SPECIAL MEETING
THURSDAY, APRIL 19, 2001
A Special Meeting of the SOUTHOLD TOWN ZONING BOARD OF APPEALS
was held at the Southold Town Hall, 53095 Main Road, Southold.
Present were:

6:30 P.M. Chairman Gerard P. Goehringer called the meeting to order and proceeded
with agenda items as follows:
STATE ENVIRONMENTAL QUALITY REVIEW: None.
DELIBERATIONS/DECISIONS/RESOLUTIONS OR OTHER: The Board
deliberated on the following applications. The originals of each of the
following applications were decided, with the original determinations
filed with the Southold Town Clerk:

PUBLIC HEARINGS: The following public hearings were held, with Chairman Goehringer
introducing each application, and Member reading of the Legal Notice as published:
6:55 p.m. Appl. No. 4937 - SOUTHOLD PARK DISTRICT. Motion was offered by
Chairman Geohringer, seconded by Member Horning, to accept letter from
applicant requesting withdrawal of application. Vote of the Board: Ayes: Ail.
This Resolution was duly adopted (5-0).
7:19 p.m. Appl. No. 4837 - H. CASHY. {Continued from 2/28; 3/15). C. Cuddy
Esq., Mr. Bossen, Owen Schroeder of NFEC; Mary Butz, Mr. Malady, J. Ciarelli,
Esq., Diane Ravich. This is a request for a Variance under Article XXIV, Section
100-239.4A. 1 to locate an accessory swimming pool and hot tub construction at
less than 100 feet from the bluff of the Long Island Sound; 1900 Hyatt Road,
Southold; 50-1-3. BOARD RESOLUTION: (Please see transcript of written
statements prepared under separate cover.) After receiving testimony, motion was
offered by Chairman Goehringer, seconded by Member Tortora, to close the verbal
portion and allow 5 days for response. Vote of the Board: Ayes: All. This
Resolution was duly adopted (5-0).
8:15 p.m. Member Horning left.
8:30 p,m. RESOLUTION (BREAK): Motion was offered by Chairman Goehringer,
seconded by Member Tortora, to take a short recess. Vote of the Board: Ayes:
All. This Resolution was duly adopted (5-0).
8:40 p.m. RESOLUTION (RECONVENE): Motion was offered by Chairman
Goehringer, seconded by Member Tortora, to reconvene the meeting. Vote of the
Board: Ayes: All. This Resolution was duly adopted (5-0).
8:40 p.m. Appl. No. 4921 - DORIS ANDERSON (owner) and JOHN HURTADO.
Applicants request variances under Article XXIII, Section 100-239.4A. 1, based on
the Building Department's December 20, 2000 Notice of Disapproval. Applicants
propos~e a new dwelling with setbacks at less than 100 feet form the top of the
bluff, less than 30 feet for combined side yard setbacks, and less than 40 feet
from the front property line. Location: 3400 Lighthouse Road, Southold; 1000-
50-2-2. BOARD RESOLUTION: (Please see transcript of written statements
prepared under separate cover.) Motion was offered by Chairman Goehringer,
seconded by Member Tortora, to recess the hearing to May 31, 2001, per
applicant's request. Vote of the Board: Ayes: All. This Resolution was duly
adopted (5-0).

Lot Waiver request for property located at Cpt. Kidd Estates, Mattituck.
BOARD RESOLUTION: (Please see transcript of written statements prepared under
separate cover.) After receiving testimony, motion was offered by Chairman
Goehringer, seconded by Member Collins, to close the hearing, reserving decision. Vote
of the Board: Ayes: All. This Resolution was duly adopted (4-0). Member Horning was
absent~
8:50 p.m. Appl. 4930 - JANE ROSS and JON SCHRIBER. Request for addition to
dwelling and recent Amendment to include an additional variance under Article III,
Section 100-244B, for the location of an "as built" pergola structure located in the front
yard on existing patio construction at less than 35 feet from the front property line, at
1295 Old Harbor Road, New Suffolk; 117-3-10. BOARD RESOLUTION: (Please see
transcript of written statements prepared under separate cover.) After receiving
testimony, motion was offered by Chairman Goehringer, seconded by Member Collins,
to close the hearing, reserving decision. Vote of the Board: Ayes: All. This Resolution
was duly adopted (4-0). Member Horning was absent.
