Rescinded 2007-887 CATEGORY: Local Law Public Hearing DEPARTMENT: Town Attorney Set PH Tax Exemp Landmark 12/18/07 4:35 WHEREAS, there has been presented to the Town Board of the Town of Southold, Suffolk “A Local Law in County, New York, on the 20th day of November, 2007 a Local Law entitled relation to Tax Exemption for Alteration and Rehabilitation of Landmarked Properties” now, therefore, be it RESOLVED that the Town Board of the Town of Southold will hold a public hearing on the aforesaid Local Law at the Southold Town Hall, 53095 Main Road, Southold, New York, on the 18th day of December, 2007 at 4:35 p.m. at which time all interested persons will be given an opportunity to be heard. November 20, 2007 Page 13 Minutes Southold Town Board Meeting “A Local Law in relation to Tax Exemption for Alteration The proposed Local Law entitled, and Rehabilitation of Landmarked Properties” reads as follows: LOCAL LAW NO. 2007 “A Local Law in relation to Tax Exemption for Alteration and A Local Law entitled, Rehabilitation of Landmarked Properties” . BE IT ENACTED by the Town Board of the Town of Southold as follows: I.Purpose. The Town Board of the Town of Southold hereby finds and determines that the preservation of historic property is essential to maintaining the culture and history of Southold Town. This Town Board also finds and determines that owners of historic real property will be more willing to alter or rehabilitate such property if they were to receive incentives in the form of property tax exemptions. Therefore, the purpose of this law is to opt into the State program to provide a real property tax exemption for historic property with Town landmark status located within the Town of Southold to the extent of any increase in value attributable to alterations or rehabilitation, in order to promote historic preservation in the Town of Southold. II. A new Article VIII of Chapter 245 of the Code of the Town of Southold is hereby enacted as follows: ARTICLE VIII Exemption for Historic Properties §245-9. Real Property Tax Exemption. November 20, 2007 Page 14 Minutes Southold Town Board Meeting The Town of Southold hereby grants an exemption from taxation and special ad valorem levies as authorized under Section 444-a of the NEW YORK REAL PROPERTY TAX LAW and as provided herein: A. Property located within the Town of Southold designated as “historic” pursuant to Chapter 170 of the Town Code of the Town of Southold shall be exempt from taxation and special ad valorem levies imposed by or on behalf of the Town of Southold, to the extent of any increase in value attributable to alteration or rehabilitation pursuant to the following schedule: Year of Exemption Percent of Exemption 1 100 2 100 3 100 4 100 5 100 6 80 7 60 8 40 9 20 10 0 B. No such exemption shall be granted unless: i. Such property has been designated as “historic” pursuant to Chapter 170 of the Town Code of the Town of Southold; ii. Alterations or rehabilitation must be made for means of historic preservation; iii. Such alterations or rehabilitation of “historic” property meet the guidelines and review standards of Chapter 170 of the Town Code of the Town of Southold; iv. Such alterations or rehabilitation of “historic” property are approved by the Town of Southold Historic Preservation Commission; v. Alterations or rehabilitation are commenced subsequent to the effective November 20, 2007 Page 15 Minutes Southold Town Board Meeting date of this local law. C. Such exemption shall be granted only by application of the owner or owners of such “historic” real property on a form prescribed by the State Board of Real Property Services. The application shall be filed with the Town of Southold Assessors on or before the appropriate taxable status date of Suffolk County. D. Such exemption shall be granted where the Town of Southold Assessors are satisfied that the applicant is entitled to an exemption pursuant to this law. The Assessor shall approve such application and such property shall thereafter be exempt from taxation as herein provided commencing with the assessment roll prepared on the basis of the taxable status date referred to in subdivision (A) of this section. The assessed value of any exemption granted pursuant to this law shall be entered by the Assessor on the assessment roll with the taxable property, with the amount of the exemption shown in a separate column. III. SEVERABILITY If any clause, sentence, paragraph, section, or part of this Local Law shall be adjudged by any court of competent jurisdiction to be invalid, the judgment shall not affect the validity of this law as a whole or any part thereof other than the part so decided to be unconstitutional or invalid. IV. EFFECTIVE DATE This Local Law shall apply to assessment rolls prepared on the basis of taxable status dates occurring on or after January 1, 2008. This Local Law shall take effect immediately upon filing with the Secretary of State as provided by law. BE IT ENACTED by the Town Board of the Town of Southold as follows: I.Purpose. The Town Board of the Town of Southold wishes to opt into the New York State Real Property Tax Law exemption provided to Cold War Veterans. This extension of the existing veterans partial exemption to veterans of the Cold War period is an appropriate accommodation and recognition of these valued individuals, to the fullest extent permitted by New York State law. II. A new Article VII of Chapter 245 of the Code of the Town of Southold is hereby enacted as follows: ARTICLE VII Exemption for Cold War Veterans §245-17. Definitions. November 20, 2007 Page 17 Minutes Southold Town Board Meeting As used in this Article, the following terms shall have the meanings indicated. COLD WAR VETERAN – A person, male or female, who served on active duty for a period of more than three hundred sixty-five days in the United States armed forces, during the time period from September second, nineteen hundred forty-five to December twenty-sixth, nineteen hundred ninety-one, was discharged or released therefrom under honorable conditions and has been awarded the Cold War recognition certificate as authorized under Public Law 105-85, the 1998 National Defense Authorization Act. ARMED FORCES – The United States Army, Navy, Marine Corps, Air Force and Coast Guard. ACTIVE DUTY – Full-time duty in the United States armed forces, other than active duty for training. SERVICE CONNECTED – With respect to disability or death, such disability was incurred or aggravated, or that the death resulted from a disability incurred or aggravated, in line of duty on active military, naval or air service. QUALIFIED OWNER – A Cold War veteran, the spouse of a Cold War Veteran, or the unremarried surviving spouse of a deceased Cold War veteran. Where property is owned by more than one qualified owner, the exemption to which each is entitled may be combined. Where a veteran is also the unremarried surviving spouse of a veteran, such person may also receive any exemption to which the deceased spouse was entitled. QUALIFIED RESIDENTIAL REAL PROPERTY – Property owned by a qualified owner which is used exclusively for residential purposes; provided, however, that in the event that any portion of such property is not used exclusively for residential purposes, but is used for other purposes, such portion shall be subject to taxation and only the remaining portion used exclusively for residential purposes shall be subject to the exemption provided by this section. Such property shall be the primary residence of the Cold War Veteran or the unremarried surviving spouse of a November 20, 2007 Page 18 Minutes Southold Town Board Meeting Cold War Veteran; unless the Cold War Veteran or unremarried surviving spouse is absent from the property due to medical reasons or institutionalization for up to five years. LATEST STATE EQUALIZATION RATE – The latest final equalization rate established by the state board. LATEST CLASS RATIO – The latest final class ratio established by the state board for use in a special assessing unit. §245-18. Cold War Veterans Exemption. A. Qualifying residential real property shall be exempt from taxation to the extent of fifteen percent (15%) of the assessed value of such property; provided, however, that such exemption shall not exceed twelve thousand dollars or the product of twelve thousand dollars multiplied by the latest state equalization or the latest class ratio, whichever is less. B. In addition to the exemption provided by paragraph A of this section, where the Cold War Veteran received a compensation rating from the United States veterans affairs or from the United States department of defense because of a service connected disability, qualifying residential real property shall be exempt from taxation to the extent of the product of the assessed value of such property, multiplied by fifty percent of the Cold War veteran disability rating; provided, however, that such exemption shall not exceed forty thousand dollars, or the product of forty thousand dollars multiplied by the latest state qualization rate or the latest class ratio, whichever is less. C. If a Cold War veteran receives the exemption under Article VI of this Chapter, the Cold War veteran shall not be eligible to receive the exemption under this section. D. The exemption provided by paragraph A of this section shall be granted for a period of ten years. The commencement of such ten year period shall be governed pursuant to this subparagraph. Where a qualified owner owns qualifying residential real property on the effective date of this section such ten year period shall be measured from the assessment roll November 20, 2007 Page 19 Minutes Southold Town Board Meeting prepared pursuant to the first taxable status date occurring on or after the effective date of this section. Where a qualified owner does not own qualifying residential real property on the effective date of this section, such ten year period shall be measured from the assessment roll prepared pursuant to the first taxable status date occurring at least sixty days after the date of purchase of qualifying residential real property; provided, however, that should the veteran apply for and be granted an exemption on the assessment roll prepared pursuant to a taxable status date occurring within sixty days after the date of purchase of residential real property, such ten year period shall be measured from the first assessment roll in which the exemption occurs. If, before the expiration of such ten year period, such exempt property is sold and replaced with other residential real property, such exemption may be granted pursuant to this subdivision for the unexpired portion of the ten year exemption period. E. Application for exemption shall be made by the owner, or all of the owners, of the property on a form prescribed by the state board. The owner or owners shall file the completed form in the Assessor’s Office on or before the first appropriate taxable status date. The owner or owners of the property shall be required to refile each year. Applicants shall refile on or before the appropriate taxable status date. Any applicant convicted of willfully making any false statement in the application for such exemption shall be subject to the penalties prescribed in the penal law. III. SEVERABILITY If any clause, sentence, paragraph, section, or part of this Local Law shall be adjudged by any court of competent jurisdiction to be invalid, the judgment shall not affect the validity of this law as a whole or any part thereof other than the part so decided to be unconstitutional or invalid. IV. EFFECTIVE DATE This Local Law shall apply to assessment rolls prepared on the basis of taxable status dates occurring on or after January 1, 2008. This Local Law shall take effect immediately upon filing with the Secretary of State as provided by law. I am here today to try to clarify, we have been receiving numerous phone calls by the residents of Southold Town pertaining to the town fall leaf and brush program. Why are we starting so early? As everyone can tell by looking at your trees, mother nature hasn’t really worked in our favor this year. The calendar says almost the end of November and we still have a tremendous amount of leaves on the trees. However, we have to set up a schedule and start and stick by it because just two years ago, we had two snowfalls in the first week in December. So, the fact of the matter is that it doesn’t say this in the advertisements that have been run in the paper but it has on the radio and I know not everyone listens to WLNG, so I am here tonight to announce that the Town Highway Department, we started our cleanup program yesterday and we will continue to pick up leaves and brush from Laurel all the way to Orient Point. I just want to, like I said, our phone has been ringing off the hook, however, the fact that, you know, I had to say to some of the residents that look, I have been looking at piles of brush for over two months, that has been sitting on the side of the road and one person says, you know, you are coming too soon another person says you didn’t come soon enough. That I want to put my Christmas decorations up and I don’t want, you know, you can’t see my Christmas decorations because the pile of brush that is in front of my house. So it is a win/lose situation no matter what we do, so the fact of the matter is, this is a program that the Town Highway does for the residents of this town to help you mitigate your yard waste, so just kind of bear with us, we have a lot of work out there that we could be doing that we take out time twice a year to do a spring cleanup and a fall cleanup and the fact that we will be back for the leaves but I will say this now, if you put the brush out again once we go through, we are not picking it up. So be prepared, you have had plenty of time to get your brush out there and that is all I have to say about that. The only other question I have is the, earlier prior to the meeting, I overheard something about raises for elected officials. Are you going to be discussing this? Adopting or something? Supervisor Russell SUPERVISOR RUSSELL: They were actually adopted as part of adopting the budget and the amendments. The raises are actually the raises the we could convey based on legality. That would be the Assessor’s, Justice’s, Tax Collector, Trustee’s. Justice Evans JUSTICE EVANS: The Town Board members, Superintendent of Highways and the Town Clerk are specifically exempted from having… MR. HARRIS: Omitted. JUSTICE EVANS: Supervisor. Once the preliminary budget is adopted… Town Attorney Patricia Finnegan TOWN ATTORNEY FINNEGAN: Once the, the salary that was published for Supervisor and Town Board, Town Clerk, Highway Superintendent was in the paper for the preliminary budget, can’t be raised again unless you do it separate by local law. You can’t raise it at this time. Supt Highways Peter Harris MR. HARRIS: So what you are trying to tell me is that the only salaries that were advertised were Town Board, Supervisor, Town Clerk and Highway Superintendent? Town Attorney Finnegan TOWN ATTORNEY FINNEGAN: The other elected officials salaries were advertised but they can be raised. The state law specifically prohibits raising those four that I mentioned above what was published in the notice for the preliminary budget. It doesn’t prohibit raising the other ones. The other salaries were raised 3% from what was initially published. Supt. Highways Harris November 20, 2007 Page 54 Minutes Southold Town Board Meeting MR. HARRIS: And that reason is and what is the, and your reasoning, again, Pat? Why they can’t for..? TOWN ATTORNEY FINNEGAN: The state law prohibits the Town from raising the salaries of those four positions once the salary has been published in the notice for the preliminary budget. In October, when we did the notice for the preliminary budget hearings, we published the salaries for elected officials. Councilman Wickham COUNCILMAN WICKHAM: And we did not provide for an increase at that time. Councilman Edwards COUNCILMAN EDWARDS: But, Pat, my understanding is that if the Town Board chose to adopt a local law which would be a little unusual but the situation is a little unusual, it could be done in that way. I have obviously said my say on this, I think it is unfortunate that it worked out this way. But I am just one vote, I don’t know that the Board has an appetite for that. As I said before, I think that not plugging in something just makes the situation worse in future years. Supervisor Russell SUPERVISOR RUSSELL: Bill had, Councilman Edwards had actually put a reasonable suggestion on the table. It was news to me and to him that we couldn’t touch those salaries after the preliminary budget had been adopted, he had decided to say, look, let’s get it out of political process and index it to a specific index. Whether you want to use consumer price index etc., that is a reasonable approach. Unfortunately we found out too late in the game that that could take place for this year but we are not in the new fiscal year yet, Pete, so we will talk to you and see what we can do. Supt Highways Harris MR. HARRIS: Okay. Just in the future, you know, I can remember sitting at a work session and it was about the budget and specifically that day they were talking about with me and different line items, kind of give and take and whatever and the discussion came up about salaries and they said, well, we can do it at a later date. I just, from henceforth, I certainly and I don’t, and I am not trying to stand here and say that I am not, want any other employees, whether they be elected or non-elected employees for this Town to receive a raise, I just certainly don’t feel that some people should be left out and everybody else get something. I am not saying they are not entitled, they shouldn’t but the fact of the matter is that we should have known sooner than later that due to state law that maybe before we go out and publish something, we should make sure we get all our homework done before we do something like that. Supervisor Russell SUPERVISOR RUSSELL: I will take absolute responsibility for that. MR. HARRIS: I am not, you know. SUPERVISOR RUSSELL: No, I agree. I agree. HARRIS: We do it on the majority here, not on a minority so… SUPERVISOR RUSSELL: Would anybody else like to come up and address the Town Board. Justice Evans JUSTICE EVANS: We received a letter from Barbara McAdam and she said to please read this letter into the minutes of your next meeting. “During the week of October 22, 2007 a traffic study was conducted in Cutchogue related to the proposed development of the Heritage. Both human and mechanical counters were on our street, however, for four of the days on which traffic was counted October 24, 25, 26 and 27 heavy rain and high winds prevailed. I have included the weather history from the weather channels official site. These inclement weather conditions kept many people, local residents and tourists alike off the roads, preventing an accurate traffic count for this time of year. Members of both the Planning Board and the Town Board said at the Town Board work session on September 11, 2007 that they would make the Heritage developer do the Cutchogue traffic study to their satisfaction rather than have the Town pay to do its own traffic study. Since Nelson and Pope Engineering are in the business of conducting traffic studies and surely had access to long range weather forecasts, the Town should make them conduct their study again to record more reliable data. The study also needs to reflect the same seasonal amount of traffic that the end of October usually generates here in Cutchogue. I would submit that the end of May would be a comparable and appropriate time to gauge the traffic in Cutchogue in another study. Sincerely, Barbara McAdam.” Supervisor Russell SUPERVISOR RUSSELL: Actually, she is actually 100% right. You can’t have traffic consultants gaming outcomes for applicants. The Town, the Planning Board and staff are actually of the weather conditions for that day and we have every right to reject the traffic study that comes forward if they don’t make accommodations for the weather and that we are exactly on top of that and she raises an excellent point, she has every right.
