AUTHORIZATION
Pursuant to the provisions of Chapter 275 and/or Chapter 111 of the Town Code of the Town of
Southold and in accordance with the Resolution of the Board of Trustees adopted at the meeting held on
June 18, 2008, and in consideration of application fee in the sum of $250.00 paid by Stacy Sheppard and
subject to the Terms and Conditions as stated in the Resolution, the Southold Town Board of Trustees
authorizes and permits the following:
Wetland Permit for the existing 49' jetty, with the condition that when it is
rebuilt it is to be a built as a low-profile groin, and as depicted on the site plan prepared
by Costello Marine Contracting Corp., last dated March 27, 2008, and received on
April 8, 2008.
IN WITNESS WHEREOF, the said Board of Trustees hereby causes its Corporate Seal to be affixed,
and these presents to be subscribed by a majority of the said Board as of this date.
TERMS AND CONDITIONS
The Permittee Stacy Sheppard, residing at 200 Airway Drive, Mattituck, New York as part of
the consideration for the issuance of the Permit does understand and prescribe to the following:
That the said Board of Trustees and the Town of Southold are released from any and all
damages, or claims for damages, of suits arising directly or indirectly as a result of any
operation performed pursuant to this permit, and the said Permittee will, at his or her owen
expense, defend any and all such suits initiated by third parties, and the said Permittee
assumes full liability with respect thereto, to the complete exclusion of the Board of
Trustees of the Town of Southold.
That this Permit is valid for a period of 24 months, which is considered to be the estimated
time required to complete the work involved, but should circumstances warrant, request for
an extension may be made to the Board at a later date.
That this Permit should be retained indefinitely, or as long as the said Permittee wishes to
maintain the structure or project involved, to provide evidence to anyone concerned that
authorization was originally obtained.
That the work involved will be subject to the inspection and approval of the Board or its
agents, and non-compliance with the provisions of the originating application may be cause
for revocation of this Permit by resolution of the said Board.
That there will be no unreasonable interference with navigation as a result of the work
herein authorized.
That there shall be no interference with the right of the public to pass and repass along the
beach between high and Iow water marks.
That if future operations of the Town of Southold require the removal and/or alterations in
the location of the work herein authorized, or if, in the opinion of the Board of Trustees,
the work shall cause unreasonable obstruction to free navigation, the said Permittee will be
required, upon due notice, to remove or alter this work project herein stated without
expenses to the Town of Southold.
That the said Board will be notified by the Permittee of the completion of the work
authorized.
That the Permittee will obtain all other permits and consents that may be required
supplemental to this permit, which may be subject to revoke upon failure to obtain same.

Dear Ms. Sheppard:
The Board of Town Trustees took the following action during its regular meeting held on
Wednesday, June 18, 2008 regarding the above matter:
WHEREAS, STACY SHEPPARD applied to the Southold Town Trustees for a permit
under the provisions of Chapter 275 of the Southold Town Code, the Wetland
Ordinance of the Town of Southold, application dated April 8, 2008, and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory
Council and to the Local Waterfront Revitalization Program Coordinator for their findings
and recommendations, and,
WHEREAS, the LWRP Coordinator issued a recommendation that the application be
found Consistent with the Local Waterfront Revitalization Program policy standards,
and,
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said
application on June 18, 2008, at which time all interested persons were given an
opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the
premises in question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,

WHEREAS, the structure complies with the standards set forth in Chapter 275 of the
Southold Town Code,
WHEREAS, the Board has determined that the project as proposed will not affect the
health, safety and general welfare of the people of the town,
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees have found the application to be Consistent
with the Local Waterfront Revitalization Program, and,
RESOLVED, that the Board of Trustees approve the application of STACY SHEPPARD
for the existing 49' jetty, with the condition that when it is rebuilt it is to be a built as a
Iow-profile groin, and as depicted on the site plan prepared by Costello Marine
Contracting Corp., last dated March 27, 2008, and received on April 8, 2008.
Permit to construct and complete project will expire two years from the date the permit
is signed. Fees must be paid, if applicable, and permit issued within six months of the
date of this notification.
Inspections are required at a fee of $50.00 per inspection. (See attached schedule.)

STACY SHEPPARD requests a Wetland Permit for the existing 49' jetty. Located: 710 Park
Ave. Ext., Mattituck. SCTM#123-8-28.
The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the
Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy
Standards. Based upon the information provided on the LWRP Consistency Assessment Form
submitted to this department, as well as the records available to me, it is my recommendation that
the proposed action is CONSISTENT with LW'RP Policy standards and therefore is
CONSISTENT with the LWRP.
Policy 6 Protect and restore the quality and function of the Town of Southold
ecosystem.
6.3 Protect and restore tidal and freshwater wetlands.
A. Comply with statutory and regulatory requirements r?f the Southold Town Board of
Trustees laws and regulations for all Andros Patent and other lands under their
jurisdiction
1. Comply with Trustee regulations and recommendations as set forth in
Trustee permit conditions.
It aooears that the existing groin is functioning and serving the purpose for which it was
designed nursuant to § 275-2.
§ 275-2 Definitions; word usage.

FUNCTIONAL JETTY/GROIN -- A jetty or groin that is at least 75%physically intact and
servinlt the nurt~oses for which it was designed.
The proposed Ilroin is within an exi~tlno_ groin field which is currently serving as part of a
whole in the stabilization of the coastline. Therefore the proposed action may be necessary,
to further the protection of the principal structure and immediate homes within this coastal
peninsular location consistent with LWRP Natural Coast sub-policy 4.1 as referenced
below.
NATURAL COAST POLICIES
Policy Standard
4.1 Minimize losses of human life and structures from flooding and erosion hazards.
The following management measures to minimize losses of human life and structures
from flooding and erosion hazards are suggested:
D. Use hard structural erosion protection measures for control of erosion only
where:
4. Construction of a hard structure is the only practical design consideration
and is essential to protecting the principal use.
Further the proposed action is for the existing groin and will not result in a net increase of
structure on the shoreline. Which is c~naiatrut with the Peconic Estuary Program "No Net
Increase" policy of harden structures on the shoreline as noted in the Town of Southold's
Pursuant to ~ 275-11, the applicant must comply with all standards for the construction of
groins.
§ 275-11 Construction and operation standards.
C. In water. The following standards are required for all in-water operations adjacent to
residential properties. Operations conducted on properties zoned M1 or M2 may be given greater
flexibility in these requirements given the water-dependent nature of their use.
(1)
Jetties and groins; general roles. [Amended 10-11-2005 by L.L. No. 17-2005]
(a) Only low-profile jetties as defined in § 275-11 will be permitted.
(b) Only in-place replacement of existing low-profile functional jetties and
groins (as defined in § 275-2) is permitted.
(c) Pre-backfilling of jetties and groins may be required.
(d) In order to prevent the release of metals and other contaminants into the wetlands
and waters of Southold, the use of lumber treated with chromated copper arsenate
(also known as "CCA"), creosote, penta products or homemade wood
preservatives is prohibited for use in sheathing and decking.
Preservatives of any type, including but not limited to those listed above,
cannot be applied to any jetty or groin after installation.
(e) The use of tropical hardwoods is not permitted unless it is certified by the Forest
Stewardship Council or similar organization.
(f) No new jetties or groins will be permitted unless the work results in a net
decrease in the total number of jetties in the subject area.
(g) All applicants for jetties and groins extending across the foreshore shall be
required to give and maintain a public passing way, on the upland, not less than
five feet in width, to enable persons to pass and repass over said structure by
steps or a ramp allowing pedestrian passage.

LWRP CONSISTENCY ASSESSMENT FORM
A. INSTRUCTIONS
All applicants for permits* including Town of Southold agencies, shall complete this CCAF for
proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law. This
assessment is intended to supplement other information used by a Town of Southold agency in
making a determination of consistency. *Except minor exempt actions including Building Permits
and other ministerial permits not located within the Coastal Erosion Hazard Area.
Before answering the questions in Section C, the preparer of this form should review the exempt
minor action list, policies and explanations of each policy contained in the Town of Southold Local
Waterfront Revitalization Program. A proposed action will be evaluated as to its significant
beneficial and adverse effects upon the coastal area (which includes all of Southold Town).
If any question in Section C on this form is answered "yes" or "no", then the proposed action will
affect the achievement of the LWRP policy standards and conditions contained in the consistency

I, Jay Parker Wickham am presenting this dialogue and Photographs on behalf of my Daughter, Stacy
Sheppard pursuant to the public session of Wednesday, May 21, 2008 which both she and I attended.
Re: Wetlands permit application by Stacy Sheppard for an existing 49' jetty located at 710 Park Avenue
Extension, Mattituck, New York. SCTM#123-8-28.5.
On May 22, 2008 1 took the enclosed photographs of the jetty in question. I dug holes in the send to find all
of the original length and the northerly most end as it now exists.
Photo #1 depict the only remaining post above the current sand level. Photo #2 shows the Dram jetty to the
west and that no Sheppard jetty protrudes above the current sand level. (I believe there was some concern
on Mr. Ghosio's part that a "safety" hazard existed).
Photos #3 and #4 depict the drum property looking west at what may have been misconstrued as the
Sheppard jetty. Please note the condition of those existing jetties.
Photos #5 and #6 depict the existing Shappard jetty. Post "A" can be seen clearly as Post "A" in the photos
taken 1 day subsequent to the summons being enforced. 2006. I also took these photographs.
Photos #7 and #8 depict protrusion "B" which is part of the original jetty and hole "C" is the continuation
northward of that original jetty. As you can see almost 12" below current sand level and rotten so as to
easily be broken away even with careful excavation with a shovel. Line "D" is the line on which I dug the
remaining holes to identify the line of the original jetty.
Photos #9 and #10 depict the digging northward and show the rotten fragments of the original jetty(not any
of these photo show the repair board (2X6) or the northerly end post (4x4) that were installed in 2006 that
prompted the summons). It has either been washed away or the ice took it away.
Photos #11 and #12 depict the only existing post ("A") protruding from the current sand level and the
shovel excavation to locate the original jetty and it's northerly end post. Again, none oftha repair that
prompted the execution of the summons in 2006 remains either above the current sand level or below.
Photos # 13 and #14 depict original jetty rotten protrusion "B" looking northward to the Sheppard house
and #14 to the south with protrusion "B" in the foreground.
Photos #15 and #16 depict the most northerly rotten end post of the original jetty.
Photos #17 and #18 depict the most northerly "E" end post of the original jetty and a "clean" dig hole with
no sand discoloration by rotten wood. Please note the dark particles in these photos. They are rotten wood
and in photo #17 notice the send discoloration in the two holes. This is the only remaining sign of the
original jetty in this area.
In closing, I am in hopes that this negates all fears of a "safety" hazard and shows no sign of any of the
repair prompting the summons from 2006.
Please notice Stacy or myself so as to help you in any way to resolve this situation and permit the existing
jetty in an "as is" condition. If Stacy is to one day have a new low profile groin installed through proper
permitting, please take into consideration her resolve and many hours and trips to the town halt in order to
do the "right thing" in a most unfortunate situation where she did nothing wrong other than be the owner of
a property that an 86 year old man made a mistake and repaired an ice damaged portion of an existing jetty
