Present Were: Absent Were: James Eckert, Chairman Jack McGreevy, Member Peter Young, Member Doug Hardy, Member Greta Schiller, Member Dave Bergen, Trustee Lauren Standish, Secretary Anne Tdmble, Member Scott Worth, Student Member CALL TO ORDER Chairman James Eckert called the meeting to order at 4:30 PM. OLD BUSINESS Member Peter Young presented his draft of the mooring study to the members for mid- course corrections, additions, and suggestions. Trustee Dave Bergen re-iterated that enforcement was still a problem. The other members provided their input and Peter will incorporate the changes and prepare a preliminary draft budget. NEW BUSINESS Member Jack McGreevy proposed to support the Town Board in opposing the proposal of Saltwater Fishing License fees. After a bdef discussion with the Supervisor, Jack volunteered to attend the next Town Board worksession on Tues., September 22, 2009. The other members would also make an effort to attend. APPROVAL OF MINUTES Moved by Peter Young seconded by Jack McGreevy, to Approve the Minutes of August 12, 2009. DISCUSSION AND RECOMMENDATION OF WETLAND PERMIT & COASTAL EROSION PERMIT APPLICATIONS Moved by Jack McGreevy, seconded by Doug Hardy, it was RESOLVED to SUPPORT the Wetland Permit application of MICHAEL KENIN to install six (6) Helical Screw Anchors within the central section of the exiting timber bulkhead. Excavate an area along the landward side of the timber bulkhead measuring 6.0' in width in order to property route the screw anchors into the landward grade. Upon installation of screw anchors, backfill aroa with excavated soils and grade accordingly. Located: 420 Lakeview Terrace, East Marion. SCTM#31-9-11 Inspected by: Doug Hardy, Jack McGreevy The CAC Supports the application with the Condition of a 10' non-turf buffer. Vote of Council: Ayes: All Motion Carried Moved by Jack McGreevy, seconded by Doug Hardy, it was RESOLVED to SUPPORT the Wetland Permit application of STEPHEN & VIRGINIA McCONNELL to legalize approx. 289 sq.ft, of deck and steps, including approx. 130 sq.ft. of pre-existing deck and steps reconstructed without a wetlands permit and approx. 159 sq.ft, of additional deck and steps constructed without a wetlands permit; and establish a 5' wide, approx. 146 sq.ft, non-turf buffer to be maintained and/or planted with native vegetation along the top of the bank. Vote of Council: Ayes: All Motion Carried 3 Moved by Jack McGreevy, seconded by Doug Hardy, to TABLE the Wetland Permit application of MICHAEL KENNA to construct a 3'X 60' fixed catwalk with a 32"X 14' seasonal aluminum ramp onto a 6'X 20' seasonal floating dock secured by two 2-pile dolphins 6" in diameter. Located: 3200 Minnehaha Blvd., Southold. SCTM#87-3-39 Inspected by: Jack McGreevy, Doug Hardy The application was Tabled because the proposed docking facility wasn't staked. Vote of Council: Ayes: All Motion Carded Moved by Jack McGreevy, seconded by Doug Hardy, it was RESOLVED to SUPPORT the Wetland Permit application of ANTHONY FOROSlCH to renovate and construct additions to the existing 1% story dwelling with two additions to the footprint, addition to garage, and new covered porches on landward and seawards sides of dwelling. Located: 1405 Anchor Lane, Southold. SCTM#79-4-4.1 Inspected by: Jack McGreevy, Doug Hardy The CAC Supports the application with the Condition gutters, leaders, and drywells are installed to contain roof ton-off, the installation of a 20' non-turf buffer, and the drainage problem is addressed. Vote of Council: Ayes: All Motion Carried Moved by Peter Young, seconded by James Eckert, it was RESOLVED to SUPPORT the Wetland Permit application of MICHAEL & DEBORAH THOMPSON to construct a first floor addition of 17.9 sr. and second floor 129.2 sf. living space to expand kitchen on first floor, extend bedroom and add two dormers on second floor. Rebuild rear deck 481.5 sf. total (30.1 sr. more than existing), rebuild side deck 113.3 sf. and expand front porch by 19.9 sr. (total 135.2 sr.), new pool and patio. Located: 9280 Nassau Point Rd., Cutchogue. Vote of Council: Ayes: All Motion Carried Moved by Jack McGreevy, seconded by Doug Hardy, it was 4 RESOLVED to SUPPORT the Wetland Permit application of CHERYL HANSEN to construct a single-family dwelling, driveway and sanitary system. Located: 405 Williamsburg Dr., Southold. SCTM#78-5-17 Inspected by: Jack McGreevy, Doug Hardy The project was not staked, however the CAC Supports the application, as applied for. .Vote of Council: Ayes: All Motion Carried Moved by Jack McGreevy, seconded by Doug Hardy, it was RESOLVED to SUPPORT the Wetland Permit application of WILLIAM H. LIEBLEIN {PORT OF EGYPT) to construct wood walkways and a deck onto the existing restaurant, a 10'X 37' roof extension, and gable appliqub along the north side to hide the mechanical equipment. Located: 62300 Main Rd., Southold. SCTM#56-6-6.1 Inspected by: Doug Hardy, Jack McGreevy The CAC Supports the application with the Condition appropriate construction materials are used, a pervious surface beneath the deck, and the serious drainage problems that currently exist on the parking lot are addressed. Vote of Council: Ayes: All Motion Carried Moved by Jack McGreevy, seconded by Doug Hardy, it was RESOLVED to SUPPORT the Wetland Permit application of JONATHAN ZANG to demolish the existing dwelling; construct a new four bedroom dwelling and two-car detached garage; new sanitary system with fill and retaining wall; and new fill on the seaward side of the dwelling. Vote of Council: Ayes: All Motion Carried Moved by Peter Young, seconded by Jack McGreevy, it was RESOLVED to SUPPORT the Wetland Permit and Coastal Erosion Permit applications of JOHN BIGGANE to restore the washed out area of bluff face in conjunction with neighboring property owner to east via placement of portion of approx. 700 cy. clean sand and erosion-control matting; planting of native vegetation; construction of portions of two vinyl terrace retaining walls; and establishment of a portion of a 15' wide non-turf buffer (inclusive of 3' wide planted berm). Located: 8871 Oregon Rd., Cutchogue. SCTM#83-1-34 Inspected by: Peter Young, Greta Schiller The CAC Supports the applications, however the existing drywell appears to be too close to the top of the bluff, and therefore recommends an additional drywell is installed landward of the berm and located further back from the face of the bluff. The CAC also recommends the installation of erosion control devices parallel to the bluff face. Vote of Council: Ayes: Ail Motion Carded Moved by Peter Young, seconded by Jack McGreevy, it was RESOLVED to SUPPORT the Wetland Permit and Coastal Erosion Permit applications of JOSE SUQUET to restore two washed out areas of bluff face in conjunction with neighboring property owners to west and east via placement of portion of approx. 920 cy. clean sand and erosion-control matting; planting of native vegetation; construction of portions of four vinyl terrace retaining walls; and establishment of portions of two 15' wide non-turf buffers (inclusive of 3' wide planted berm). Located: 8869 Oregon Rd., Cutchogue. Vote of Council: Ayes: All Motion Carded Moved by Peter Young, seconded by Jack McGreevy, it was RESOLVED to SUPPORT the Wetland Permit and Coastal Erosion Permit applications of CHARLES CASARONA & JOSEPH CASARONA to restore washed out area of bluff face in conjunction with neighboring property owner to west via placement of portion of approx. 220 cy. clean sand and erosion-control matting; planting of native vegetation; construction of portions of two vinyl terrace retaining walls; and establishment of a portion of 15' wide non-tuff buffer (inclusive of 3' wide planted berm). Located: 55 Glen Court, Cutchogue. SCTM#83-1-36.1 Inspected by: Peter Young, Greta Schiller The CAC Supports the applications, however the existing drywell appears to be too close to the top of the bluff, and therefore recommends an additional drywell is installed landward of the berm and located further back from the face of the bluff. The CAC also recommends the installation of erosion control devices parallel to the bluff face. Vote of Council: Ayes: All Motion Carried Moved by Jack McGreevy, seconded by Doug Hardy, it was RESOLVED to SUPPORT the Wetland Permit application of SCOTT & JENNIFER SCHULMAN to demolish the existing one-story dwelling and construct a new single- family, two-story dwelling with covered porch located 5.5' father from wetlands and in line with neighboring dwellings; abandon existing sanitary system located less than 100' from wetlands and install new, upgraded sanitary system more than 100' from wetlands; install a drainage system of drywells; and establish 5' wide non-turf buffer adjacent to top of slope in place of existing lawn. SCTM#70-5-41 Inspected by: Doug Hardy, Jack McGreevy The CAC Supports the application with the Condition the erosion problems are addressed, the cement block wall is repaired, a catch basin or pervious area is installed to contain run-off, and gutters, leaders and drywells are installed to contain the roof run-off. Vote of Council: Ayes: All Motion Carried Moved by Jack McGreevy, seconded by Doug Hardy, it was RESOLVED to SUPPORT the Wetland Permit application of SOUTHVlEW CUSTOM BUILDERS for the subdivision of a 14.54 acre property into three lots, construction of three single-family dwellings with associated sanitary systems and access gravel driveway. Located: South Side of Main Bayview Rd., Southold. SCTM#87-5- 21.4,21.7,21.9,21.10,21.11,21.12,21.13 Inspected by: Jack McGreevy, Doug Hardy The CAC Supports the application with the Condition the vernal pond is protected and efforts are made to save as many trees as possible, over and 8" DBH. Vote of Council: Ayes: All Motion Carried Moved by Jack McGreevy, seconded by James Eckert, it was RESOLVED to SUPPORT the Wetland Permit and Coastal Erosion Permit applications of GEORGE, FLORENCE, ALEXANDER & DEMETRIOS VASlLAKIS to construct approx. 137 linear ft. of vinyl retaining wall in place of existing timber retaining wall and backfill ? with approx. 25 cy. clean sand to be trucked in from an upland source and planted with Cape American beach grass (12" on center); construct a 4'X 6' cantilevered wood platform and 3'X 15' stairs to the beach; and reconstruct (in-place) existing deck and stairs down bluff. Located: 21625 Soundview Ave., Southold. SCTM#135-1-6 Inspected by: Doug Hardy, Jack McGreevy The CAC Supports the applications with the Condition of a 10' non-turf buffer, no stairs are constructed seaward of the bulkhead, the proposed stairs are properly engineered, and erosion control devices are placed at the footings of the posts. Vote of Council: Ayes: All Motion Carried Moved by Doug Hardy, seconded by Jack McGreevy, it was RESOLVED to SUPPORT the Wetland Permit application of JOHN & DANIELLA VENETIS to demolish and reconstruct the first floor, if required; construct new second- floor over existing first floor; raise foundation for FEMA; new front steps and front overhang; reconstruct wood deck and add a covered deck (roof); and upgrade the sanitary system, if required. The next meeting of the Conservation Advisory Council has been set for Wed., October 14, 2009 at 4:30 PM at Down's Farm Preserve.
