The meeting began at 7:14 p.m. with four LPC members present. Adoption of Meeting Minutes: ?? FORMAT FOR LPC MINUTES MOTION made by Lillian Ball, seconded by Monica Harbes, for the recorded minutes to include both discussion notes and Committee motions with indication of which items are discussion and which are motions. Further discussion ensued. Vote failed for lack of 4 affirmative votes needed to pass a motion: 3/0/1 (Ray Huntington abstained) MOTION made by Ray Huntington, seconded by Lillian Ball, that recorded minutes contain actions and commitments, and be accompanied by significant notes concerning LPC discussions. Vote failed for lack of 4 affirmative votes needed to pass a motion: 3/1 (John Sepenoski) LPC will re-evaluate in another month the content of meeting minutes to be recorded and adopted. ?? ACCEPTANCE OF MEETING MINUTES FROM AUGUST 18, 2009 AND SEPTEMBER 15, 2009 MOTION made by John Sepenoski, seconded by Eric Keil, to adopt the August 18, 2009 meeting minutes, as revised. Motion carried: 5/0 HOLD adoption of September 15, 2009 meeting minutes for further revisions. Applications and Inquiries: ?? GIRARDS PROPERTY SCTM #: 1000-107-10-10.1 PDR offered: ±8 acres Location: 6900 Wickham Ave, Mattituck Zoned: A-C Total Acreage: ±10.5 acres (GIS 10.18 acres) CPF: Yes Subdividable: No F/MWet: 0 acres Re-activate PDR application. Staff report prepared by Melissa Spiro, dated 9/23/09, was reviewed by Committee. Landowner made application to LPC in 2006, appraisal was prepared, and offer made by Committee was declined by landowner. Landowner is now requesting to re-activate his application for the sale of an 8± acre development rights easement to the Town, reserving a 2 acre area in the northwest corner of the property. The Committee discussed the proposed Reserve Area, the existing lot coverage and whether or not project should be referred to County Farmland. LPC accepted Reserve Area and decided that existing lot coverage was not concern for proposed PDR. Discussion with landowner appears that landowner is anxious to proceed at this time and Town is likely to proceed faster than County. MOTION made by Monica Harbes, seconded by Lillian Ball, to direct Melissa Spiro to commission an appraisal of the Girards property, with a two acre Reserve Area set aside in the northwest corner of the property that will include the majority of the existing buildings on the site. The easement area will include existing greenhouses and the easement will not restrict agricultural structures or lot coverage. Ag structures and lot coverage must all be in accordance with Town Code requirements. Motion carried: 5/0 Applications & Inquiries for Uses or Structures on Preserved Property: ?? SHINN ESTATES VINEYARDS SCTM #: 1000-100-4-3.2 PDR Acreage: 21.274 acres Location: 2000 Oregon Rd, Mattituck Zoned: A-C Continuation of review of David Page request for installation of wind turbine on PDR land. Melissa Spiro met with Town Attorney as directed by LPC for clarification purposes. MOTION made by Lillian Ball, seconded by John Sepenoski, to approve the construction of a wind turbine on the property known as SCTM #1000-100-4-3.2 (owned by Shinn Estates Vineyards), in the proposed and “preferred third” location as describe in written description submitted to the Land Preservation Committee on September 15, 2009 by David Page, and as hand drawn on an aerial photograph of the property, as applied for. The Committee is permitting this structure within the development rights easement on the condition that it is compatible with the purpose of the development rights easement and subordinate to the agricultural use of the property. The Committee’s approval does not mean that construction or such use will be approved or permitted by other Town Departments or agencies. The Committee’s approval allows the pursuit of any applicable approvals that are required by Town Code. Motion carried: 5/0 General Land Preservation Items: ?? PRESERVATION OUTREACH Discussion Forum for Cutchogue Farm Belt o Peconic Land Trust and the Town of Southold have planned an outreach event for Friday evening, October 23, 2009, from 5:30-7:00 p.m., that will be hosted by Lou & Lisa Carracciolo at their Mattituck property. Stephen Searl presented LPC with the printed invitation that will be mailed out to 70 farmland property owners in an area lying between Mattituck Inlet on LI Sound, south to NYS Rt 25, east to Peconic/Mill Lane, north to Goldsmith’s Inlet and west to Mattituck Inlet area. Members agreed that additional landowners that have been requesting preservation information should also be invited to attend and will be added to the invitation list. Members suggested that event should be followed-up with a press release. Town Farmland Outreach o Town Farmland Outreach Master List was reviewed by LPC members to gather farm contact information. ?? AGRICULTURAL ADVISORY COMMITTEE MEMO TO TOWN BOARD RE: $4 MILLION FARMLAND BOND REVIEW AND PREPARE COMMENTS. HOLD for October 13, 2009 meeting at request of Chris Baiz ?? MELISSA SPIRO’S CONFIDENTIAL STATUS REPORT AND FINANCIAL SNAPSHOP UPDATE [executive session re: status of offers] The members entered into EXECUTIVE SESSION. Melissa’s confidential status report was distributed and updates on current projects were discussed. END OF EXECUTIVE SESSION Melissa handed out financial snapshot update that was recently presented to the Southold Town Board and Board members, according to Councilman Al Krupski, found information contained therein useful and acceptable. Additions to Agenda: ?? GILLOOLY PROPERTY – SCTM #1000-25-2-20.20 Melissa was contacted as to Town’s possible interest in purchasing Gillooly property (SCTM #1000- 25-2-20.20) within Orient hamlet halo area. Informational: ?? SUFFOLK COUNTY FARMLAND COMMITTEE 9/29/09 MEETING UPDATE Not discussed due to time constraints. ?? MAARATOOKA NORTH, LLC PROJECT Town Board Public Hearing scheduled for Tuesday, October 6, 2009 at 7:34 p.m. th ?? LONG ISLAND 29 ANNUAL AGRICULTURAL FORUM – January 14 & 15, 2010 Melissa Spiro has requested permission from the Southold Town Board to attend the Ag Forum. Request was made of LPC members to volunteer to attend also. Next Regular Meeting: ?? The next regular meeting will be held on Tuesday, October 13, 2009, at 7:00 p.m., in the Annex Executive Board Room. Adjournment: ??
