93.4% interest in the premises as tenants in common;
party of the first part, and
PATRICIA DIVELLO, as Trustee of the THE EDWARD. W.
HARBES, JR. TRUST #II, under agreement dated June 16,
2009, residing at 220 Blossom Bend, Mattituck, New..York
11952, Trustee, as to an 18.75% interest in the

dated June 16, 2009, Patricia DiVello, residing at 220

and Peter H. Harbes, residing at 935 Laurelwood Drive,
Laurel, New York 11948, as Trustees, as to a 27.95%
interest in the premises; party of the second part,
WITNESSETH, that the party of the first part, in
consideration of Ten Dollars and other valuable
consideration paid by the party of the second part, does
hereby grant and release quitclaim unto the party of the
second part, the heirs or successors and assigns .of the
party of the second part forever, all of the party of
the first part's interest in
ALL that certain plot, piece or parcel of land, with
buildings and improvements thereon erected, situate,
lying and being in the Hamlet of Mattituck, Town of
Southold, County of Suffolk, State of New York;
BEGINNING at a point on the westerly line of Aldrich
Lane at the southeasterly corner of land of Koroleski,
200.00 feet southerly along Aldrich Lane from Sound
Avenue, said point of beginning being the northeasterly
corner of the premises herein described; running thence
along Aldrich Lane five courses;
1) South 18 degrees 53 minutes 50 seconds East, 550.73
feet; thence
2) South 22 degrees 55 minutes 20 seconds East, 206.05
feet; thence
3) South 27 degrees 25 minutes 20 seconds East, 46.93
feet; thence
4) South 24 degrees 55 minutes 20 seconds East, 61.81
feet; thence
5)
South 21 degrees 55 minutes 20 seconds East, 135.0
feet to Plot D; thence along Plot D South 71 degrees
31 minutes 30 seconds West, 585.72 feet to Plot B;
thence along Plot B North 19 degrees 59 minutes 10
seconds West, 1139.36 feet to land of Jens; thence
along said land and along land of Koroleski North 85
degrees 16 minutes 30 seconds East, 590.28 feet to
the point of BEGINNING.
Containing 13.946 acres.
BEING AND INTENDED TO BE a portion of the same premises
conveyed to the Grantor by Deed dated September 7, 2006
and recorded in the Suffolk County Clerk's Office on
October 13, 2006 in Liber D00012474, page 088, the
Grantor being the same person described as the Grantee
in said Deed. An additional 2.2% of the premises was
conveyed by the Grantor by Deed dated December 20, 2006
and recorded in the Suffolk County Clerk's Office on
February 25, 2008 in Liber D00012541 page 709. An
additional 2.2% of the premises was conveyed by the
Grantor by Deed dated January 2, 2007 and recorded in
the Suffolk County Clerk's Office on May 5, 2008, in
Liber D00012549, page 808. An additional 2.2% of the
premises was conveyed by the Grantor by Deed dated
December 14, 2008 and recorded in the Suffolk County
Clerk's Office on December 22, 2008, in Liber D00012575,
page 657.
The aforesaid parcel was created by virtue of a
resolution adopted by the Town of Southold Planning
Board held on May 24, 1993.
Together with all right, title and interest, if any, of
the party of the first part in and to any streets and
roads abutting the above-described premises to the
center lines thereof;
Together with the appurtenances and all the estate and
rights of the party of the first part in and tg said
premises;
To have and to hold the premises herein granted unto the
party of the second part, the heirs or successors and
assigns of the party of the second part forever.
And the party of the first part covenants that the party
of the first part has not done or suffered anything
whereby the said premises have been encurabered in any
way whatever, except as aforesaid.
And the party of the first part, in compliance with
Section 13 of the Lien Law, covenants that the party of
the first part will receive the consideration for this
conveyance and will hold the right to receive such
consideration as a trust fund to be applied first for
the purpose of paying the cost of improvement and will
apply the same first to the payment of the cost of the
improvement before using any part of the total of the
same for any other purpose. The word "party" shall be
construed as if it read "parties" whenever the sense of
this indenture so requires.
