Kevin McLaughlin, Esq. on behalf of GEORGE, FLORENCE, ALEXANDER & DEMETRIOS VASILAKIS applied to the Southold Town Trustees for an Amendment to Wetland Permit#7178 and Coastal Erosion Permit#7178C under the provisions of Chapter 275 of the Southold Town Code, the Wetland Ordinance of the Town of Southold, and Chapter 111 of the Southold Town Code, Coastal Erosion Hazard Areas, applications dated September 29, 2010, and, WHEREAS, said applications were referred to the Southold Town Conservation Advisory Council and to the Local Waterfront Revitalization Program Coordinator for their findings and recommendations, and, WHEREAS, the LWRP Coordinator recommended that the proposed applications be found Inconsistent with the LWRP, specifically Inconsistent with the following Coastal Policy: Policy 6.3 — Protect and restore tidal and freshwater wetlands, and, WHEREAS, Wetland Permit#7178 and Coastal Erosion Permit#7178C were issued to construct approx. 137 If. of vinyl retaining wall in place of existing timber retaining wall and backfill with approx. 25 cy. clean sand to be trucked in from an upland source and planted with Cape American Beach Grass (12"on center); construct a 10'easterly return; construct a 4'X 6'cantilevered wood platform and 3'X 15'seasonal stairs to the • 2 is beach; and remove the existing 14'X 12'deck and stairs down bluff during construction and replace onto new decking posts while repairing only necessary areas to damage from removal, with the conditions that the existing 14X 12'deck with stairs down the bluff cannot be reconstructed without further review from the Board of Trustees, and the installation of+/- 500-1000 Ib. stone toe armor along the retaining wall, and, WHEREAS, the 14'X 12' deck and stairs were removed and reconstructed without the benefit of a further review from the Board of Trustees, and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the deck and stairs, as applied for, do not comply with the standards set forth in Chapter 275-11 (A) (6) of the Southold Town Code, and Chapter 111-14 (A) of the Southold Town Code, in that no decks or platforms shall be permitted on or near bluffs, and, WHERAS, the Board has determined that the structure will have a detrimental effect upon the health, safety and general welfare of the people of the town, and, NOW THEREFORE BE IT, RESOLVED, that for the foregoing reasons, and based upon the application's failure to meet the standards contained in Chapter 275 of the Town Code, that the Board of Trustees deems the proposed project to be Inconsistent with the Local Waterfront Revitalization Program pursuant to Chapter 268-5 of the Southold Town Code, based on the size and location of the existing structure, and, BE IT FURTHER, RESOLVED, that the Southold Town Board of Trustees DENIES WITHOUT PREJUDICE the applications to Amend Wetland Permit#7178 and Coastal Erosion Permit#7178C to include the as-built 14'X 12' deck and stairs down the bluff, as applied for. The Department objects to the placement of the stone armor. Apparent high water is located at the seaward face of the bulkhead. Since apparent high water is located at the seaward face of the bulkhead, the placement of the stone toe armor along the seaward tow of the bulkhead is considered as the filling of tidal wetlands(shoals,mudflats and littoral zone), a presumptively incompatible use under section 661.5(b)(30). The placement of the stone toe armor would be submerged at high tide and would not deflect wave energy or offer protection against scour. The placement of the stone toe armor would negatively impact the benthic habitat and will not improve the security of the bulkhead. As an alternative, the Department could authorize the placement of batter piles along the face of the bulkhead for reinforcement. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is CONSISTENT with the Policy Standards and therefore is CONSISTENT with the LWRP provided that the following recommendations to further the below listed policies are implemented. Policy 6. Protect and restore the quality and function of the Town of Southold ecosystem 6.3 Protect and restore tidal and freshwater wetlands. E. Maintain buffers to ensure that adverse effects of adjacent or nearby development are avoided: 1. Maintain buffers to achieve a high filtration efficiency of surface runoff. 2. Avoid permanent or unnecessary disturbance within buffer areas. 3. Maintain existing indigenous vegetation within buffer areas. If the action is approved it is recommended that the Board require the establishment of a perpetual landscaped buffer landward from the top-of-bluff line. A sample definition follows: LANDSCAPED BUFFER -- a land area of a certain length and width which is planted with indigenous, drought tolerant, vegetation similar to that found within the immediate proximity of the parcel. Vegetation shall be installed in sufficient densities to achieve ninety-five (95) percent ground cover within two years of installation. Survival of planted vegetation shall be (ninety) 90 percent for a period of three years. Maintenance activities within the buffer are limited to removing vegetation which are hazardous to life and property, trimming tree limbs up to a height of fifteen feet (15') to maintain viewsheds, replanting of vegetation and establishing a four foot (4') wide access path constructed of pervious material for access to the water-body. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action.
