SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without an adverse effect on the environment if the project is implemented as planned. PROPERTY FACTS/DESCRIPTION: The applicant's 219 acre site is improved with a firehouse with 40 ft. high tility pole with siren, a fire hydrant, roof access stairway, masonry garage, flagpole, and other improvements as shown on the site plan prepared by William F. Collins, A.I.A. dated 12/11/02, revised 6/25/03 (ref. survey prepared 11/18/02 by Barrett, Bonacci and VanWheele, P.C.). BASIS OF APPLICATION: Building Department's May 25, 2004, Notice of Disapproval, citing Code Section 100-162B.3 in its denial of a building permit application concerning a replacement of a wireless communications antenna and related equipment, for the reason that the proposed antenna (measured at 60 feet) projects higher than 20 feet above the average height of buildings, which is 23 feet. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on July 15, 2004, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: Applicant wishes to replace the existing 40 ft. high wooden pole with a new wireless telecommunications facility monopole at 60 ft. in height, on a 10' x 12' concrete pad, behind the firehouse along the northeast rear wall section. The property contains a firehouse and related equipment for emergency. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: 1. Grant of the relief requested will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The applicant is licensed by the FCC. The 60-ft. high tower will replace existing SFD 40-foot wooden pole. Applicants expert witness testified that 60' is the lowest possible height that will I~age 2 - August 2, 2004 · ZBA No. 5547 - Southold Fire District/Ol~Eqipoint CTM 62-2-11.1 enable Omnipoint to close the coverage gap. No testimony was presented to refute this statement. With regard to the design elements of the structure, the applicant's testimony confirmed that a "flagpole" design would reduce coverage, be twice as costly, and would prohibit the company from future heightening of the pole. A flagpole design was stated would require an additional 10' to 20' in height to ensure the same coverage as the pole design. 2. The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The applicant's expert witness, Nicholas Balzano, Radio Frequency Engineer, testified that there is a significant service gap in the Southold area, and that the height and location of the antenna is required to eliminate the gap. The gap affects coverage for the public, as well as police, fire, ambulance and emergency response personnel in Southold. 3. The vadance granted herein is substantial. The height of the new tower would exceed the code limit by 17 ft. (23' existing tree line plus 20 ft. allowed above code = 43 feet), for a 60 ft. height. 4. The difficulty has been self-created, as a result of the applicant's desire and need to replace the existing structure at a height which exceeds the code limitation of 43 feet, in this Hamlet Business (HB) Zone District. 5. No evidence has been submitted to suggest that the requested variance in this community of commercial and residential uses will have an adverse impact on the physical or environmental conditions in the neighborhood. There was no opposition to the wireless telecommunications facility, either written or oral testimony, presented in this matter. The benefits to the community of improved service and ensuring public safety outweigh the affects of the variance. 6. Grant of this relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a 60' wireless telecommunications facility, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Tortora, seconded by Member Dinizio, and duly carried, to GRANT the variance as applied for, as shown on the site plan dated 12/11/02 (SP-1), updated 56/25/03, prepared by William F. Collins, A.I.A. The applicant has confirmed that 43 feet would be code-permitted after calculating the 23 ft. average height of the trees, and 20 feet allowed above this average. Based on the information submitted, the variance relief is 17 feet over the allowable 43 feet, and the tower will not exceed 60 feet. We will help to assist in your reviews. Rosenberq, 82 N.Y.2d 364, held that a provider of wireless telecommunications services is considered a public utility for zoning purposes, and that the public utility exception to the test for unnecessary hardship, warranting the grant of a height variance applies. In its decision the Court stated, "It has long been held that a zoning board may not exclude a utility from a community where the utility has show a need for its facilities." In addition, the Court stated, '~/Vhere the intrusion or burden on the community is minimal, the showing required by the utility should be correspondingly reduced." In this case, the applicant, which is licensed by the Federal Communications Commission to provide service in Suffolk County, has a significant service gap in the Southold area and cannot provide reliable service to its customers as required. In order to eliminate its service gap, it must establish an antenna facility in a location and at a height determined by its engineers. The proposed facility would be located in the Hamlet Business District, and is proposed to be 60 feet in height. Accordingly it complies with Section 100-162, and would be a permitted use, but for its lack of compliance of Section 100-162B.3. The facility will be designed to have as little visual impact as possible on the surrounding area, and is not out of character in the Hamlet Business District.
