THIS INDENTURE, made the day of April nineteen hundred and eighty—nine

party of the first part,and
KENYON H. TUTHILL and KATHRYN E. TUTHILL, his wife, residing at
675 Cedar Drive, Mattituck, New York 11952

WITNESSETH, that the party of the first part,in consideration of ten dollars and other valuable consideration
paid by the party of the second part, does hereby grant and release unto the party of the second part, the heirs
or successors and assigns of the party of the second part forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate,
lying and being cnximoc at Mattituck, in the Town of Southold, County of
Suffolk and State of New York, known and designated as Lots 10
and 11 on a certain map entitled, "Map of Property of Mattituck
Development Company, Inc. , Mattituck, Long Island, New York, " made
by Daniel R. Young, Surveyor, December 1922 and filed in the Suffolk
County Clerk's Office May 1, 1923 as Map No. 776, which said lots are
"unded and described as follows:

BEGFNNING at a point on the southwesterly side of Cedar Drive

southerly side of Bayview Avenue;
RUNNING THENCE along Cedar Drive the following:

DISTRICT THENCE from said point or place of beginning running thence along
1000 the southwesterly side of Cedar Drive South 37 degrees 53 minutes
East 100.00 feet;
SECTION THENCE South 52 degrees 07 minutes West, 150.00 feet;
106.00 THENCE North 37 degrees 53 minutes West, 100.00 feet;
BLOCK THENCE North 52 degrees 07 minutes East, 150.00 feet to the
10.00 southwesterly side of Cedar Drive at the point or place of BEGINNING.
LOT TOGETHER with an easement of ingress and egress over Cedar Drive to Bayview Avenue.

the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of
the first part well receive the consideration for this conveyance and will hold the right to receive such consid-
eration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply
the same first to the payment of the cost of the improvement before using any part of the total of the same for
any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indentpre so requires.
