TERMS AND CONDITIONS The Permittee Charles Casarona & Joseph Casarona, residing at 55 Glen Court, Cntchogue, New York as part of the consideration for the issuance of the Permit does understand and prescribe to the following: That the said Board of Trustees and the Town of Southold are released bom any and all damages, or claims for damages, of suits arising directly or indirectly as a result of any operation performed pursuant to this permit, and the said Permittee will, at his or her own expense, defend any and all such suits initiated by third parties, and the said Permittee assumes full liability with respect thereto, to the complete exclusion of the Board of Trustees oftha Town of Southold. That this Permit is valid for a period of 24 months, which is considered to be the estimated time required to complete the work involved, but should circumstances warrant, request for an extension may be made to the Board at a later date. That the work involved will be subject to the inspection and approval of the Board or its agents, and non-compliance with the provisions of the originating application may be cause for revocation of this Permit by resolution of the said Board. That there will be no unreasonable interference with navigation as a result of the work herein authorized. That there shall be no interference with the right of the public to pass and repass along the beach between high and low water marks. I have no objection to this worthwhile project by the applicants. However, the application does not state how the applicants intend to truck in 220 cubic yards of sand and erosion control matting etc. to the work site. If the contractor is going to do it by way of the beach by gaining access at the end of Duck Pond Road, I certainly have no objection. However, if they are going to truck in this material over Birch Lane and Glen Court, then some sort of permission should be had from the Birch Hills Property Owners Association, Inc., the owner of these roads. At the very minimum a surety bond or other type of cash deposit should be paid to the Association in the event there is any damage to these residential roadways which are currently in good shape.
