way for any patron to leave the
marina without having to back onto Skunk Lane, dangerous in
view of people sometimes speeding around tile bend in the road.
Since ownership, parking has been taken off tile road (photos
b & c) by means of blocking cars from just pulling in and out.
This was accomplished by placing the pilings and hawser lines as
noted (photo b) and the telephone pole automobile stops as in
photo a have been moved much closer to the white 4 x 4 posts
creating a good size parking area (photo c). Parking in tile
area of my home .has been landscaped, in a year or so no auto
in that portion of tile marina will be seen from either Skunk
Lane or Nassau Point Causeway.
These photos indicate the entire marina basin. The platform of photo d
is 20' overall enabling you to compare size of boats down the line.
Photo c shows boats on the road side as well as tile east side. You can
see from these photos that the boats are day boats, good for a leisurely
outing, fishing or water skiing. They are not what would be called live
on board type boats.
To tie up a few loose ends. There is simultaneously community need
as well as financial requirement for the expansion. The cost of
operation far exceeds the revenue. I stated at the Trustees hearing
that I will not again ask to increase the facilities if this request
is passed and that is true. My home is almost ready to move into, I wish
to do so. I as well as my neighbors wish to enjoy the quietude of the
area and do not intend to make this into a large commercial enterprise.
As you are aware, I am requesting an increase of eighteen additional
boats, approximately 18' or less over the covenant set forth by tile
Board of Appeals several weeks prior to the sale of the marina (covenant
dated 6/1/78, deed delivered 8/23/78)' On May 17th 1978, to establish
these guidelines, the former owner (Angelo Petrucci) in a letter to the
Board of Applals stated he could accomodate with ease 40 to 45 boats,
but for his purposes chose 35 (letter enclosed). There is ample room
for this proposed addition.

Addendum: At the Trustees meeting it was mentioned that at times
people have exceeded the 5~II rule which would result in erosion of
the marsh and wetland area. On occasion this has happened in the
channel and we let the few who have done so be aware that it is against
the law and would make them subject to expulsion from the marina. NO
ONE has ever sped in the area of any docked boats however, and this
addition would have the effect of protecting rather then destroying
this vital area. People do slow down in the area of boats.

The maximum number of boats docked at the marina with
tile present docking has been 37 boats plus my personal
boat. I'd like to mention that my boat is for sale
(Listed with McMichaels Yacht Sales in Sag llarbo~.
Until my home is completed, target date early fall
1984, I must continue to live on it during the week-
ends.
(b)
I've enclosed for your review our construction plan
which indicates the length of walk to be 175' and
width 20' 1-1/2" .
(c)
Site plan enclosed indicates that we can provide up to
62 parking spaces, however as stated in my letter dated
July 14, 1982 (the same is true of the 1983 season) even
during the hottest days with the heaviest traffic there
has never been more than 20 cars parked at any one time.
After proposed expansion, parking for 62 cars will frankly
NEVER be necessary however the plan indicates that they
are available.
(d)
As to width of channel, it is 50' wide at the narrowest
portion The total projection of the proposed catwalk
and fingers into the channel is approx 20~', our personal
boat is 14'10" in width with a 3' spring line meaning
that the boat we use projects into the channel roughly
18', resulting in a difference of only approx. 2~.'.

with respect to access or egress and a difference
in the width of the channel of 2½' will not result
in any less maneuverability.
Sir, I would like to request that the tapes of the
public hearing of the Board of Trustees held on the
13th of Decembeq 1983, be reviewed by the Board of
Appeals for in,ut as to the function of the marina
and the community need for additional dockage.

GENERAL CONDITIONS
1. The permittee shall file Jn the office of the appropriate Regional

or injury to the struclure or work herein authorized which may be caused by or
result from future operations undertaken by the State for the conservation or
improvement of navigation, or for other purposes, and no claim or riRht to
compensation shall accruc from any such damage.
9. That if the display of lights and signals on any work hereby authorized
is not otherwise provided for by law~ such lights and signals as may be pre-
scribed by the United States Coast Guard shall be installed and maintained
by and al the expense of lhe owner.
10. All work carried out under this permit shall be performed in accoro
dance with established engineering practice and in a workmanlike manner.
11. If granted under Articles 24 or 25, the Department reserves the ~'ighl
1o reconsider this approval at any time and after duc notice and hearing to
continue, rescind or modify this permit in such a manner as may he found 1o
be just and equitable. If upon the expiration or revocation of this permif~ the
modification of the wetland hereby authorized has not been completed, the
applicant shall, without expense to the State, and to such extent and in such
time and manner as the Department of Environmental Conservation may mquire~
remove all or any portion of the uncompleted structure or fill end restore the
site to its former condition. NO claim shall be made against the State of New
York on account of any such removal or alteration.
12. This permit shall not be construed as conveying to the applicant any
right to trespass upon the lands or interfere with the riparian rights of others
to perform the permitted work or as authorizing the impairment of any rights,
title or interest in real or personal property held or vested in a person not a
party to the permit.
13. The permittee is r. espunsible for obtaining any other permits, ap-
provals, lands, easements and rights-Of-way which may be required for this
project.
14. If Branted under Article 36, this permit is granted solely on the basis
of the requirements of Arlicle 36 of the Environmental Conservation Law and
Part 500 of 6 NYCRR (Construction in Flood Plain Areas having Special Flood
Hazards - Building Permits) and in no way signifies that the project will he
free from flooding.
15. By acceptance of this permit the permittee agrees that the permit
is contingent upon strict compliance with the special conditions on the
reverse side.

As you know, your business on the south side.of Bay Avenue, Cutchogue,
New York, is classified as a non-conforming marina or boat basin.
According to our present zoning ordinance, a non-conforming use is any
use, whether of a building or tract of land, or both, existing on the
effective ~ate of the zoning ordinance, which does not conform to the
use regulations of the district in which it is located. The definition
of a marina is any premises containing one (1) or more piers, wharves,
docks, moorings, bulkheads, buildings, slips, basins or lands under
water, designed, used or intended to be used primarily for the docking
or mooring of boats, for or without compensation.
Using your letter of May 17, 1978, and the above definitions as a guide,
J.t seems to us that your non-conforming marina includes the following:
The seasonal operation of a marina or boat basin with docks or slips fer
not more than thirty-five (35) non-commercial boats not more than 24 feet
in length. Special services for owners such as fresh water, electricity,
oil and gasoline are also permitted. We think that this service barge
is an integral part of your marina operation and may be stored on your
property when not in use.
You are not permitted to store boats, build boats or conduct the retail
sale of boats on your premises.

Mr Angelo Petrucci came to see me today on behalf of Boos.
You have also spoken to me about this application.
I enter the discussion with hesitation and not to interfere.
Ny recollection is that a four lot subdivision was approved by
the Board of Appeals sometime in the 1960's adjoining the Petrucci
marina..that the 100' easterly lot of this subdivision was sold
(now Wenks)..that at some point this 100' lot was increased in
width to 175'. Without tracing the complicated history of the
balance of the property as amended to two lots on 4/25/72 survey..
my understanding is that ownership of the balance rests with Boos.
with upland of 70507 sq ft..and that Boos wants to separate the
marina from the residential site. ,
The result of all this is that instead of four possible
residential lots and a marina~the possible density has been
reduced to two residential sites and a marina. It seems to me that
this reduction in density goes a long)way toward making what was
a perfectly legal use(prior to Zoning conform to ever-increasing
standards most of which the applicant has already met including
Board of Health,D.E.C.,and parking requirements. It should further
be remembered that any expansion of minimal services which the
marina provides is limited and defined by the June 1 1978 letter
and controlled by the Board of Appeals.
Having been sued a number of times(even thou6h in a dQ-gooder
role) and fully aware of small business difficulties in Southold
as are other members of the Board,I tend to sympathize with the
applicant's desire to separate his business lisbilty from his
residence. In this connection I am increasingly aware of professional
people leaving the state of New York because of liability premiums.
In view of the foregoing special circumstances..some of which
may be new to you and the Board..it is my view that reconsideration
of this application without prejudice would be part of an orderly
procedure. Further I am convinced that an outcome favorable to
the applicant would not injure the safety,health,and welfare of
the Town of Southold

Gentlemen,
Today ~. An~elo Petrucci called on me in reference to some
matters oertaining to bulk requirements for lots which include
wetlands.
For many years the bulk requirements for lots in the A
zone have been allowed to be ~ulfilled with saltwater wetlands.
The area of such wetlands has also been allowed in comouting
units in the "~" district. If the code has been changed in this
regard ~ am not aware of it.
At the same time, Luyears east, the Planning Boar~ in at-
temoti~ to be reasonable, and with the aoproval of the County
Board of Health, arbitr~rily set a minimum area of about ~0,000
seuare feet of bu~ao-z'~-zar~-'-a~-~ne
Again, buildable land was exoected to be above normal high
water line and where oak trees ~row in the natural state.
~:,r. Petrucci's m~.or subdivision was ~ranted because it ful-
filled these requirements. His ore-existing private marina
also fulfilled requirements at the time.
I n reading the aooeal, it aopears that the proposed vari-
ance would result tn buildable areas in excess of that required
of minor subdivi~ons unless reMulations have been changed with-
out my knowledge.

in length. Special services for owners such as fresh water, electricity,
oil and gasoline are also permitted. We think that this service barge
ls an integral part of your marina operation and may be stored on your
prgperty when not in use.
You are not permitted to store boats, build boats or conduct the retail'
sale of boats on your premises.

matters pertainin~ to bulk requirements for lots which include
wetlands.
For ms=ny years the bulk requirements for lots in the A
zone have been allowed to be fulfilled with saltwater wetlands.
The area of such wetlands has also been allotted in comnuting
units in the "M" district. If the code has been changed in this
regard t am not aware of it.
At the s~e time, in years ~mst, the Planni~ Boar~ in at-
temotir~ to be reasonable, and with the aoproval of the Co~u~ty
Board of Health, arbitr~_rily set a minimum area of about 30.000
square feet cf buildable 1-~r,d as the minimum they would require.
A~ain, buildab!e land v,'as exoected to be above normal high
water l~ne and where oak trees ~.o~, in' the natural] state.

Dear Mr. Raynor:
I am still trying to clear the confusion on the Norman C. Boos application.
The review of my file indicates the following: Mr. Boos' application to subdivide
was disapproved by the Building Department on October 22, 1981. At the time of
the disapproval there was pending an application with your Board, which had been
filed on October 13, 1981. Subsequent to that, Mr. Boos and I appeared and you
requested additional information. Confirming our telephone conversations I
made an investigation of the property and found as follows: That the property
had been developed by Angelo Petrucci as residential and marina properties.
He having created the marina by dredging the inlet and the marina area as shown
on proposed minor subdivision map made by Robert Kart last dated October 15, 1981.
I also found out that Mr. Petrucci had in effect done subdivision without application
to your Board; he having sold property to Boos, Wenk, Leeman, and perhaps others.
I also investigated the status of the marina and enclose a copy of letter to
Southold Board of Appeals explaining its status.
The effect of Mr. Boos' application is to somewhat reduce the size of the
marina and convert it from non-conforming use to conforming residential use.
It is my understanding that you probably cannot approve the subdivision for
reason that the residential parcel, even though the bed of the dredged inlet is
owned by Mr. Boos, would be too small when the inlet area is excluded from the lot
area, which would make the application appropriate to be referred to the Zo~ng
Board of Appeals, who as well as you have been furnished with proof of compliance
with NYS Department of Environmental Conservation regulations.
Therefore, I request that you put the matter on your calendar and if you can
grant the minor subdivision, fine; and if not, refer us to the Board of Appeals
for their action, as I understand the procedure involved in the Town of Southold
is that application must first be made to your Board and then to the Board of
Appeals. I have applications pending before both Boards. This matter has been

John advised me that since it is common knowledge that our
house on Broadwaters Cove is on the market, opposition to
the Boos' proposal would have been totally discounted and in
fact might have hurt your efforts to defeat his addition.
Therefore, I did not respond to your invitation to object.
If you disagree with Mr. Nickels' opinion,
please let me know as I certainly would not want my failure
to act to prejudice your position in any way.

Mr. Nickles'opinion. In fact, being our friend we called
him and read him your letter dated February 27, 1984. He
said at the time he had advised you that the Norman Boos
project was not yet a ~najor and public fact. As of to date
all the surrounding c~nities, Broadwater Cove Association,
Nassau Farms and Nassau Point, Oppose him very strongly in his
request to increase this non-confonming marina in this quiet
residential area.
For your sake (as an adjacent neighbor and facing frc~
your house the new proposed boat base parking field), we
strongly urge you to write as Chester H. Hochba~u and Debbie
S. Cantor wrote. As you see, anyone buying your home would
do like them and investigate what this marina can do.

Dear Mr. Grigonis,
As owners of the property directly adjacent to Broadwaters Cove Marina, we are opposed
to the variance proposed by Mr. Norman Boos for expansion of the marina facilities for
the following reasons;

We call your attention to Southold Town Board of Appeals Action dated
September 17, 1982 on Appeal No. 2914, a copy of which is enclosed.
In order to gain a variance to the zoning ordinance to enable him to
build his house, Mr. Boos 6equested permission to reduce the land area
for the marina. Clearly the intention of the zoning Board in granting
the Appeal was to increase residential use and limit marina expansion.
Now, having gained permission to build the house, Mr. Boos wants to
expand his marina property also.
Possible expansion of the marina was a concern of oU~s even.before we
purchased ou~ property. Before our purchase we asked Mr. Boos about his
expansion plans and he told us that he had no intention of bpilding more
than his home. Our concern is evidenced by. the enclosed copy of a letter
from our lawyer dated January 9, 1981. In reply to our concerns about
marina expansion he states that as a pre-existing'non-conforming use,
"opportunity for expansion or intensification would be extremely limited
at best". We do not consider fifty percent expansion of docking and parking
facilities to be "extremely limited".

We believ~ there is insufficient space for parking additional cars on the
property and we are concerned that cars may be parked in areas not allocated
for parking in Mr. Boos' plans. Indeed even in the past, marina patrons
have parked their cars in the area wehave marked in red on the enclesed
map~ This area is directly adjacent to our residential property~.~nd we
believ~is included in the residential portion of Mr. Boos' property and
is not allocated for pa~king in any of the previously approved plans nor
in the proposed plan. If additional docks are built in thisarea, more
patrons will certainly park there in order to be close to their boats,
destroying the residential nature of the area.

We are concerned about possible effects of the proposed expansion on the
safety of our child, ourselves, our neighbors and the rest of the community.
The proposed expansion will surely bring an increase in automobile traffic
on an already unsafe portion of Skunk Lane. There are blind curves on
either side of the marina and speeding is commonplace on this road.
Therefore, there is very poor visibility for cars entering or leaving the
marina.
We are also concerned about ~uch a large increase in boat traffic. The
marina is largely unsupervised and adding these docks will make navigation
to and from the marina much more hazardous. In addition, the channel leading
out of Broadwaters Cove is very narrow and, even in the past, there have
been numerous groundings including some on our property where the channel
leads into the marina.
Our safety concerns are tensified because Mr. Boos proposes to expand this
marina, a commercial use in a residential area, even though there is no
full-time supervision of the facility as Mr. Boos is normally present on
weekends only.
Finally, we are opposed to this proposal because of the negative environ-
mental impact we believe it will have on Broadwaters Cove and the wetlands
in the area.
All Boats must motor in and out of the marina, and a fifty percent increase
in this traffic will cause increased gasoline and oil pollution in the cove,
not to mention the increase in trash thrown or blown overboard. The lack ~
maneuverability in the marina caused by proposed expansion might increase
damage to the banks of the Wetlands. And the additional traffic in the
channel leading out the marina passes directly through our property,
jeopardizing the marshes at the edge of the water. We are also concerned
with the lack of sewage f~cilities at the marina and the effects of raw
untreated sewage disposed of directly into Broadwaters Cove on swimmers
and natural wildlife.
Please consider that the area surrounding Broadwaters Cove Marina is entirely residential
in nature, and most of the residents believe that expansion of'~his' commercial activity
as proposed would be detrimental to the wetlbeing of the entire community. Indeed, we
have supported Mr. Boos' previous proposals for variances needed to build his house,
as residential development of the property was deemed a positive asset to the community.

My wife and I occupy the house directly across the street from the home
of Mr. Boos. We have never been notified of any application for a variance,
neither in writing or by Mr. Boos personally.
Let me begin by saying that my wife and I (and my brother-in-law and wife
McQuaid) are thoroughly opposed to this expansion. There is no reason to
allow a commercial operation to be that close to our home. The parking
facilities are in great shortage now for the existing boat slips (35). The
traffic of cars on Skunk Lane has increased alarmingly. We have owned our
home for 17 years and in the last few years the marina has been operated
as "big business"; to further increase this volume would constitute an
unnecessary hazard to a private dwelling community. Skunk Lane is the only
road to Nassau Point and to allow the further expansion of a con~ercial
operation in a residential area seems to be an infringemant of our rights
to privacy, lack of noise and unnecessary disturbances.
Mr. Boos constructed his home on a work day of 10-12 hours, 7 days a week
for months and caused enough of a disturbance that I see no reason to believe
he will be any more concerned with the effect of operating full-time co~a~er-
cial marina less than 100 feet from two homes.
Finally, the discharge of pollutants-sewerage in an area where all residents
have wells for their drinking water would appear to be a hazard that certain-
ly could be detrimental to the health of several families. I know nothing
of the problem that this could cause to the adjacent wetlands--but it should
be further proof that there is justification to consider this matter care-
fully before granting any permit.
When Mr. Petrucci operated this marina it was a small operation--how it ever
got to 35 slips was something we always questioned but we assumed it was

permissible within the sale to Mr. Boos by Mr. Petrucci. But to
further allow this expansion is unthinkable and certainly consti-
tutes an infringement of our rights to maintain our status as
a residential environment.

I am writing to protest expansion of the marina dockage facilities
at 8000 Skunk Lane, Cutchogue in the name of Norman C. Boos.
I live with my children directly across from the present home
of Mr. Boos. I nor my children were never notified of Mr. Boos'
application to expand.
The traffic on Skunk Lane is very heavy as it is the only road
to Nassau Point. The location of the present marina is at a bend
which has been hazardous for as long as I have been there. Drivers
attempt to pass the cars depositing people at their boats causing
screeching of brakes and skidding constantly in front of our home.
This parcel of land and body of water was never intended to
handle the excessive boat traffic already present. How can an
expansion ever be considered when this plus the huge impact on
the already endangered envrionment is evaluated.
Please do not allow this proposal to proceed any further.

Mr. Boos has requested a variance to build eighteen additional
boat slips on his residentially zoned property.
As home owners who would be directly affected by this
increased docking space, we wish to go on record in opposition of
the Board of Appeals granting permission for his application which
represents an enlargement of the present marina by almost fifty
percent.
Decisions of all boards are made for the good of all the
public concerned, especially when related to health, safety and
tranquility.
Granting this variance would create a hazardous condition
with regard to increased traffic conditions and parking facilities.

Dear Mr. Goehringer,
As owners of the property directly adjacent to Broadwaters Cove Marina, we are opposed
to the variance proposed by Mr. Norman Boos for expansion of the marina facilities for
the following reasons;
l)
We call your attention to Southold Town Board of Appeals Action dated
September 17, 1982 on Appeal No. 2914, a copy of which is enclosed.
In order to gain a variance to the zoning ordinance to enable him to
build his house, Mr. Boos requested permission to reduce the land area
for the marina. Clearly the intention of the zoning Board in granting
the Appeal was to increase residential use and limit marina expansion.
Now, having gained permission to build the house, Mr. Boos wants to
expand his marina property also.
Possible expansion of the marina was a concern of o~fs eve~.before we
purchased ou~ property. Before our purchase we asked Mr. Boos about his
expansion plans and he told us that he had no intention of building more
than his home. Our concern is evidenced by the enclosed copy of a letter
from our lawyer dated January 9, 1981. In reply to our concerns about
marina expansion he states that as a pre-existing'non-conforming use,
"opportunity for expansion or intensification would be extremely limited
at best". We do not consider fifty percent expansion of docking and parking
facilities to be "extremely limited'~.

~e believe there is insufficient space for parking additional cars on the
property and we are concerned that cars may be parked in areas not allocated
for parking in Mr. Boos' plans. Indeed even in the past, marina patrons
have parked their cars in the area we have marked in red on the enclosed
map? This area is diFectly adjacent to our residential property.~nd we
believe'is included in the residential portion of Mr. Boos' property and
is not allocated for paF~king in any of the previously approved plans nor
in the proposed plan. If additional docks are built in th~$ area, more
patrons will certainly park there in order to be close to their boats,
destroying the residential nature of the area.

We are concerned about possible effects of the proposed expansion on the
safety of our child, ourselves, our neighbors and the rest of the community.
The proposed expansion will surely bring an increase in automobile traffic
on an already unsafe portion of Skunk Lane. There are blind curves on
either side of the marina and speeding is commonplace on this road.
Therefore, there is very poor visibility for cars entering or leaving the
marina.
We are also concerned about such a large increase in boat traffic. The
marina is largely unsupervised and adding these docks will make navigation
to and from the marina much more hazardous. In addition, the channel leading
out of Broadwaters Cove is very narrow and, even in the past, there have
been numerous groundings including some on our property where the channel
leads into the marina.
Our safety concerns are tensified because M~. Boos proposes to expand this
marina, a commercial use in a residential area, even though there is no
full-time supervision of the facility as Mr. Boos is normally present on
weekends only.

Finally, we are opposed to this proposal because of the negative environ-
mental impact we believe it will have on Broadwaters Cove and the wetlands
in the area.
All Boats must motor in and out of the marina, and a fifty percent increase
in this traffic will cause increased gasoline and oil pollution in the cove,
not to mention the increase in trash thrown or blown overboard. The lack (me
maneuverability in the marina caused by proposed expansion might increase
damage to the banks of the Wetlands. And the additional traffic in the
channel leading out the marina passes directly through our property,
jeopardizing the marshes at the edge of the water. We are also concerned
with the lack of sewage f~cilities at the marina and the effects of raw
untreated sewage disposed of directly into Broadwaters Cove on swimmers
and natural wildlife.
Please consider that the area surrounding Broadwaters Cove Marina is entirely residential
in nature, and most of the residents believe that expansion of'~his commercial activity
as proposed would be detrimental to the wellbeing of the entire'community. Indeed, we
have supported Mr. Boos' previous proposals for variances needed to build his house,
as residential development of the property was deemed a positive asset to the community.

Dear Sir:
Despite the above address, I am a Yankee, own property at Nassau Point,
and am very much a citizen of that area.
For at least ten years I have kept my boat at the Broadwaters Marina,
even before it had that name and had become the beautifully planned
and operated unit that it has become. It is a credit to a man of vision
and tremendous vitality and industry.
At no time has there been any characteristic of this installation which
can be interpreted as a detriment to the area in which it exists. As a
matter of fact, the proprietor has constructed a magnificent house to
be his living quarters immediately adjacent to the marina.
I have been aware of resistance to the development of this property for
some time. Various excuses have been introduced to prevent its progress.
Certainly problems with adequate parking space cannot logically be a
legitimate objection. ! have never seen the space provided even challenged.
I believe that the community can safely allow Mr. Boos to build additional
slips for small boats without worry. A successful venture to the extent
that I understand this is to be expanded cannot but benefit the community.
It is therefor suggested that permission be granted to Mr. Boos to
complete the installation according to his plans.

As thirty year residents of Broadwaters Cove, Cutchogue,
we would like to go on record as bei~ strongly opposed
to any further expansion of Broadwaters Cove Marina as
requested by Mr. Boos.
In 1978 the zoning Board of Appeals set limits for the
operation of this marina property. If the new owner.
Mr. Boos, feels, as he stated at the Board of Trustee
meetir~g last October, that he cannot make enough money
with the marina at its present size, let him r~ise his
mooring fees, and not further commercialize and polute
these beautiful waters of Broadwaters Cove.
We therefore request that you deny Mr. Boos' applica-
tion for expansion of his marina.

we, the undersigned, James Reale, Michelena Reale, Angelo Petrucci,
Georgette Petrucci live on Bay Avenue (Skunk Lane), Cutchogue directly
across the road frcm Broadwater Cove Marina owned by Norman C. Boos.
Norman C. Boos has applied to the Trustees to construct a floating
catwalk with nine fingers for eighteen more boats in the Broadwater Cove
Marina channel. This will obstruct free navigation and be very hazardous
to the marina's navigation.
Let us not lose sight of the fact that this marina is in a residential
area and is a nonconforming zoned piece of property (not zoned for business).
We feel at this time that the marina is operating at its full capacity
of thirty five boats as the Southold Town Board of Appeals letter dated
June 1, 1978 states and Mr. Boos was well aware of what he bought. The
additional fingers or slips increasing the amount of boats stored in this
marina would congest and would add additional traffic on an already busy,
narrow road and the only road leading in and out of Nassau Point, creating
noise and rubbish on the road. There is no parking area for eighteen more
boats except on the road not to mention the depreciation of the real estate
properties in our area.
When launching boats it creates a traffic back up and is a hazzard
because boats being launched need the ccmplete width of Bay Avenue (Skunk
Lane). The increase in boats stored in this dead end marina with people
sleeping on board overnight certainly has to create problems on water
pollution and the envirerm~nt.
We hope the Planning Board, Board of Appeals, Building Department and
Trustees will take these above facts under consideration when making their
decisions.
We w~uld appreciate your notifying us whenever this matter ccrnes before
the Southold Town Board of Appeals so that we can express our opinion on
this matter at those meetings.

New York, is classified as a non-conforminq marina or boat bas%n. ,.

water, designed, used or intended to be used primarily for the docking
or mooring of boats, for or without compensation.
Using your letter of May 17, 1978, and the above definitions as a guide,

is an integral part of your marina operation and may be stored on your
property when not in use.

Hopefully, this clearly defines all permitted uses for your property. If
there are any other questions, please bring them to our attention.

Dear Mr. Goehringer~
I wish to oppose Mr. Boos' application
of 10/23/83 to increase the capacity of his
marina on Bay Ave., Cutchogue.
Residents of this area have, for many
years, enjoyed clamming, gathering oysters,
scallops, etc., in these waters, with the
assurance that the creeks in our area were
clean and unpolluted.
The enlargement of Mr. Boos' marina
would bring in more boats, polluting our
waters with oil plus the debris which may be
cast from the boats by the owners.
I, therefore, request, that Mr. Boos'
application to increase the capacity of his
marina be turned down.

I, like many of the Broad Waters Cove residents, oppose the
application of Mr. Boos which was submitted on October 28, 1983.
A letter from the previoup owner, Angelo Petrucci, that was sub-
mitred to the Southold Town Board, clearly explains the number of
boats that can be moored in this marina. I cannot see why the
board should change their decision now to please Mr. Boos. If
he is having financial difficulties, his problem should not be the

Resarding the Application for NORMAN C. BOOS
FOR construction of 175 lin. ft. of floating walk with nine
fingers each approximately 16' long to accommodate additional
dockage for 18 small boats; We, the undersigned, C~ARENCE AND
MARY BELZ,, living on the corner of Mason and Broadwters Drive,
are very much against the approval of thus application.
The present marina is in a residential area and is a nonconforming
zoned p&ece of property (not zoned for business).
The additional fingers or slips increasing the amount of boats
stored in this marina would congest and would add additional
traffic on an already busy,narrow road and the only road leading
in and out of Nassau Point, creating noise and rubbish on the road.
There is no parking area for eighteen more boats except on the
road not to mention the depreciation of t he real estate
properties in our area.
When launching boats it create~ a traffic back up and is a
hazard because boats being launched need the complete width of
Skunk Lane. The increase in boats stored in this dead end
marina with people sleeping on board overnight certainly has to
create problems on wat~rpollution and the environment.
We hope the Planning Board, Board of Appeals, Building
Department and Trustees will take these above facts under con-
sideration when making their decisions.

When I first decided to write this letter I began to mentally compile a -
list of reasons why the permit sought by Mr. Boos should not be granted.
It occurred to me, however, that no list of reasons ought to be required,
nor should there 'be required a long list of interested persons opposed to
the granting of the permit. Ail that should be required is this statement:
I, as an individual with a demonstrable interest in the area, do not want
the permit to be granted.
The June 1, 1978, letter of the Southold Town Board of Appeals to Mr. Angelo
Petrucci very clearly defines the limits within which the marina property is
to be operated. The statement by the Board was made not only to Mr. Petrucci
but to the interested public, and presumably it represents a certain commit-
ment on the part of the Board.
~. Boos now seeks to expand the use of the property beyond the indicated
limits for his personal profit and at the expense of an impact upon the
area and the comnunity. I seek, by urgently requesting that the application be
denied, tohmintainundiminished that store of envi~mmental qualities which
ied me to purchase a home in the area. '.~
It would seem appropriate for Southo!d to again be first, this time in deciding
that the existing relative quiet and solitude ~Crtichmake the North Fork so
unique, and which are of great value to at least a single resident, are no less
important to the comity as a whole than the aggrandizement of another single
resident through further concessions which impinge in any degree upon that
quiet and solitude.

Dear Members of the Board:
As residents of Cutchogue and customers for the past
two years of the Broadwaters Cove Marina we would
like to add our whole-hearted support to Mr. Boos'
application for the expansion of his facilities.
We suspect that the major issues, pro and con, have
been voiced by this point but hope that some of our
personal experiences and observations may help shed
a positive light on the question.
1. Availability of slip space at the marina, the only
such facility for several miles in either direction,
was the determining factor in our decision to
recommission our power boat after five years in
storage as we were beyond the stage where we wanted
to be concerned about an unattended boat moored in
the Bay. Boat expenditures, as is well documented,
are considerable and in our case have resulted in
nearly $3,000 in revenues to local canvas makers,
mechanics, boat movers, marine supply stores,
gas docks, and insurance agents in two years. In
short, pleasure boating is good business for the
Southold Town economy.
2. We have frequently remarked that even on prime
weekends the marina is surprisingly full of unused
boats and noticeably void of signs of humanity.
3. We do not own an automobile and seem to be only
one of many boaters dropped off at the marina with
the land chauffeur then driving off for points
unknown. This pattern is most common with Mr. Boos'
teenaged client-navigators which age group seems to
be the majority in Cutchogue's boating population.

Parking is, in our opinion, a non-issue. We recall
only once last summer when the area along the road
seemed to be filled to capacity although it appeared
that one could have then easily found space in the
parking area closer to ~r. Boos' house.
4. The marina is a neighborhood facility and its
pattern of usage differs from some of the larger
commercial facilities in the area. It appears that
most boat owners have residences locally which serve
as the focal points for weekend social gatherings
and entertaining rather than the dockside entertaining
which is more common with the owners of large craft
at some of the marinas which accomodate those sorts
of boats, again suggesting that conventional parking
capacity standards do not apply.
5. We have never seen evidence that anyone is living
aboard a boat, except for Norman himself. Most of
the boats are simply too small. It is unusual, in
fact, for anyone to linger any longer than is necessary
to handle the details of getting underway or closing
up the boat.
Ail of us need to be concerned with the over-
development of the North Fork and we favor the careful
review of proposals such as this. It is important
that in this issue the nature of the marina's use
patterns be carefully examined. It is not a conventional
heavy use facility. Norman has developed a facility
which is aesthetically pleasing, properly maintained,
well managed, and an asset to the community. In our
opinion the addition of 18 more slips will not degrade
the area by resuming in a congested facility. We
strongly recommend your approval of the proposed
expansion. Our fellow boaters need dock space.

Gentlemen

be increased if for no other reason that to provide
more docking space for local boatowners. Because of its
current limited size many boaters in the Nassau Point area
are unable to use this facility.
This facility is a real asset to our community and it should
be available to as many people as possible. It is well
maintained, the grounds and parking facilities are
attractive and more than ample to handle any planned
increase in the number of cars using it.
I have kept my boat this this marina for a number of years
and would strongly resent any move to deprive local
boaters of an opportunity to avail themselves of this
facility.

I am a year-round resident of Southold residing on Indian Neck Lane. I
have moored my sailboat at the Broadwater Cove Marina for the past three
years. During these years, I have found this marina to be one of the
most efficiently run marinas I know of. The atmosphere is one that is
quiet and extremely clean, both at the dock and surrounding waters. This
atmosphere most certainly conforms with the surrounding residential area.
I find the parking facilities to be more than adequate.
For these reasons, I am in favor of Mr. Boos' request to expand. He is
to be complimented on running a very efficient operation which serves
the community and affords local residents the opportunity to safely moor
their boats.
In closing, let me say that I have a waterfront home, but I choose to
moor my boat at the Broadwater Cove Marina because it is run so efficiently.

about the expansion of the marina at Broadwater's Cove.
I have been a boat tenant since the inception of that facility.
I think Mr. Boos should be complimented on ta~ing what was an eye-
sore location and steadily improved and enhanced the appearance of
that same location, to a point which is now an asset to the road
leading to Nassau Point.
The objection that has been raised about the new proposed finger
slips is totally ridiculous. There is more than a~ple room and space
for any size craft to come in and out of the marina.

Gentlemen:
We have a residence on Sterling Road, Cutchogue, located just around the
corner (about a 4-5 minute walk) from the Broadwaters Cove Marina on
Skunk Lane, (Bay Avenue), Cutchogue.
It has come to our attention that the Owners and operators of the Marina,
Mr. and Mrs. Norman Boos, want to make better use of their Marina property
by adding some slips to the existing location. It is surprising to learn
that their attempts to improve the area and provide expanded and better
service and docking facilities are meeting with resistance from some of the
other local residents.
We have enjoyed our home in Cutchogue for nearly two years and have had the
pleasure of docking our small boat in the Broadwaters Cove Marina for the
past two sum~ers and it is our intention to continue.
It was not too difficult to learn that the original marina was in disrepair
and not in keeping with the fine area. Since Mr. and Mrs. Boos have taken
over the marina a few years back, many, many improvements have been made
and maintained. The general housekeeping is impeccable, and the arrangements
they have made for parking has ensured that everyone who needsto park their ~
car at the marina can be done off the main street, Skunk Lane. (Previously,
cars would have to be loaded/unloaded and parked directly on the road.)
Anyway, our experience during the past two sum~ers has been nothing but
excellent. Even on the busiest of days, we have always been able to easily
find a parking space (if we didn't walk - as many of the marina users do).
There has always been adequate facilities for refuse and all the people
(of all ages) have always been considerate and helped police the area to
keep up the standards that Mr. and Mrs. Boos have established.
Interestingly enough, Mr. and Mrs. Boos have thought so much of the area
and their marina that they have been building (themselves) a fine residence
on the immediately adjacent lot to the marina and I understand that it will
be finished and they will be able to move in within the next couple of months.
I am certain that the Board will take all facts into consideration when
making a final decision but also trust that due consideration is given to
Mr. and Mrs. Boos' request and the increase in revenue that they may be
able to realize, however slight - for whatever increased number of slips
eventually allowed. Full time supervision right on the premises is an
advantage that, in most cases, is i/m~easureable.

In short, we feel that, being residents of the area, having Broadwaters
Cove Marina in our neighborhood, with its fine standards and facilities,
is a definite asset, and that the moderate expansion plans will also prove
